June 22, 1999 Issues Consider and Act Upon an Ordinance Annexing all of a certain 136.339 Acre tract situated in the William Patterson Survey, Abstract No. 716, Collin County, Texas and being a portion of a 157.53 acre tract of land according to the deed recorded in Volume 254, Page 563 of the Deed Records of Collin County, Texas(DRCCT). Background The City of Wylie has received a request for annexation from Kurtz- Bedford Associates, Incorporated, for Barbara D. Wilkinson on a 136.339 acre tract generally located along the west side of FM 1378 across the street from the Newport Harbor development. The applicant is requesting annexation in order to enable development of the property utili7ng City of Wylie utilities and has indicated a contract to develop the property has been issued. Staff has held preliminary discussions with the applicant regarding the use and zoning of this property and anticipate a request for rezoning subsequent to Council approval of the annexation request. Should the City Council approve the annexation request,the property will be temporarily zoned as A(Agricultural)until permanent zoning is established by the City Council. The procedure for establishing permanent zoning on annexed territory shall conform to the procedures established by law for the adoption of zoning regulations. Before a municipality may institute annexation proceedings,the governing body of the municipality must conduct two (2)public hearings at which persons interested in the annexation are given the opportunity to be heard. In compliance with state law, staff has prepared the following public hearing and institution schedule. As your can see,the two(2)public hearings have been scheduled for the May 13, 1999, and May 25, 1999, City Council Meetings. The date for the institution of the annexation proceedings has been scheduled for June 22, 1999. Other Considerations Article 1, Section 3 of the Wylie City Charter authorizes the City Council to adjust boundaries. The City will also be required when the annexation is considered,under Section 43.056 of the Local Government Code, for provisions of Services to the annexed area and use it as directed in said statute(see attached service plan). DATE OF ANNEXATION ORDINANCE: June 2, 1999 ACREAGE ANNEXED: 136.339 ACRES SURVEY, ABSTRACT& COUNTY: William Patterson Survey _Abstract Number 716 Collin County, Texas Municipal Services to the acreage described above shall be furnished by or on behalf of the City of Wylie, Texas (the `;.City") at the following levels and in accordance with the following schedule: 4_ : A. POLICE SERVICE 1. Patrolling, responses to calls and other routine police services, within the limits of existing personnel and equipment and in a manner consistent with any of the methods of the City, extends police service to any other area of the municipality, will be provided within sixty(60) days of the effective date of the annexation ordinance. 2. As development and construction commence in this area, sufficient police personnel and equipment will be provided to furnish this area the maximum level of police services consistent with the characteristics of topography, land utilisation and population density within the area as determined by the City Council within four and one-half(4-1/2) years from the effective date of the annexation ordinance, or upon commencement of development within the area, whichever occurs later. 3. Upon ultimate development of the area, the same level of police services will be provided to this area as are furnished throughout the City. B. FIRE SERVICES 1. Fire protection equipment by the present personnel and the present equipment of the Fire Department,within the limitations of available water and distances from existing fire stations, and in a manner consistent with any of the methods of the City, extends fire service to any other area of the municipality, will be provided to this area within sixty(60) days of the effective date of the annexation ordinance. 1 "EXHIBIT B" 2. As development and construction commence in this area, sufficient fire and emergency ambulance equipment will be provided to furnish this area the maximum level of fire services consistent with the characteristics of topography, land utilization and population density within the area as determined by the City Council within four and one-half(4-1/2) years from the effective date of the annexation ordinance, or • upon commencement of development within the area, whichever occurs later. 3. Upon ultimate development of the area, the same level of fire and emergency ambulance services will be provided to this area as are furnished throughout the City. C. ENVIRONMENTAL HEALTH AND CODE ENFORCEMENT SERVICES 1. Enforcement of the City's environmental health ordinances and regulations, including but not limited to, weed and brush ordinances, junked and abandoned vehicle ordinances and animal control ordinances, shall be provided within this area sixty(60) days of the effective;date of the annexation ordinance. These ordinances and regulations wilt :enforced through the use of existing personnel. Complaints of ordinance or regulation violations within this area will be answered and investigated within sixty(60) days of the effective date of the annexation ordinance. 