Hold a Public Hearing and consider, and act upon, a recommendation from the Planning and Zoning Commission regarding a Replat for Bozman Farm Estates Phase 2, Lot 28 and a part of Lot 29, Block C, and establishing 139 single family residential lots and eight open space lots on 50.392 acres to create Bozman Farms Phase 3, generally located east of Collins Boulevard near Saddle Ridge Drive. (R. 011ie, Planning Director) Executive Summary The purpose of the plat is to create 139 single-family residential and eight open space lots, and to reconfigure two lots to allow for a realignment of Wildflower Lane on 50.392 acres of property,zoned PD 2002-52. 2. Hold a Public Hearing and consider, and act upon amending the zoning from Agricultural (A/30) to Planned Development Single Family Detached District (PD-SF) to accommodate a proposed single family residential subdivision on an approximate 28 acre tract generally located on South Ballard approximately 1000' south of Alanis. ZC 2013-08. (R. 011ie, Planning Director) Executive Summary The applicant is requesting to establish permanent zoning on an approximate 28 acre tract generally located south of Alanis on South Ballard. The property is currently zoned A/30 and almost completely surrounded by property that lies outside city limits. 3. Consider, and act upon, Ordinance No. 2014-02, amending Section 22-446 (general sign regulations) of Article XX (sign regulations) of Chapter 22 (buildings and building regulations) and Article IX (prohibitions of illegal smoking material) of Chapter 74 (offenses and miscellaneous provisions) and adopting a new Article X (electioneering at polling locations) of Chapter 74 (offenses and miscellaneous provisions), all of Part II of the Wylie Code of Ordinances; providing for a penalty for the violation of this ordinance; providing for repealing, savings and severability clauses; providing for an effective date of this ordinance; and providing for the publication of the caption hereof. Ehrlich, City Secretary) Executive Summary New legislation passed in 2013 by House Bill 259 requires an entity that owns or controls a public building being used as a polling place to prohibit, at any time during the voting period, electioneering on the building's premises outside of the area described in Subsection (a) and being the 100 foot marker for electioneering. The bill does allow entities to place reasonable regulations concerning the time, place, and manner of electioneering which includes the posting, use or distribution of political signs or literature. Diaz stated that the award was given for outstanding communication in social media. Diaz explained the award is based on creativity, innovation and effectiveness of social media such as Facebook, Twitter and other social sites. The submission was for the "Get Mobbed" promotion staff di during the summer of 2013. It was designed to take participants to the Wylie parks during National Parks Month. Consider, and act upon, Ordinance No. 2013-47 amending Ordinance No. 2013-35 (2013-2014 Budget) for the purpose of distributing funds that were previously budgeted for salary changes to the proper departments and accounts; providing for repealing, savings and severability clauses; and providing for an effective date of this ordinance. Bantz, Finance Director) Executive Summary Finance Director Bantz addressed council stating that during a Work Session on November 21, 2013, the City Council heard a presentation from Waters Consulting regarding the compensation study they performed for the City. After discussion the Council directed staff to proceed with allocating funds that were previously set aside for employee salary adjustments in the 2013-2014 budget to consider the implementation of the recommendations made by the consultant to the fullest extent possible. This is now being brought back for Council consideration in the form of an ordinance amending the 2013-2014 Budget Ordinance as council requested. Council Action A motion was made by Councilman White, seconded by Councilwoman Culver to adopt Ordinance No. 2013-47 amending Ordinance No. 2013-35 (2013-2014 Budget) for the purpose of distributing funds that were previously budgeted for salary changes to the proper departments and accounts; providing for repealing, savings and severability clauses; and providing for an effective date of this ordinance. Minutes December 10, 2013 Wylie City Council Page 3 WORK SESSION • Discussion regarding funding for the Wylie Jubilee Bluegrass on Ballard scheduled for July 5,2014. (C. Kelly, Public Information Officer) Public Information Officer Craig Kelly, joined by Wylie Downtown Merchant Association President Dede Burke, Vice President Jeremy Meier, and Treasurer Bobby Heath, requested $10,000 funding for the 2014 Wylie Jubilee Bluegrass on Ballard schedule for July 5, 2014. Kelly provided a brief recap of the 2013 event and thanked Council for the $5,000 investment in the 2013 event that met the Council's goals of marketing the City of Wylie to the surrounding area and attracting first time visitors. Kelly reported that onsite survey's revealed that more than 50% of attendees visited the historic downtown area for the first time. The Best Western Wylie Inn sold 27 more rooms as compared to the same weekend last year; Ballard Street Café reported a record day; 96 West Winery experienced record sales; and Taste of Home along with many other merchants were experienced brisk sales. The car show had more than 100 entries and the more than 50 Arts and Crafts vendors generated $3,800 for the Art Fund. Kelly said that planning has already begun for the July 5, 2014, event and asked for direction