PUBLIC HEARINGS
1. Continue a Public Hearing from April 26, 2005 to receive citizen comments on recommendations of
the Planning and Zoning Commission concerning certain proposed revisions to the Comprehensive
Plan. (C. Thompson,Planning and Zoning Director)
Executive Summary
The public hearing was convened, as published, on April 26, 2005 but Council tabled discussion until the May 10, 2005
meeting so that additional research and recommendation could be provided concerning the sufficiency of retail and
commercial uses and the proportion of residential densities (lot sizes). The Planning and Zoning Commission held an
additional work session on May 3 to consider these issues and staff has conducted additional research,and new information
will be provided at the Council meeting.
The Council has tabled any decision on the proposed revisions until the May 24, 2005 Council meeting.
Planning and Zoning Commission recommends approval.

2. Consider and act upon a change in zoning from Agriculture (A)to Planned Development (PD) District

Executive Summary
The public hearing was convened as published on April 26, 2005,but Council tabled discussion and decision on the request
until the May 10 meeting in order to allow time for an expanded traffic study to be completed.
The PD proposes to extend Mainstream Drive to link with Riverway Lane for additional traffic access/egress. Consultants
have performed an expanded traffic analysis, which is attached. This study concludes that the proposed connection is
justified and will reduce traffic on Claybrook to levels below those currently existing regardless of the number of lots
(proposed 8,500 sq. ft. or 10,000 sq. ft.)allowed in Phase 9. The closure of Claybrook to the east, disconnecting it directly
from Phase 9,would not reduce the traffic volumes.
The currently-adopted Comprehensive Plan recommends lots of 1 acre or larger, and revisions to the Comp Plan currently
being considered recommend medium-density residential (10,000 to 20,000 square feet lots). The requested smaller lot
size of the PD(8,400 sq.ft.)does not conform to either of these recommendations.
Planning and Zoning Commission recommends approval.
3. Consider and act upon a request from D. R. Horton Homes to install a kiosk sign for off premise
advertisement located at the corner of Highway 78 & Kreymer. (J. Bray, Building Department
Director)
Executive Summary
D. R. Horton Homes has requested the City Council's approval of an off premise temporary directional kiosk sign for the
purpose of advertising the Avalon subdivision. Section 11.A of the adopted sign ordinance requires the sign design and
location to be approved by the City Council. All other requirements have been met.
4. Consider and act upon approval of a Police Recruit Employment Agreement.. (J. Butters, Police
Chief)
Executive Summary
The proposed agreement would be entered into between the City and new Police employees who are not Certified Peace
Officers. Uncertified individuals hired for the position of Police Officer must be sent to a sixteen-week Police Academy.
The proposed agreement requires the employee to reimburse the City of Wylie for the cost of his/her training if the
employee separates from the City of Wylie prior to their two-year anniversary. This agreement is designed to protect the
City from being used as a training ground for Officers who desire to work in a larger City,but need some experience to do
so.

Mayor John Mondy called the meeting to order at 6:00 p.m. Council Members present were: Mayor Pro
Tern Eric Hogue, Councilman Chris Trout, Councilman Earl Newsom, Councilman Merrill Young, and
Councilman J. C. Worley. Councilwoman Reta Allen was absent.