2. Inspection services including the review of building plans,the issuance of permits and the inspection of all buildings, plumbing, mechanical and electrical work to ensure compliance with the City codes and ordinances will be provided within sixty(60) days of the effective date of the annexation ordinance. Existing personnel will be used to provide these services. 3. The City's zoning, subdivision, sign and other ordinances shall be enforced in this area beginning within sixty(60) days of the effective date of the annexation ordinance. 4. All inspection services furnished by the City, but not mentioned above, will be provided to this area beginning within sixty (60) days of the effective date of the annexed ordinance. 5. As development and construction commence in this area, sufficient personnel will be provided to furnish this area the same level of Environmental Health and Code Enforcement Services as are furnished throughout the City. D. PLANNING AND ZONING SERVICES The planning and zoning jurisdiction of the City will extend to this area within sixty(60) days of the effective date of the annexation ordinance. City planning will thereafter encompass this property, and it shall be entitled to consideration for zoning in accordance with the City's Comprehensive Zoning Ordinance and Comprehensive Plan. 2 C:Annex.ltr • "EXHIBIT B" E. PARK AND RECREATION SERVICES 1. Residents of this property may utilize all existing park and recreational services, facilities and sites throughout the City, beginning within sixty (60) days of the • effective date of the annexation ordinance. 2. Additional facilities and sites to serve this property and its residents will be acquired, developed and maintained at locations and times provided by applicable plans for providing parks and recreation services to the City. • 3. Existing parks, playgrounds, swimming pools and other recreational facilities within this property shall,upon dedication to and acceptance by the City,be maintained and operated by the City, but not otherwise. F. SOLID WASTE COLLECTION 1. Solid waste collection shall be provided to the property in accordance with existing City policies,beginning within sixty(60) days of the effective date of the annexation ordinance. Residents of this property utilizing private collection services at the time of annexation shall continue to do so until it becomes feasible because of increased density of population to serve the property municipally. Commercial refuse collection services will be provided to any business located in the annexed area at the same price as presently provided for any business customer within the City, upon request. 2. As development and construction commence in this property and population density increases the property level, solid waste collection shall be provided to this property in accordance with the current policies of the City as to frequency, changes and so forth. 3. Solid waste collection shall begin within sixty (60) days of the effective date of the annexation ordinance. G. STREETS 1. The City's existing policies with regard to street maintenance, applicable throughout the entire City, shall apply to this property beginning within sixty (60) days of the effective date of the annexation ordinance. Unless a street within this property has been constructed or is improved to the City's standards and specifications, that street will not be maintained by the City. 2. As development, improvement or construction of streets to City standards commences within this property, the policies of the City with regard to participation in the costs thereof, acceptance upon completion and maintenance after completion, shall apply. 3 C:Annex.ltr "EXHIBIT B" 3. The same level of maintenance shall be provided to streets within this property which have been accepted by the City as is provided to City streets throughout the City. 4. Street lighting installed on streets improved to City standards shall be maintained in accordance with current City policies. • H. WATER SERVICES 1. Connection to existing City water mains for water service for domestic, commercial and industrial use within this property will be provided in accordance with existing City policies. Upon connection to existing mains, water will be provided at rates established by City ordinances for such service throughout the City. 2. As development and construction commence in this property, water mains of the City will be extended in accordance with provisions of the Subdivision Ordinance and other applicable ordinances and regulations. City participation in the costs of these extensions shall be nn accordance with the applicable City ordinances and regulations. Such extensions will ccommenced within two (2) years from the effective date of the annexation ordinance and substantially completed within four and one-half(4-1/2) years after that date. 3. Water mains installed or improved to City standards which are within the annexed area and are within approved dedicated easements shall be maintained by the City beginning within sixty(60) days of the effective date of the annexation ordinance. 