from Council on continuing to build the event and requested $10,000 in funding. He reported that the hotel/motel fund balance currently stood at $109,000 and grows by approximately $5,000 a month. Kelly touted the solid partnership between the Downtown Merchants Association and the City of Wylie saying the events like this are a win for both parties. • Discussion regarding the possibility of implementing a Juvenile Case Manager position. (L. Bantz, Finance Director) Municipal Court Supervisor Lisa Davis addressed council stating that the current employee status of the Wylie Municipal Court is one full time Court Administrator/Supervisor, two full time clerks and one full time Bailiff/Warrant Officer. One part-time Prosecutor and two part-time judges are also on staff. The average number of cases filed per year is 2,500 adult and 200 juvenile cases; Sixty Six percent of the juvenile cases are for non-traffic violations. Justice of the Peace Terry Douglas is retiring as Collin County Precinct 2 Judge which creates a great possibility that current Failure to Attend School cases will now be filed with Wylie Municipal Court. This will add approximately 300 cases to the court docket annually. Davis recommended as a solution, to implement a Juvenile Case Manager position. Davis explained that this position would benefit and prevent children from becoming further involved in the justice system and curb juvenile crime. This is accomplished by acting as a liaison between juvenile defendants and their parents; to assist and monitor progress of juveniles moving through the programs; assure communication between juveniles, parents and the court; assist juveniles in completing state required alcohol and tobacco awareness classes, and serving as Teen Court Coordinator. Pursuant to Article 102.0174 Code of Criminal Procedure the court could add a $5.00 fee to all convictions for providing the Juvenile Case Manager. . Minutes December 10, 2013 Wylie City Council Page 4 Davis explained that total costs for this position would be $74,445.84 with additional revenues of $44,279.60; making the net cost approximately $30,166.24 annually. Davis noted that the estimates given were conservative. Judge Terry Douglas stated that he could not guarantee that the Wylie ISD would agree to utilize the Wylie Municipal Court for school truancies but had a meeting with ISD staff set for January 20, 2014 to discuss this recommendation. Direction from council was to move forward with an agenda item to implement the position for consideration by council at a future meeting. Discussion The City of Wylie Home Rule Charter in Article III, Section 9 states that the City Council shall hold at least one regular meeting each month and as many additional meetings as it deems necessary to transact the business of the City. The City Council shall fix, by ordinance, the date and time of the regular meetings. Special meetings of the City Council shall be held on the call of the mayor or a majority of the City Council members. By this Ordinance, the dates and times of all regular meetings in 2014 will be set. During the months of November and December one meeting per month has been scheduled due to the holidays. Upon request of the Council, special called meetings and work sessions can be scheduled at any times designated by the City Council and posted in accordance with the Texas Open Meetings Act. Discussion Owner: Bank Site Acquisition Corp Applicant: Oak National Holdings/Altura Homes The applicant is requesting to establish permanent zoning on an approximate 28 acre tract generally located south of Alanis on South Ballard. The property is currently zoned A/30 and almost completely surrounded by property that lies outside city limits. The applicant/owner is requesting a change in zoning to Planned Development Single Family Detached (PD- SF) to allow for a suburban single family residential neighborhood that is consistent with the City's Comprehensive Plan for that area. PD districts allow for development projects that may use some design elements not covered or allowed within the standard Zoning Ordinance, but may be compatible with the City's Comprehensive Plan. The applicant is proposing to provide a residential development on minimum 10,000 s.f. lots and adding architectural, landscaping, and site design elements to the development that offer a distinctive character to the community. The proposed development is designated as Sub-Urban Sector within the land use guidelines of the Comprehensive Plan. The Sub-Urban Sector primarily includes residential development of low to medium densities and shall also allow commercial development of very low intensity. Access to the community will be a featured entry from South Ballard Ave. There is a proposed access at the western boundary of the development that will be a future connection to Highland Oaks (Woodbridge Subdivision). Currently there are no immediately plans for this connection. In the interim, the developer is proposing to construct a Temporary Access Easement (T.A.E.) to serve as a secondary point of access to meet fire code regulations. Discussion New legislation passed in 2013 by House Bill 259 requires an entity that owns or controls a public building being used as a polling place to prohibit, at any time during the voting period, electioneering on the building's premises outside of the area described in Subsection (a) and being the 100 foot marker for electioneering. The bill does allow entities to place reasonable regulations concerning the time, place, and manner of electioneering which includes the posting,use or distribution of political signs or literature. In order