PUBLIC HEARINGS
1. Hold a Public Hearing and consider acting upon an Ordinance approving certain revisions to
the Comprehensive Plan for the City of Wylie. (C. Thompson,Planning and Zoning Director)
Public Hearing
Mayor Mondy opened the public hearing at 6:22 p.m.
James Griffin residing at 301 W. Kirby Street#222, Wylie, Texas addressed Council stating that he was in favor
of the proposed amendments to the Planning and Zoning Comprehensive Plan. He stated that the increased
commercial corridor and light industrial zoning would boost the tax base.
With no one else present to address Council, Mayor Mondy closed the public hearing at 6:23 p.m.
Staff Comments
Planning and Zoning Director Thompson addressed Council stating that in February, the Planning and Zoning
Commission recommended certain revisions to the Comprehensive Plan, and on February 22, the City Council
endorsed the proposed revisions and directed the Commission to continue with the approval process as required by
State Law. These revisions were also considered at a Joint Commission/Council Work Session on February 8,2005.
Once the revised Comprehensive Plan is adopted,the Zoning Ordinance and Subdivision Regulations will be revised
accordingly. Some lands are already zoned and/or platted for uses other than those recommended by the current
Comprehensive Plan as well as these revisions. If platted,these have a legal right to develop to the code which was
in effect at the time of platting and may be developed as previously anticipated regardless of the recommendations
of the Plan. However, lands which are not yet platted have no vested rights and must be developed in full
compliance with these revisions and the development requirements of the current Zoning Ordinance.
Council Discussion
Mayor Mondy asked Mr. Thompson how many public hearings had been conducted on this item. Mr. Thompson
replied that the Planning & Zoning Commission had held three hearings on this plan and one joint work session
between the City Council and Planning and Zoning Commission. Mayor Mondy then asked Mr. Thompson,based
on the retail areas being pushed to S.H. 78 and S.H. 544, has the Planning and Zoning Commission taken into
consideration the increased development in the areas and roads going to the retail areas. Mr. Thompson stated that
they did. Mayor Mondy questioned certain areas where light commercial had been taken out and asked if it was
feasible for residents to travel so far for necessities. Mr. Thompson stated that an earlier plan, with the Village

Concept had addressed these problems and that Council's direction was to go more vehicular in nature.
Councilman Worley asked Mr. Thompson if those zoning cases filed and pending would follow the revised
comprehensive plan, if approved, or the Comprehensive Plan currently in place. Mr. Thompson replied that the
cases filed and pending, by vested right, would follow the Comprehensive Plan that was in place when they
submitted their plan. Councilman Newsom asked what percentage in the new plan was not residential. Mr.
Thompson stated those figures were not available yet but his best estimate was 25% was non-residential.
Councilman Worley stated that he would like to see the public hearing continued at the May 10, 2005 Council
meeting and the item tabled to the May 24,2005 Council meeting.
Council Action
A motion was made by Councilman Worley, seconded by Councilman Young to Table Item #1
(Ordinance #2005-19) until the May 24, 2005 Council Meeting in order to conduct further research. A
vote was taken and passed 6-0 with Councilwoman Allen absent.
2. Hold a Public Hearing and act upon an Ordinance approving a change of zoning from
Agriculture (A) to Planned Development District for Mixed Uses. (Zoning Case#2005-01-Jones
Tract). (C. Thompson,Planning and Zoning Director)
Staff Discussion
Planning and Zoning Director Thompson addressed council stating that the applicant had contacted his office and
submitted a formal letter of withdrawal of this zoning case. The property totals 186.56 acres, south of FM 544 and
west of Regency Business Park Addition. The property is traversed by the undevelopable 150 feet wide right-of-
way of a major electric power transmission line (approximately 9 acres),which legally describes the property as the
northern Tract One of 130.7 acres and the southern Tract Two of 55.8 acres. The Development Plan also suggests a
construction phasing pattern. The current request proposes to divide the property into two major uses. The northern
60 acres along FM 544, for a depth of 1,000 feet, is designated for Corridor Commercial uses. The remaining
southern 127 acres is designated for 345 single-family residential lots of 10,000 square feet each, for a density not
exceed 2.76 lots per acre.
Because the Planning and Zoning Commission has recommended denial of this request, the affirmative vote of
seventy-five percent (75%) of the entire City Council will be required to approve the requested rezoning. However
since the applicant has formally withdrawn the zoning case, Council may move to accept the withdrawal by the
applicant.

