CALL TO ORDER
Chairman Bryan Rogers called the meeting to order and a quorum was present. Board
members present with the Chairman were; Board Member Billy McClendon, Board
Member Zachary Herrera, Board Member SuniI Verma, Board Member Robert Heath,
Board Member Michael Grubbs and Board Member Sonny Lee Mosby.
Staff present was Code Enforcement Officer Pat Mitchell, Secretary Alicia Chavez, Chief
Building Inspector Todd White and Building Official Brian Killebrew.
CITIZENS COMMENTS
Chairman Rogers opened the Citizens Participation. With no one approaching the
Commissioners, Chairman Rogers closed the Citizens Participation.
CONSENT ITEMS
1. Consider and act upon approval of the Minutes from the August 29, 2013,
Regular Meeting.
Board Action
A motion was made by Board Member Verma and seconded by Board Member
Heath. Motion passed 7-0.
REGULAR AGENDA
Regular Hearing
1. Consider, and act upon, a variance to the City of Wylie Sign ordinance section 22-449
regarding the Taco Bell menu board. This property is located at 1601 FM 544,
Wylie, Texas 75098.
Staff Comments
Mr. White, stated the applicant is requesting a variance for menu sign board due to
the size requirements. Mr. Toby Gowin, Director of Construction, for Taco Bell, the
applicant for the request, stated that the purpose for the request is that Taco Bell is
revising the brand requirement for all Taco Bells. The size of the board will be 46'

feet wide and 7' 3" inches tall. The new menu board would not be facing FM 544 or
Westgate Way. A similar variance request was approved by one other city.
Otherwise, no other resistance or special variance was required.
Board Action
A motion was made by Board Member McClendon, and seconded by Board Member
Sunil, to approve the Sign variance as submitted with the stipulation that any other
extension(s) or wings would be reviewed by Building Inspections prior to
construction. Motion carried 7-0.
Public Hearing
1. Hold a public hearing, consider, and act upon providing evidence, seeking a
determination that a building(s) located at or near 705 Flagstgone Way, Westwind
Meadows #3, Block 3, Lot 18, Wylie, Collin County, Texas was in violation of
standards set out in Ordinance #2008-49 DANGEROUS BUILDINGS and or
PUBLIC NUISANCES Ordinance 92-14 of the City of Wylie, Texas; and seeking an
order of approval of the Emergency Secure conducted on September 19, 2013.
Staff Comments
Ms. Mitchell stated that the property located at 705 Flagstone Way, Wylie Police
Department had contacted her about the front door being wide open and it had a green
stagnant swimming pool in back yard. The yard was mowed and secured and
vandalism photos were taken. Liens were filed on this property and have not been
paid, although a title company is looking to pay off.
Board Action
A motion was made by Board Member McClendon, and seconded by Board Member
Sunil to approve the emergency secure of 705 Flagstone Way. Motion carried 7-0.

determination that a building(s) located at or near 2809 Lakefield Drive, Lakeside
Estates #2, Block I, Lot 9, Wylie, Collin County Texas was in violation of standards
set out in Ordinance #2008-49 DANGEROUS BUILDINGS and or PUBLIC
NUISANCES Ordinance 92-14 of the City of Wylie, Texas; and seeking an order of
approval of the Emergency Secure conducted on April 5, 2013.
Staff Comments
Ms. Mitchell stated that the property located at 2809 Lakefield Drive, Wylie Police
Department found the garage door unsecured. An emergency secure was performed to
board the garage door back up. Liens have been filed and have not been paid. This is a
vacant lot.

Board Action
A motion was made by Board Member Sunil, and seconded by Board Member Heath to
approve the emergency secure for 2809 Lakefield Drive. Motion carried 7-0.
3. Hold a public hearing, consider, and act upon providing evidence, seeking a
determination that a building(s) located at or near 704 Ashford Lane, Birmingham
Farms #14b, Block B, Lot 21, Wylie, Collin County Texas was in violation of
standards set out in Ordinance #2008-49 DANGEROUS BUILDINGS and or
PUBLIC NUISANCES Ordinance 92-14 of the City of Wylie, Texas; and seeking an
order of approval of the Emergency Secure conducted on June 24, 2013.
Staff Comments
Ms. Mitchell stated that the property located at 704 Ashford Lane, was contracted to be
mowed for high/grass and weeds. The Code Officer was notified about the back door
being open. The property was properly boarded up. Liens were filed and have not
been paid. Ms. Mitchell believes it is still a vacant lot but not sure.

A motion was made by Board Member Sunil, and seconded by Board Member
McClendon to approve the emergency secure for 704 Ashford Lane. Motion carried
7-0.
4. Hold a public hearing, consider, and act upon providing evidence, seeking a
determination that a building(s) located at or near 400 Carver Drive, Meadowview
Estates, Block 4, Lot 25, Wylie, Collin County Texas was in violation of standards set
out in Ordinance #2008-49 DANGEROUS BUILDINGS and or PUBLIC
NUISANCES Ordinance 92-14 of the City of Wylie. Texas; and seeking an order of
approval of the Emergency Secure conducted on May 31, 2013.
Staff Comments
Ms. Mitchell stated that the property located at 400 Carver Drive; was vacant and the
back door was open. There was a complaint of teenagers being inside the home. The
property was properly boarded up. Liens were filed and paid.

A motion was made by Board Member Sunil, and seconded by Board Member Mosby
to approve the emergency secure for 400 Carver Drive. Motion carried 7-0.
5. Hold a public hearing, consider. and act upon providing evidence, seeking a
determination that a building(s) located at or near 101 S Jackson Avenue, Kellers #1.
Block 4, Lot 12, Wylie, Collin County Texas was in violation of standards set out in
Ordinance #2008-49 DANGEROUS BUILDINGS and or PUBLIC NUISANCES

Emergency Secure conducted on April 19, 2011
Staff Comments
Ms. Mitchell stated that the property located at 101 S Jackson Avenue, was vacant
and in a very bad condition. The property was secured. Liens were filed and paid in
full.
Board Action
Board Member Heath withdrew from voting, due to possible Conflict of Interest. A
motion was made by Board Member McClendon, and seconded by Board Member
Sunil to approve the emergency secure for 101 S Jackson Ave, Motion carried 6-0.
ADJOURNMENT
A motion was made by Board Member Heath, and seconded by Board Member Sunil to
adjourn the meeting. Motion carried 7-0..