to protect the public with regard to damage to property, traffic safety concerns and blight, Section 74- 173 of the proposed ordinance does not allow signs in driveways, parking areas, on medians within parking areas or driveways on the premises of a polling location. Signs may not be posted on polls, trees, buildings or other improvements on public property used as a polling location. The ordinance will allow for signs and electioneering within twenty-five feet of the public road way adjacent to the public property where a polling location resides. Signs violating this provision shall be considered illegal signs and may be removed and disposed of by the city in accordance with this article. SECTION 3: Amendment to Article IX (Prohibition of Illegal Smoking Material) of Chapter 74 (Offenses and Miscellaneous Provisions) of Part II of the Wylie Code of Ordinances. Article X (Electioneering at Polling Locations) of Chapter 74 (Offenses and Miscellaneous Provisions) is hereby adopted as follows: "ARTICLE X. ELECTIONEERING AT POLLING LOCATIONS Sec. 74-171. Purpose. The purpose of this article is to provide reasonable regulations for electioneering on city owned or controlled public property when such property is used as an election polling place. The regulations contained herein are to mitigate against any safety concerns, prevent damage to public property, and ensure that Ordinance No.2014-02 Political Signage and Electioneering Page 3 of 6 the property is sufficiently available for its patrons who use the facilities other than for election purposes. Sec. 74-172. Definitions. The following words and phrases as used in this Article shall have the meanings as set forth in this section: Electioneering shall mean the posting, use, or distribution of political. signs or literature, including the use of tents, chairs, booths, tables or other furniture or devises to post, use or distribute political signs or literature. Voting period shall mean the period each day beginning the hour the polls are open for voting and ending when the polls close or the last voter has voted, whichever is later on Election Day and early voting days. Sec. 74-173. Regulations and Exceptions. (a) The following regulations apply to electioneering on the premises of public property during the voting period. (1) It is an offense for any person to leave any electioneering sign or literature on public property that is used as a polling place other than during the voting period and for thirty (30) minutes before and after the voting period. (2) It is an offense for any person to engage in electioneering on driveways, parking areas, on medians within parking areas, or driveways on the premises of a polling location. This restriction shall not apply to electioneering signs that are attached to vehicles that are lawfully parked at the premises of a polling location. (3) It is an offense for any person to attach, place or otherwise affix any electioneering sign, literature or material to any building, tree, shrub, pole or other improvement on public property used as a polling location. (4) It is an offense for any person to place any electioneering sign or literature within twenty-five (25) feet of the public road way adjacent to the public property where a polling location is located. (6) In addition to imposing any criminal penalty, electioneering sign(s) located in violation of this section may be removed and disposed of by the entity in control of the public property. (7) The authority to conduct electioneering on public property under this Article X is limited to the property on the premises where the voting is conducted and only for the voting period. (b) The regulations set forth in (a) above shall not apply to any City of Wylie authorized signs, materials or other messages on its property." SECTION 5: Savings/Repealing Clause. All provisions of any ordinance in conflict with this Ordinance are hereby repealed, but such repeal shall not abate any pending prosecution for violation of the repealed ordinance, nor shall the repeal prevent a prosecution from being commenced for any violation if occurring prior to the repeal of the ordinance. Any remaining portions of said ordinance shall remain in full force and effect. SECTION 6: Severability. Should any section, subsection, sentence, clause or phrase of this Ordinance be declared unconstitutional or invalid by a court of competent jurisdiction, it is expressly provided that any and all remaining portions of this Ordinance shall remain in full force and effect. Wylie hereby declares that it would have passed this Ordinance, and each section, subsection, clause or phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional or invalid. SECTION 7: Penalty Provision. Any person, firm, corporation or entity violating this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined a sum not exceeding Five Hundred and 00/100 Dollars ($500.00). Each continuing day's violation under this Ordinance shall constitute a separate offense. The penal provisions imposed under this Ordinance shall not preclude Wylie from filing suit to enjoin the violation. Wylie retains all legal rights and remedies available to it pursuant to local, state and federal law. SECTION 8: Effective Date. This Ordinance shall become effective from and after its adoption and publication as required by the City Charter and by law. Recommendation N/A Discussion This item is being discussed at the request of Mayor Hogue and Councilwoman Culver. The existing ordinance is structured to enable the Council to consider providing funding to not-for-profit organizations as a part of the budget process each year, including a