ZC 2015-06 (R. 011ie, Development Services Director) Executive Summary The subject tract was part of a Planned Development adopted July 26, 2005 in order to develop a master planned residential community. The Final Plat for Phase IV was approved in 2013 and created 77 single-family residential lots. 2. Hold a Public Hearing and consider, and act upon a change in zoning from Single Family Residential (SF 10/24) District to Neighborhood Service (NS), to allow an engineering firm. Property generally located at 634 North Ballard. ZC 2015-05 (R. 011ie, Development Services Director) Executive Summary The applicant and owner are requesting to rezone the property to allow for an Engineering firm to occupy a residential structure currently zoned for single family uses. The Mayor presented a Blue Star flag to David and Jennifer Brokaw in honor of their son, Joshua Brokaw, and his current service in the U.S. Army stationed in South Korea. • American Legion Hale-Combest Post 315 would like to recognize the following individuals: o EMT/Paramedic of the Year-Michael Towne o Firefighter of the Year-John Hunt o Law Enforcement Officer of the Year-Angela M.McIntosh Mary Lang, representing American Legion Hale-Combest Post 315, presented certificates to EMT/Paramedic of the Year, Michael Towne, and Law Enforcement Officer of the Year, Angela M. Consider, and act upon, the appointment of a City Council member to replace Bennie Jones on the Parks and Recreation Facilities Development Corporation, 4B Board to fill the term Minutes July 14, 2015 Wylie City Council Page 2 of July 1,2015 to June 30,2016. Mayor Hogue addressed Council stating that a member of the seated Council would need to be appointed to take the position of Bennie Jones for the unexpired term of one year. Mayor Hogue asked Council if anyone was wishing to volunteer. Councilman Dahl stated that he would serve on the Parks and Recreation Facilities Development Corporation 4B Board if appointed. Council Action A motion was made by Councilman Wintters, seconded by Mayor pro tem Stephens to appoint Councilman Dahl to replace Bennie Jones on the Parks and Recreation Facilities Development Corporation, 4B Board for the unexpired term of July 1, 2015 to June 30, 2016. Consider, and act upon, Ordinance No. 2015-24 authorizing the City Manager to amend Chapter 46 (Fire Prevention and Protection) of the Code of Ordinances, Ordinance No. 2005-07, to add Article V (Public Safety and Fire Emergency Response Cost Recovery), authorizing the imposition of fees to recover costs actually incurred in responding to certain public safety and fire emergency incidents; describing cost recovery procedures; providing for civil and criminal remedies and a right to appeal; providing a penalty clause, savings/repealing clause, severability clause and an effective date; and providing for the publication of the caption hereof. (B. Parker, Fire Chief) Executive Summary Fire Chief Parker addressed Council stating that recently the fire department discovered the Resolution for emergency services billing passed on July 11, 2000 does not legally allow the City to bill for services. Amending Ordinance No. 2005-07 will ensure legal integrity. First responder fee collections include items such as: vehicle extrications, rescue operations, hazardous materials incidents, structure fires outside the City limits, and false alarms. Wylie Fire Rescue will also add billing for boat towing and lake rescue operations. The billing company does not bill individuals, with the exception of boat tows, but does bill the appropriate insurance company. Chief Parker reported an enterprise fund was established specifically for this program which helps support Wylie Fire Rescue training opportunities and the regional fire training facility behind Station Two. Mayor Hogue convened into Work Session at 6:30 p.m. WORK SESSION • Discussion regarding the North Texas Municipal Water District board governance and the current Water Supply Contract. (Torn Kula, Executive Director, North Texas Municipal Water District) Executive Director Tom Kula addressed Council explaining the history of the North Texas Municipal Water District and its Member Cities. Kula reported at the time of the establishment of the North Texas Municipal Water District, the member cities decided they were all in this together for the greater good of the region; they could not do it separately. Kula explained NTMWD staff is developing the protocol for meetings to include all Member Cities. Once protocol is set, NTMWD will invite all Member Cities to meet together to determine their willingness to discuss two immediate matters: 1. Should Member Cities have the authority to remove a Director, and if so, have the authority to remove under what circumstances? 