A motion was made by Councilman Trout, seconded by Councilman Young to accept the applicant's
withdrawal of Zoning Case #2005-01. A vote was taken and passed 6-0 with Councilwoman Allen

3. Hold a Public Hearing and act upon an Ordinance approving a change of zoning from
Agriculture (A) to Planned Development (PD) for Single Family Residential (SF). (Zoning
Case No. 2005-03-Housewright Tract/Sage Creek). (C. Thompson, Planning and Zoning

Staff Comments
Planning and Zoning Director Thompson addressed Council stating that the property totals 59.24 acres,west of Sage
Creek Phase 4 and 7 Additions and north of Wooded Creek Estates, effectively land-locked between existing
development and the Muddy Creek floodplain. The request is to expand the existing Sage Creek Planned
Development District(PD 99-9)for single-family residential uses. The floodplain occupies the eastern two-thirds of
the tract. The currently-adopted Comprehensive Plan recommends lots of 1 acre or larger, and revisions to the Comp
Plan currently being considered recommend medium-density residential (10,000 to 20,000 square feet lots). The
requested smaller lot size of the PD (8,400 sq. ft.) does not conform to either of these recommendations. Not less
than 60%of the two story homes would be built on the ground floor. 50%of all homes in the development would be
2,400 sq. ft. or larger with the remainder being a minimum of 2,000 sq. ft. Mr. Thompson stated that the applicant
did not agree with the stipulation that the 60%floor area be on the first floor. Mr. Thompson stated the applicant
was present to address that issue as well as others.
Public Hearing
Mayor Mondy opened the public hearing at 6:26p.m.
Jim Byrne residing at 3104 Bryce Dr., Wylie Texas addressed Council stating that he was in favor of the planned
development. Mr. Byrne stated that he felt the new bridge the developer was proposing would eliminate traffic
problems.
Katheryn Hawkins residing at 3014 Claybrook, Wylie Texas addressed Council stating that she was one of the
residents that was opposed to the planned development. She stated that she had experienced yard damage due to
the construction of Phase 8 and felt that Phase 9 would only make damage to her property by construction crews
even worse. Traffic issues were another concern to Ms.Hawkins.
Jessica Kattenbach residing at 3004 Claybrook Dr., Wylie Texas addressed Council stating that she was opposed
to the planned development and she felt that Claybrook would become a thoroughfare due to the additional homes
and lack of access out of the development. She also stated that she was in favor of 10,000 sq.ft lot minimums.
Bruce Miller residing at 1100 Midstream, Wylie, Texas (30 feet from the proposed bridge) addressed Council
stating that he was opposed to the development citing that he was the resident at the corner where the new
proposed bridge would be constructed. He stated that when he purchased the property he had no information that
a bridge would be constructed so close to his residence. He stated that he had fully researched the development
and was not told there would ever be anything but creek.He stated he was very much against the bridge.
Debbie Pyle residing at 3001 Claybrook Drive addressed Council stating that she was opposed to the development
and citing that child safety was of the utmost concern and she felt with the new development and increased traffic,
it would not be a safe place for children to play.
Scott McMurdie residing at 1012 Meandering Dr, Wylie, Texas,addressed Council stating that he was in favor of
the planned development, citing that the Sage Creek Development was being built by excellent builders (Ashton
Homes) and he felt his property value would only increase with the additional quality homes. Mr. McMurdie also
commented that he felt since this was an extension of a land locked area; the 8.400 minimum lots would work in
this area. He also stated that by putting a bridge in the development,it would eliminate all traffic problems.
Red Byboth representing the Planning&Zoning Commission addressed Council stating that many of the citizens
speaking at the P & Z Public Hearings were in favor of this development. He stated that he was pleased that
Ashton Woods decided to build the bridge to eliminate the traffic concern and that Ashton Woods has increased
the amenity center and has made every effort to accommodate the residents and the city. He encouraged the
consideration of the closure of Claybrook and diverting the traffic north and south, and proceeding with the
development by approving this zoning case. Mayor Mondy asked Mr. Byboth how P&Z Commission had voted
on this zoning case. Mr. Byboth replied that they voted in favor of the zoning case to recommend to Council. Mr.
Byboth stated that he remembered that the conversation during the Planning and Zoning Commission meeting was
to recommend the closure of Claybrook.