4. Private water lines within this property shall be maintained by their owners in accordance with existing policies applicable throughout the City. SANITARY SEWER SERVICES 1. Connections to existing City sanitary sewer mains for sanitary sewage service in this area will be provided in accordance with existing City policies. Upon connection, sanitary sewage service will be provided at rates established by City ordinances for such service throughout the City. 2. Sanitary sewage mains and/or lift stations installed or improved to City standards, located in approved dedicated easements, and which are within the annexed area and are connected to City mains will be maintained by the City beginning within sixty(60) days of the effective date of the annexation ordinance. 3. As development and construction commence in this area, sanitary sewer mains of the City will be extended in accordance with provisions of the Subdivision Ordinance and other applicable City ordinance and regulations. Such extensions will be commenced within two (2) years from the effective date of the annexation ordinance and substantially completed within four and one-half(4-1/2) years after that date. 4 C:Annex.ltr "EXHIBIT B" J. MISCELLANEOUS 1. Any facility or building located within the annexed area and utilized by the City in providing services to the area will be maintained by the City commencing upon the date of use or within sixty(60)days of the effective date of the annexation ordinance, • whichever occurs later. 2. General municipal administration services of the City shall be available to the annexed area beginning within sixty(60)days of the effective date of the annexation ordinance. 3. [ADD IF VOLUNTARY ANNEXATION:The parties agree that because of the size or projected manner of development by the owner and/or developer, it is not reasonably expected and the parties do not require construction of capital improvements to be substantially completed within four and one-half(4-1/2)years. Notwithstanding anything-set forth above, this Service Plan does not require all municipal services fe;-'provided as set forth above if different characteristics of topography, land use and population density are considered a sufficient basis for providing different levels of service. 5. AN ORDINANCE ANNEXING A 136.339 ACRE TRACT OF LAND, MORE , OR LESS, SITUATED IN THE WILLIAM PATTERSON SURVEY, ' ABSTRACT NO. 716, BEING A PORTION OF A 157.53 ACRE TRACT OF LAND ACCORDING TO THE DEED RECORDED IN VOLUME 254, PAGE 563 OF THE DEED RECORDS OF COLLIN COUNTY, TEXAS (DRCCT); PROVIDING THAT THE OWNERS AND INHABITANTS OF THE ABOVE- DESCRIBED TRACT OF LAND SHALL BE ENTITLED TO THE RIGHTS AND PRIVILEGES OF OTHER.'CITIZENS OF WYLIE AND BE BOUND BY THE ACTS AND ORDINANCES NOW IN EFFECT AND HEREINAFTER ADOPTED; PROVIDING FOR A PENALTY FOR A VIOLATION OF THIS ORDINANCE AND COMPREHENSIVE ZONING ORDINANCE NO. 85-23A; PROVIDING FOR REPEALING, SAVINGS AND SEVERABILITY CLAUSES; PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE; AND PROVIDING FOR THE PUBLICATION OF THE CAPTION HEREOF WHEREAS, the City Council of the City of Wylie, Texas ("City Council") under the authority of Section 43.021, Local Government Code and City of Wylie, Texas' ("Wylie") Home Rule Charter, investigated and determined that it would be advantageous and beneficial to Wylie and its inhabitants to annex the below-described property(the "Property")to Wylie; and WHEREAS, prior to conducting the public hearings required under Section 43.052, Local Government Code, the City Council also investigated and determined that the Property is within the extraterritorial jurisdiction of Wylie and is adjacent and contiguous to the existing city limits of Wylie; and WHEREAS, before the publication of the notice of the first public hearing regarding the annexation of the Property, the City Council directed the appropriate persons to prepare a service plan that provides for the extension of full municipal services to the Property to be annexed; and WHEREAS, the City Council finds that the service plan has been prepared in full compliance with Section 43.056, Local Government Code, and has been made available for public inspection and was available for explanation to the inhabitants of the Property at the public hearings; and WHEREAS, the City Council finds that the field notes close the boundaries of the Property being