May 1 deadline for organizations to submit an application for budget consideration. On occasion, a request has been made to consider funding for not-for- profits at times other than the budget review and, as such, the procedure established in the ordinance has not been followed. The request to review the ordinance stems from the intent that all requests for funding for not-for-profit organizations be subject to the same review and criteria,regardless of the timing of the request. If the Council wishes to amend the ordinance there are options to consider. One, if we want to keep the process for funding during the budget cycle, we can keep the majority of the language currently in the Ordinance, but staff suggests changing the wording so that it does not imply that we will take applications every year. We can. then add language that states that the process and eligibility requirements apply regardless of when a request is received. A second option is to remove the language related to funding not-for-profits through the budget in order to keep the process generic and applicable to a wider variety of circumstances. The City of Wylie is committed to providing may, from time to time provide financial assistance to not-for-profit organizations that provide assistance to its citizens. In funding not-for-profit organizations, the City of Wylie will: (1) Encourage the not-for-profit organizations to provide services that meet specific needs of Wylie citizens. (2) Provide last resort capital or operating budget support to not-for-profit organizations. (3) Supplement (not supplant) funding from other sources available to not-for-profit organizations. (4) Provide limited funds to encourage the not-for-profit organizations to seek alternative resources of funds, donated materials and volunteer labor. (5) Relate specifically to measurable levels of service provided to city citizens. (6) Promote accountability through reporting of services provided. (Ord. No. 2005-52, § 1, 10-11-2005) Sec. 2-162. Procedures. The presentation and consideration of requests for expenditures of public funds by the city council in support of not-for-profit organizations will be evaluated based on the following guidelines and criteria: (1) Requests for the donation of public funds to not-for-profit organizations must be submitted to the Wylie City Manager's Office. on or before May 1 of each year for consideration in the operating budget process. {2) An emergency request may be submitted at any time provided: a. The request was not reasonably foreseeable on or before May 1 budget process deadline; or b. The essential function of the requesting not for profit organization would be irreparably harmed if delayed to the next budget process cycle. (3) Organizations requesting the donation of public funds from the City of Wylie are required to complete the city's request form (Section 2 166). [MM note: I recommend removing the form from the Code of Ordinances—we should not have administrative forms codified.] Page 3 of 6 (4) Each not-for-profit organization's application for funds will be screened by the city manager's office to ensure the guidelines and criteria are met. (5) Presentations of qualified applicant requests will be made at a city council meeting appropriate to the operating budget process, to include a public hearing. (6) Not-for-profit organizations whose requests do not meet the guidelines and criteria of this policy will be so notified and if appropriate, invited to resubmit the request. for the next budget cycle. (7) City council donations to not-for-profit organizations will be based on the benefit to the public and the priorities of community outcomes. (Ord. No. 2005-52, § 1, 10-11-2005) Sec. 2-163. Eligibility criteria. At a minimum, the not-for-profit organizations will meet the following qualifying criteria to receive public funds: (1) The organization will be a nonprofit, tax exempt 501(c)(3) corporation, in good standing with the State of Texas, and must have an active board of directors in compliance with IRS Section 501(c)(3). (2) The organization will have been operating successfully for at least two years prior to the application deadline. (3) The organization will have sufficient funding support to meet ongoing operating costs and obligations. (4) The organization is not currently receiving other funding from the City of Wylie. (5) If previously funded by the City of Wylie, the organization must have successfully fulfilled all prior contractual obligations, or explain reasons for noncompliance. (6) Services and programs are need-based, nondiscriminatory, and provided to the citizens of the City of Wylie. (7) Services and programs are provided through means that are more cost effective than the city government could provide. (8) Services and programs supplement or extend the services and programs by the city. (9) Services and programs are able to fill gaps that may exist between those of the city and the needs of the community. (10) The organizations are able to verify their not-for-profit status and submit detailed financial documents for review by city staff, including, but not limited to: a. Federal tax identification number; b. Copy of 501(c)(3) nonprofit status certification letter; and c. Certificate of liability insurance. The City of Wylie will not fund the following: (1) No more than 25 percent of the public funds request may be for salaries; however, under unusual circumstances, exceptions may be approved by the city council. (4) Underwriting, investments, stocks, bonds, or any financial obligation. (5) Interest and/or depreciation on loans, fines, penalties, or costs of litigation. (Ord.