Neil Hecker(applicant)residing at 13800 Montfort,Dallas,Texas addressed Council stating that the traffic was a
key issue. He stated that he had discussed stepping back and looking at the possibility of closing Claybrook. He
stated that since that time, a traffic review has been completed regarding the closure and in Mr. Hecker's opinion,
the bridge and the commitment made by Ashton Woods to construct that bridge is sufficient to solve the traffic
issue. He saw no need to close Claybrook He explained that having three exits from Sage Creek 9 was ample
access for traffic. Sage Creek 4 and 8 only have one exit at this time and building the bridge will make the problem
better. He explained that the Parks board desired additional trails which Aston Woods committed to as well as
building a 2,000 sq. ft. club house, raising the commitments on homes from 2,000 sq.ft. minimum to 2,400 sq. ft.
(for 50%of the homes)and dedicate the park land and build the bridge needed for traffic. He explained that Aston
Woods would only receive 45%of the use of the land with the improvements that have been submitted.
With no one else present to address Council Mayor Mondy closed the public hearing at 6:57 p.m.
Council/Staff Discussion
Mayor Mondy asked City Engineer Holsted how the City could put the cul-de- sac in, do a traffic study and then
make a determination whether or not traffic is impacted. City Engineer Holsted stated that his recommendation to
Council would be to leave Claybrook as a dead end street and not install a cul-de-sac. Mr. Hoisted also stated that
there was no decrease in level of service on Claybrook from an engineering standard. City Manager Roath asked
Mr. Hecker about the assumption he made regarding the bridge and no extra strain on Claybrook. At some point,
if the traffic increases significantly, would Aston Woods be willing to conduct a survey at that time and close
Claybrook if deemed necessary. (12— 18 mos. out)Mr. John Bull(engineer for Ashton Woods) replied that if the
bridge was constructed now, there would be no impact to Claybrook. Mr. Roath asked again if Ashton Woods
would be willing to fund that study in the future. Mr. Hecker stated that if a traffic study was done now and
another at build-out, if the traffic study shows increased traffic, he was not sure if he could commit to closing
Claybrook. Mayor Pro Tem Hogue and Councilman Trout commented that they would like to see minimum lot
sizes of 10,000 sq.ft. in this development.
A motion was made by Councilman Worley, seconded by Mayor Pro Tern Hogue to deny Zoning Case
#2005-03. After some discussion Councilman Worley withdrew his motion.
Council Action
A motion was made by Councilman Worley, seconded by Mayor Pro Tem Hogue to table Item #3
(Zoning Case#2005-03, Ordinance#2005-21) to the May 10, 2005 Council Meeting to allow time for a
traffic study to be completed and information regarding the bridge, and it's location by the developer
and the City Engineer. A vote was taken and passed 6-0 with Councilwoman Allen absent.
4. Hold a Public Hearing and act upon an Ordinance approving a change of zoning from
Agriculture (A) to Planned Development (PD) District for single family residential uses.
(Zoning Case No. 2005-09-Collins Tract) (C. Thompson,Planning and Zoning Director)
Staff Comments
Planning and Zoning Director Thompson addressed Council stating that the Comprehensive Plan recommends
Country Residential (1 acre lots). This request does not comply with Comp Plan. Planned Development zoning is
intended to establish a minimum house size of 3,000 square feet as stipulated by the Planning & Zoning
Commission, compared to the 2,100 sq. ft. allowed by straight zoning. PD is justified to accomplish this request.
The subject tract is effectively land-locked, being long and narrow with developed properties on three sides,
allowing access only from the narrow frontage of FM 544. Development of this configuration as one-acre lots as
recommended by the Comp Plan will likely require undesirable single point of entry, double-sided lots, over-length
streets and/or dead-end utilities.