annexed; and WHEREAS, the City Council has conducted at least two (2) public hearings at which persons interested in the annexation were given an opportunity to be heard regarding the proposed annexation and the proposed service plan; and WHEREAS, the City Council finds the public hearings were conducted on or after the fortieth (40th) day but before the twentieth (20th) day before the date of institution of the annexation proceedings; and WHEREAS, the City Council finds it has completed the annexation process within ninety (90) days after the City Council instituted annexation proceedings; and WHEREAS, the City Council-finds that all legal notices, hearings, procedures and publishing requirements for annexation have been performed and completed in the manner and form set forth by law. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1: The Property described in"Exhibit A" and all public streets, roadways and alleyways located within or contiguous to the same is hereby annexed to Wylie: SECTION 2: The Service Plan for the Property is attached hereto as Exhibit "B" and made a part hereof for all purposes. SECTION 3: That from and after the passage of this Ordinance, the Property shall be a part of Wylie, and the inhabitants thereof shall be entitled to all the rights and privileges of all of the citizens of Wylie and shall be bound by all of the ordinances and regulations enacted pursuant to and in conformity with the City Charter and the laws of the State of Texas. SECTION 4: That the official map and boundaries of Wylie are hereby amended to include the Property as part of the City of Wylie, Texas, and that a certified copy of this Ordinance shall be filed in the county clerk's office of Collin County, Texas. • • SECTION 5: It shall be unlawful for any person, firm or corporation to make use of the Property in some manner other than as authorized by this Ordinance and Comprehensive Zoning Ordinance No. 85-23A, and any amendments thereto; and it shall be unlawful for any person, firm or corporation to construct on the Property any building that is not in conformity with the permissible use under this Ordinance and Comprehensive Zoning Ordinance No. 85-23A, and any amendments thereto. SECTION 6: Any person, firm or corporation who violates any provision of this Ordinance and Comprehensive Zoning Ordinance No. 85-23A, and any amendments thereto, shall be deemed guilty of a misdemeanor and upon conviction shall be fined a sum not exceeding Two Thousand and 00/100 Dollars_($2000.00), and each and every day such violation continues shall be considered a separate offense;'pravided, however, such penal provision shall not preclude a suit to enjoin such violation. SECTION 7: Should any part or portion of this Ordinance, or the use created herein or under Comprehensive Zoning Ordinance No. 85-23A, and any amendments thereto, be declared unconstitutional or invalid by a court of competent jurisdiction, it is expressly provided that any and all remaining portions shall remain in full force and effect. Atterbury Survey,Abstract No. 22,City of Wylie, Collin County,Texas. Background The preliminary plat under consideration is Phase I of the Birmingham Farms Addition. The applicant is preliminary platting 56.42 acres of land in order to develop the property with 219 single family residential homes. The property is currently vacant, unplatted, and zoned for SF-3 (Single Family Residential)uses. Section 4.07 of the City of Wylie Subdivision Regulations states that an applicant may appeal the decision of the Commission with regard to a preliminary plat by filing a Notice of Appeal. Specifically,the Council shall consider the appeal at a public meeting and either affirm, modify or reverse the decision of the Commission and may,where appropriate, remand the plat to the Commission for further proceedings consistent with Council's decision. At the June 1, 1999, Planning and Zoning Commission meeting,the Commission voted by 5-1 to recommend denial of this case. Commissioner Hughes voted nay. Concerns identified by the Commission encompassed traffic congestion,points of ingress/egress, open drainage,park dedication, and thoroughfare screening. Section 212.005 of the Texas Local Government Code states that the municipal authority responsible for approving plats must approve a plat or replat that is required to be prepared and that satisfies all applicable regulations. Staff has reviewed the proposed plat and found it to be in compliance with all applicable subdivision regulations and other pertinent ordinance of the City of Wylie. As a result,this case must be approved as it complies with state statues and the City of Wylie Subdivision Regulations. Other Considerations Staff has reviewed the proposed preliminary plat and found it to be in compliance with the Subdivision Regulations and other pertinent ordinances of the City of Wylie. The Subdivision Regulations state that where