2. Are there amendments to the existing Water Supply contract that would provide a better solution for all, and if so, what are the proposed changes? Kula updated Council on projects under construction, completed, and in the permitting stages. In closing Kula stated "Unity" is our strength since 1951; the vision and foundation for NTMWD Member Cities and regional development has been "All-in-Together." Discussion Competitive sealed bids were solicited for the purchase, installation and continued maintenance of a Cummins brand DSGAA 100 kW diesel standby generator set (or equivalent) and transfer switch, NFPA 110 Acceptance Testing of the unit, and an extended warranty. The City received three (3) bids, and the bids were evaluated in accordance with the weighted "best value" criteria as set forth in the bid specification. This generator will supply back up power to the City's lift station's 40 HP pumps and control panels. This generator set will be a dedicated unit to increase the reliability of the Redwood Lift Station, a site that is subject to Inflow and Infiltration loadings and power failures during heavy storms. Award of this item does not affect the Wastewater Division's request for a portable standby generator set in the FY15-16 budget. That item is intended to be used as a power source to any of two remaining lift stations or three water pump stations. All 3 bids were reviewed and scored and the totals were weighted. PLANNING& ZONING COMMISSION DISCUSSION: The Commissioners heard from several residents within the surrounding area expressing their concerns regarding drainage and drainage issues, long term uses, increased traffic, and type of uses allowed under the NS base zoning. The primary concern was regarding other uses that would be allowed should the Engineering firm go out of business or decide to relocate. Staff discussed the typical uses allowed under NS zoning by current ordinance which include convenience stores, pharmacies, and general office uses. Uses that are allowed only by SUP include but are not limited to Motor Fueling Station,Vehicle Sales &Display. BALLARD AVE.FROM SINGLE FAMILY TO NEIGHBORHOOD SERVICES Planning&Zoning Gloria Ray Jordan Property ID 2103929 Harvest Bend#1(CWY).Bik B.Lot 6.60'x 120' Concerning the elevation of the land of the proposed change of zoning and the land adjoining—some is on high ground and some on low ground. 634 N. Ballard land is on high ground. The land west of that address is in the Harvest Bend Subdivision#1. The Harvest Bend Subdivision is all residential and is in the low ground area. The lot my house is on In Harvest Bend#1 is exactly behind 634 N. Ballard. When we have a big rain or a prolonged period of rain,water which cannot be absorbed by the high ground runs down to my property. it runs like a river between my house and the house on my south'side (Judy&Gilbert Watt's property). The rainwater stands along the backside of my house. Water stands against the back slab and out into the yard when the ground is saturated and can't absorb any more water. I worry the whole time that the water will reach the top of the slab and enter the house. If the property on the high ground becomes zoned as"Neighborhood Services,"more of that uphill land will probably be concreted or cemented. That means less rain water can be absorbed by that uphill land;and that water will come pouring downhill to the residents'property on Grassy Glen Dr., endangering the flooding of their houses. This may also be true for the residential property on the other side of Ballard Ave. because I think that land also runs downhill from Ballard Ave. RAILROAD: There is a railroad track to cross if one is traveling from downtown Wylie or going to downtown Wylie. Crossing trains stall traffic both ways. One incident I experienced a week or so ago: I drove out of Harvest Bend and turned right onto Ballard to drive into Wylie to meet a church group supposed to leave at a certain time. As I turned onto Ballard, I found that a train had completely stopped across Ballard. As I stayed In my place for a while,drivers closer to the RR tracks began to find a little room to back out of line and turn to head in the opposite direction up Ballard. After waiting longer,and with no train movement,I decided to back out,turn, and go In the opposite direction also. To get to downtown Wylie,I had to drive to Park Blvd,then to Country Club Rd.,then to Hwy.544,then to Hwy.78 to get to my destination. The traffic is already bad enough. Many times when I want to go to Country Club Rd,l go from Harvest Bend#1 to Harvest Bend#2 to get onto Ballard. As I wait to get onto Ballard,to the left and to the right Ballard is curved. So much of the time when I'm waiting to get onto Ballard,there is traffic coming around Both of those curves or from one curve,making it quite a wait to get onto Ballard. if the proposed zoning is approved, it will definitely mean more traffic on Ballard from both directions. Any train running or stalling will cause a long traffic jam on both sides of the track and drivers will be trying to turn and go In the opposite direction.