Mayor Mondy opened the public hearing at 7:02 p.m.
Ms. Jamie VanEaton residing at 1001 Oakbrook Drive, Wylie, Texas addressed Council stating that after much
discussion with the developer and the agreed upon buffer along the TXU easement, she was in favor of this zoning
case.
Mike Foster (Applicant)addressed Council stating that he was willing to include a 15 foot buffer along the TXU
easement and once completed dedicate it to the City of Wylie. This will eliminate any liability to the developer at a
later date.
With no one else present to address Council Mayor Mondy closed the public hearing at 7:08 p.m.
Council Discussion
Councilman Newsom asked if iron fences were required in the development as part of the P.D. Mr. Thompson
replied that yes it was.
Council Action
A motion was made by Councilman Worley, seconded by Councilman Trout to approve Zoning Case
#2005-09 (Collins Tract, Ordnance #2005-22), with the stipulation that a 15 foot buffer zone be added
to the TXU easement on the northern side of the tract and dedicate the buffer zone to the City of Wylie.
A vote was taken and passed 6-0 with Councilwoman Allen absent.
5. Consider and act upon acceptance of the Comprehensive Annual Financial Report after
presentation by the audit firm of Rutledge Crain & Co., PC. (R. Hutchison, Interim Finance
Director and Lewis Crain,Rutledge Crain & Co.,PC)
Staff Comments
Interim Finance Director Hutchison addressed Council stating that the City Charter in Article VII, Municipal
Finance, Section 13: Independent Audit, requires that at the end of the fiscal year an independent audit be made of
all accounts of the City by a certified public accountant. In compliance with the City Charter, our outside auditor
Rutledge Crain&Company,PC,has performed an audit as of September 30,2004.
Auditor Comments
Mr. Lewis Crain representing Rutledge Crain& Company, PC addressed Council stating that overall it was a good
year for the City of Wylie and fund balances are in excellent condition.He complemented Mr.Hutchison on his hard
work.
Council Action
A motion was made by Mayor Pro Tern Hogue, seconded by Councilman Young to accept and place on
file the Comprehensive Annual Financial Report for FY 2003-2004. A vote was taken and passed 6-0
with Councilwoman Allen absent.

6. Consider and act upon appointment of a board member to the North Texas Municipal Water
District Board. (C. Ehrlich, City Secretary)
Staff Comments
City Secretary Carole Ehrlich addressed Council stating that the NTMWD's existing Board (18 member cities) is
comprised of individuals who have worked to represent their communities in other capacities and who have a solid
understanding of municipal concerns to share with other Directors. Historically,Directors have dedicated from 10

provides the maximum benefit in order to assure the city's needs are met in the most effective manner. She
explained that the City of Wylie has two board members on the NTMWD Board; Mr. Harry Tibbals, whose term
expires May 31, 2005 and Mr.Marvin Fuller whose term expires May 31, 2006. Ms.Ehrlich stated that Mr. Tibbals
was contacted and is willing to serve another term. The City Council will need to make this appointment before the
term expires in May 2005.

A motion was made by Councilman Worley, seconded by Councilman Trout to re- appoint Harry
Tibbals to the North Texas Municipal Water District Board of Directors for a two year term beginning
May 31. 2005 and ending May 31, 2007. A vote was taken and passed 6-0 with Councilwoman Allen

WEDC Director Satterwhite gave a short presentation to Council regarding remediation needed on and
around the Northwest Corner of State Highway 78 and Westgate Way. He proposed creating a TIF to
assist in the cost of this remediation with all costs incurred by Greenway Investments. Direction from
Council was to move forward and research the legal aspects of creating a TIF for this property. Present
representing Greenway Development was: Mark Hardaway and Joel Mayton. Michael Whitehead was
also present representing Whitehead&Mueller.