subdivisions are platted so that the rear yards of residential lots are adjacent to a dedicated roadway, the owner shall provide screening at his or her sole expense. The applicant is proposing a 6' wood fence with brick columns in order to comply. Staff recommends that the applicant clarify the location of the proposed screening. Specifically,the applicant should revise the screening note to indicate all required screening will be located on private property and maintained by the either the Homeowners Association or individual property owner. The applicant is aware and has agreed. The applicant is dedicating approximately 7.06 acres of land for park improvements. The Parks Boards has reviewed the preliminary dedication plans and recommended approval of the dedication. Other Considerations continued The applicant is aware that all applicable issues and permits concerning development/access on the T.P. &L. right-of-way must be resolved prior to scheduling a final plat for hearing by the City Council. The applicant has proposed open drainage channels within the Texas Power and Light Easement and along the west side of Westgate Way. The City's Consulting Engineer has reviewed and approved said preliminary drainage plans subject to notification from the Corps of Engineers verifying their desire to have open drainage channels within their jurisdiction. The applicant is aware that final water and sewer connections, and drainage improvements must be approved by the City's Consulting Engineer. Background This item was first presented to Council for consideration at the Regular Meeting of June 8, 1999. Council tabled this item. Article 8, Section 1A of the City Charter authorizes the City Council to appoint members to serve on boards, commissions and committees to help carry out the functions and obligations of the City. The City Council has prescribed the purpose, composition, function, duties, accountability and the tenure of each board, commission and committee. City staff began an active campaign to solicit for Board and Commission applications by utilizing the Wylie News and special edition Bond Newsletter. This year staff held a Board and Commission Applicants Reception at the Municipal Complex. An invitation was extended to the community to attend and meet with city staff and council regarding the functions of city boards/commissions. Invitations were mailed to all current members encouraging them to bring prospective members. After the deadline for applications, a total of 27 new applications were received. For the third year, an interview panel consisting of three council members was formed and applicants were personally contacted to schedule an informal meeting with the Council Review Panel. Current members were also given an opportunity to visit with Council through the interview process. Staff followed up with a reminder mailed prior to the interview date. Council members Joel Scott, Reta Allen and Chris Trout again volunteered to serve on the interview panel and conducted approximately 40 interviews at the conclusion of the process. The Panel met with applicants on Monday, May 17, Thursday, May 20 and concluded the interviews on Monday, May 24, 1999. Applicants were asked a series of questions developed last year that helped them to understand the applicants philosophy about the Community as well as why they wished appointment to a City Board or Commission. June 22, 1999 Issue Consider award of bid for purchase and installation of a Direct Alarm Monitoring System. Background Current Alarm Monitoring System Currently in the City of Wylie,if a citizen or a business wants their alarm monitored they must contract with a private alarm company. The private alarm service charges a monthly fee to monitor the alarm and notify the City of Wylie Communications Center if the alarm goes off The City of Wylie communications personnel dispatch the appropriate Police and/or Fire units who respond to the alarm and take whatever action is needed. Better than 99%of alarm calls are false, 30 to 40%of all Police calls are alarms. While the private alarm companies do provide a service, the City of Wylie clearly provides the majority of the services needed to respond to alarms, and has almost all of the Capital investment and overhead costs associated with providing those services, However, the private alarm company collects all of the fees or revenue generated. This system adds an unnecessary link in the communications process that increases public safety response times. Proposed Direct Alarm Monitoring System An alternative for the City of Wylie is to invest in our own Direct Alarm Monitoring System and begin monitoring alarms for a monthly fee. Drawbacks: Initial startup cost of$70,913.00 - Covers cost of alarm monitoring equipment,radio system,and CAD Interface. - Increased liability risk - The City assumes liability if an alarm is missed just like we assume liability if