04-08-2014 (City Council) Minutes Wylie City Council CITY OF WYLIE Minutes Wylie City Council Meeting Tuesday, April 8, 2014-6:00 p.m. Wylie Municipal Complex-Council Chambers 300 Country Club Road, Bldg. 100 Wylie, TX 75098 CALL TO ORDER Announce the presence of a Quorum. Mayor Eric Hogue called the meeting to order at 6:00 p.m. City Secretary Carole Ehrlich took roll call with the following City Council members present: Mayor pro tern Rick White, Councilman Nathan Scott, Councilman Keith Stephens, and Councilman Todd Wintters. Councilwoman Diane Culver, Councilman Bennie Jones were absent. Staff present were: City Manager, Mindy Manson; Assistant City Manager, Jeff Butters; Police Chief, John Duscio; Planning Director, Renae 011ie; Library Director, Rachel Orozco; Finance Director, Linda Bantr; WEDC Executive Director, Sam Satterwhite; City Secretary, Carole Ehrlich; PIO, Craig Kelly, and various support staff. INVOCATION & PLEDGE OF ALLEGIANCE Councilman Todd Wintters gave the invocation and Corporal Ethan Maeder led the Pledge of Allegiance. Mayor Hogue addressed the audience introducing Ethan Maeder as a 2009 graduate of Wylie High School. He is currently serving in the United States Marines. Mayor Hogue noted Ethan's parents were also Wylie residents. Mayor Hogue thanked Ethan for his service to our country. PRESENTATIONS • Proclamation for National Library Week,April 12—19,2014(Orozco, Library Director) Mayor Hogue presented a proclamation proclaiming April 12 —April 19, 2014 as National Library Week. Members of the Library Board, Friends of the Library and staff were present to accept the proclamation. • Proclamation declaring April 13, 2014 through April 19,2014 as National Public Safety Telecommunications Week in the City of Wylie. Corbin, Fire Chief) Minutes April 8,2014 Wylie City Council Page 1 Mayor Hogue, presented Battalion Chief Robert Ballard and members of the Wylie Telecommunications staff a proclamation designating April 13, - April 19, 2014 as National Public Safety Telecommunications Week. CITIZENS COMMENTS ON NON-AGENDA ITEMS Residents may address Council regarding an item that is not listed on the Agenda. Residents must provide their name and address. Council requests that comments be limited to three (3) minutes. In addition, Council is not allowed to converse, deliberate or take action on any matter presented during citizen participation. Bobby Heath, representing the Wylie Downtown Merchants Association addressed council thanking the engineering staff and specifically City Engineer Chris Hoisted for his assistance in the Brown Street west thoroughfare improvements; most importantly the area near the Historic Downtown District. Dennis Keck residing at 1902 Clearwater, Wylie addressed council with concerns regarding the lack of a city ordinance restricting minors from purchasing or possessing e-cigarettes and vapor products. He also voiced Concern with voter tumotit in the City. CONSENT AGENDA All matters listed under the Consent Agenda are considered to be routine by the City Council and will be enacted by one motion. There will not be separate discussion of these items. If discussion is desired, that item will be removed from the Consent Agenda and will be considered separately. A. Consider, and act upon, approval of the Minutes of the March 25, 2014 Regular Meeting and March 29, 2014 Special Called Meeting of the Wylie City Council. (C. Ehrlich, City Secretary) B. Consider, and act upon, approval of a Site Plan for Woodbridge Centre, Phase 1, Block B, Lot 10 (Rock Wood Fired Kitchen) developing a 7,731 square foot two-story restaurant facility, generally located south of FM 544 and west of Woodbridge Parkway. Consider, and act upon, approval of a Final Plat for Covington Estates Phase I consisting of 14.308 acres for 44 single family residential lots, generally located on Ballard Avenue, and approximately 1000' south of Alanis Drive. (R. 011ie, Planning& Zoning Director) D. Consider, and act upon, the vendor request from Girl Scout Troop #3345 father/daughter fundraiser event at Olde City Park on June 7, 2014. (R. Diaz, Parks & Rec Superintendent) E. Consider, and place on file, the monthly Revenue and Expenditure Report for the Wylie Economic Development Corporation as of February 28, 2014. (S. Consider, and act upon, Resolution No. 2014-05(R) of the City Council of the City of Minutes April 8, 2014 Wylie City Council Page 2 Wylie, Collin, Dallas and Rockwall counties, Texas, amending Resolution No. 2014- 02(R) (Order of Election), Section 7, to amend the election judges; and providing for an effective date. Consider, and act upon, Resolution No. 2014-06(R) of the City Council of the City of Wylie, Texas, hereby authorizing the City Manager of the City of Wylie, Texas, to enter into an interlocal cooperative purchasing agreement between National Cooperative Purchasing Alliance (NCPA) and the City of Wylie for the use of the City of Grand Prairie's contracts. Consider and action upon, Resolution No. 2014-07(R) of the City of Wylie, Texas establishing a Travel Policy for City Council Members; and providing for an effective date. (M. Manson, City Manager) Council Action A motion was made by Mayor pro tern White, seconded by Councilman Scott to approve the consent agenda as presented. A vote was taken and the motion passed 5-0 with Councilwoman Culver and Councilman Jones absent. REGULAR AGENDA 1. Conduct the 2nd Public Hearing for the annexation of approximately 62 acres of land situated in the Francisco De La Pins Survey, Abstract No. A0688, Collin County, Texas, generally located west of E. Stone Road and approximately 1,600 feet south of Brown Street.2014-01A (R. 011ie, Planning&Zoning Director) Mayor pro tern White recused himself from discussion on this item and left the room due to a conflict of interest. The affidavit is filed with the City Secretary. Staff Comments Planning Director 011ie reported this annexation is at the request of property owners of three tracts of land. The subject tracts are contiguous to existing city limits on the western side, while properties to the north, south and east are within unincorporated Collin County. The applicant desires to bring the subject tracts into the city and eventually develop it as a combination of uses including, but not limited to assisted living, medical complexes, and single family dwellings. 011ie reported all notices and publications for this annexation had been completed to date. In compliance with state law, the following schedule has been adhered to: Notice published for Public Hearings March 12, 2014 and March 19, 2014 First Public Hearing March 25, 2014 Second Public Hearing April 8,2014 Adoption of Ordinance April 22,2014 Public Hearing Minutes April 8, 2014 Wylie City Council Page 3 Mayor Hogue opened the public hearing on Item #1 annexation at 6:27 p.m. asking anyone present wishing to address council to come forward. No one was present to address council during the public hear. Mayor Hogue closed the second of two public hearings on this annexation at 6:28 p.m. No action was required. 2. Conduct the 2nd Public Hearing for the annexation of approximately 6.210 acres of land situated in the Lewis M. Marshall Survey, Abstract No. 594 and the William Patterson Survey, Abstract No. 716, which is contiguous and adjacent to the City of Wylie, in Collin County, Texas, generally located south of Parker Road, east of the City of Parker boundary and west of Rita Smith Elementary School. 2014-02A (R. 011ie, Planning&Zoning Director) Staff Comments Planning Director 011ie reported this annexation is at the request of property owners of three tracts of land. The subject tracts are contiguous to existing city limits on the western side, while properties to the north, south and east are within unincorporated Collin County.