SUMMARY:
The subject property is 14.8 acres in size, and was annexed into the City of Wylie on July 8, 2004. An
additional 4.6 acres is to the southeast is within unincorporated Rockwall County, and not subject for
annexation into Wylie due to the City of Garland corridor between the two parcels.
An alley waiver was approved by the City Council on September 28, 2004. On November 9, 2004, the
Council approved extending Wylie sewer services into the 4.6 acres within Rockwall County.
The Final Plat will create 43 single-family lots, and dedicates 50 feet of right-of-way for the existing Troy and
future widening. The Plat complies with the Subdivision Regulations and with requirements of the SF 10/19
District of the Zoning Ordinance, as well as all other pertinent code requirements of the City of Wylie.
Financial Considerations: Development impact fees for water services and park dedication fees must be paid
prior to issuance of building permits.

Bands 2" concert May 13, 2005.

SUMMARY:
Steven Salinas approached staff following the first"Battle of the Bands" concert that was held at the BP
Community Center about having another concert in May. Steven would be setting up the concert similar to how
Jason Riddings set up the April show. Steven wants to charge a fee to enter the community center to
watch the concert and he would also want to charge the bands participating. The vendor would also like to sell
band merchandise i.e. cd's and t-shirts. Revenue generated would pay for use of the facility, rental of equipment,
and prizes for participants. Staff recommends that in addition to our staff, an off-duty police officer is on site
during the concert. This cost would need to be figured into Steven's overall costs. The last concert was well
attended and went off without any problems.
At the April 25, 2005 Parks and Recreation Board Meeting the Board approved the request for Mr. Salinas to
have the concert with the staff stipulation of the off-duty police officer be on site during the event.

Helpful Information
The City of Wylie has an exclusive contract that allows the sale of only Pepsi products within all park, recreation, community center
facilities, and other city facilities. If food is prepared on-site or if food is prepared off-site and brought to the location to be sold, the
vendor must contact the City Inspections Office at 972-442-8150 in order to obtain a Health Permit prior to the sale of such products.
An Inspector must examine the food preparation and food storage equipment to assure the health and safety of customers.
Section 78-150 of the City Code of Ordinances states: It shall be unlawful for any person to solicit for sale,vend,peddle,sell or offer to
sell any cold drinks, cigars,tobaccos,cigarettes,fruits,candies,goods,wares or merchandise of any kind or nature whatsoever within

SUMMARY:
The U.S. Department of Justice requires all Police Agencies to enter into the Federal Equitable Sharing
Agreement in order to receive money or property seized and forfeited in federal court.
The agreement requires the receiving agencies to account for seized funds separately, spend seized funds for
law enforcement purposes only, and to submit an annual certification report and audit.
By signing the agreement we also agree to comply with Title VI of the Civil Rights Act of 1964, and the
National Code of Professional Conduct for Asset Forfeiture.
The agreement is good for three years.
When we make large drug cases and/or have large seizures of money and/or property we are likely to file
Federal Conspiracy Cases, if applicable.
The preference for filing in Federal Court is that the sentences are longer, there is no good time in Federal
prison, and we get a larger percentage of the seized funds.
In order to be able to file cases with seizures in Federal Court we must have a signed Federal Equitable
Sharing Agreement.