a 911 call is missed. Advantages: Improved service delivery, direct alarm monitoring removes a link in the communication chain. Monitoring alarms directly allows our 911 Operators to know exactly what type of alarm it is;robbery, fire,medical assistance, etc. and dispatch the appropriate public safety units without delay. Private alarm monitoring services, often take 10 to 15 minutes to relay alarm information to Wylie's 911 Operators. By eliminating that communication link the City of Wylie can reduce response times 50 to 80%. Reduced public safety response times can lead to increased apprehension and clearance rates on crimes, reduced fire damage, and saved lives. A study conducted in Cedar Rapids Iowa showed an increase in burglary clearance rate from 17 to 32%in structures that were direct alarm monitored. The highland Park Police Department implemented direct alarm monitoring which resulted in significant reductions in response times and increases in rates at apprehension and conviction. Cost Recovery-Currently 30 to 40% of Police and Fire calls are false alarms. Answering these alarms is a tremendous cost to the City. Currently private alarm companies assume a very small percentage of the cost, provide a very small percentage of the service and receive all of the financial benefit. By implementing Direct Alarm Monitoring the City of Wylie can recover some of the costs of providing these services and use the additional revenue to improve public safety staffing and equipment. Financial Considerations Direct Alarm Monitoring project costs are as follows: DSS Direct Alarm Monitoring System Purchase and Installation =$64,913.00 ICS CAD/DSS Interface =$ 6,000.00 DSS Annual Maintenance Agreement(1s`year under warranty) =$ 6,500.00 The City of Wylie currently has over 800 alarm permits issued and are adding approximately 20 to 30 alarm permits per month. If we convert 25%of current alarms to Direct Alarm Monitoring in the next two years, and monitor 50%of new alarms installed in the next two years,we could be monitoring as many as 600 plus alarms in two years. If we charge $20.00 per month 600 alarms would generate $12,000.00 per month or$144,000.00 per year. The alarm system we are purchasing will monitor 4000 alarms and is expandable to 8000 alarms. Other Cities currently monitoring alarms have cautioned that it takes time to build your base of alarms monitored because many people have existing contracts,however, revenue should eventually far exceed costs. HB 3189, prohibits monitoring of fire alarms by a political subdivision unless the system is in place by September 1, 1999. Background As a result of the recent acquisition of the old Service Center property by Kansas City Southern Railway and their proposed new rail alignment, it is necessary to relocate two existing 15" sewer lines. The existing sewer lines will be relocated and combined into one larger sewer main from the north end of the old Service Center property, south across FM 544 to SH 78. Also, due to the relocation and reconstruction of a box culvert located in FM 544 just west of Cooper Drive, it is necessary to relocate an existing 15-inch sewer line from FM 544 to SH 78. Due to the age and condition of the existing sewer lines, the City must move quickly to relocate them so construction of the new KCS rail line can begin. The sewer lines also must be relocated before the construction of FM 544 begins in July. Competitive sealed bids have been solicited and received for the construction of approximately 630 feet of 30-inch sewer line. 825 feet of 24-inch sewer line, and 1,050 feet of 15-inch sewer line. Alternate bids were invited to relocate a section of 8-inch water line located along the north side of FM 544. A bid tabulation id provided as an attachment. The lowest responsive bidder is Mid-Continent Excavation Inc., with a base bid of$349,360.00 for the construction of the sewer line and an alternate bid of$12,490.00 for the construction of an 8-inch water line. Financial Considerations Through negotiations with KCS Railroad, the City has received participation from the KCS in the amount of$80,000. Due to TxDOT requirements, the installation of the sewer line across FM 544 was bid as a bore. However, the railroad will be constructing the box culverts and the rail crossing simultaneously with the sewer line installation, which will allow the City to install the sewer line crossing by an open cut method. The City has received authorization from TxDot to use the open cut method. The projected savings could range from $30,000 to $50,000 when the field change order is negotiated with the contractor. The City Council approved on April 27. 1999 as a part of the mid-year budget amendments, $350,000 for the above sewer and water line relocations. Other Considerations The solicitation of competitive sealed bids was conducted in accordance with Chapter 252.021 of the Texas Local Government Code.