2. Signatories. This agreement must be signed by the head of the law enforcement agency and the head of the governing body.
Examples of law enforcement agency heads include police chief,sheriff,director,commissioner,superintendent,administrator,
chairperson, secretary, city attorney, county attorney, district attorney, prosecuting attorney, state attorney, commonwealth
attorney,and attorney general. Examples of governing body heads include city manager,mayor,city council chairperson,county
executive, county council chairperson, director, secretary, administrator, commissioner, and governor. Receipt of the signed
agreement is a prerequisite to receiving any equitably shared cash,property,or proceeds.
3. Uses. Any shared asset shall be used for law enforcement purposes in accordance with the statutes and guidelines that govern
equitable sharing and as specified in the equitable sharing request (either a DAG-71 or a TDF 92-22.46) submitted by the
requesting agency.
4. Transfers. Before the undersigned law enforcement agency transfers cash,property, or proceeds to other state or local law
enforcement agencies,it must verify first that the receiving agency has a current and valid Federal Equitable Sharing Agreement
on file with both the Department of Justice and the Department of the Treasury. If there is no agreement on file,the undersigned
law enforcement agency must obtain one from the receiving agency and forward it to the Department of Justice and the
Department of the Treasury as in item 1. A list of recipients and the amount transferred must be attached to the Federal Annual
Certification Report.

5. Internal Controls. The parties agree to account separately for federal equitable sharing funds received from the Department
of Justice and the Department of the Treasury. Funds from state and local forfeitures and other sources must not be commingled
with federal equitable sharing funds. The recipient agency shall establish a separate revenue account or accounting code for state,
local,Department of Justice,and Department of the Treasury forfeiture funds. Interest income generated must be accounted for
in the appropriate federal forfeiture fund account.
The parties agree that such accounting will be subject to the standard accounting requirements and practices employed for other
public monies as supplemented by requirements set forth in the current edition of the Department of Justice's A Guide to Equitable
Sharing of Federally Forfeited Property for State and Local Law Enforcement Agencies(Justice Guide),and the Department of
the Treasury's Guide to Equitable Sharing for Foreign Countries and Federal, State, and Local Law Enforcement Agencies
(Treasury Guide). The accounting of shared funds must be reported on the Annual Certification Report.
The misuse or misapplication of shared resources or the supplantation of existing resources with shared assets is prohibited.
Failure to comply with any provision of this agreement shall subject the recipient agency to the sanctions stipulated in the current
edition of the Justice or Treasury Guides,depending on the source of the funds or property.
6. Federal Annual Certification Report. The recipient agency shall submit an Annual Certification Report to the Department

PICNIC PAVILIONS
The City of Wylie is soliciting competitive bids for the installation of picnic
pavilions in Sage Creek North Park and Cimarron Estates Park. Sealed bids will
be accepted at the Wylie Municipal Complex, Office of the Purchasing Agent,
2000 Highway 78 North, Wylie, Texas until 2:00 PM April 27, 2005, at which time
and place all duly received bids will be publicly opened. The City reserves the
right to reject any or all bids and to accept the bid that provides the best value for
the City.
The successful bidder shall furnish the specified pavilion structures and provide
all labor, materials and equipment necessary for the installation of the pavilions
per the attached specifications. Concrete foundations, piers and anchor bolts are
in place at both job sites. The City reserves the right to award a single lump sum
contract for both projects or to award separate contracts for each project. .
GENERAL PROVISIONS
Sage Creek North Park Pavilion- The City shall provide the contractor with
certified engineered shelter drawings for this project. Delivery and installation of
the pavilion structure shall be completed within 100 (one hundred) calendar days
after award of contract. Plans and specifications are attached.
Cimarron Estates Park Pavilion- Contractor shall be responsible for acquiring
certified engineered shelter drawings for this project. Delivery and installation of
the pavilion structure shall be completed within 120 (one hundred-twenty)

.1875" wall thickness, the upper TS purlin shall be 7'-7 3/4" tube length x 4" x 8" x .1875", all members shall be
factory pre-drilled. there shall be no center column. The roof pitch shall be 6:12 in the roof plane. Eave height
to be —8'.
IV. Frame: All structural framing shall be structural tube steel with end caps to form a clean, neat
appearance with no place for bird nesting. Since all connections will bolt together, field welding shall not be
required. Bolts shall be a single anchor bolt, concealed within the tubing where possible. All structural
members to be designed in accordance with AISC and AISI specifications. High strength, bolted connections to
be used. AWS standards to be used on all welded connections. Steel frame to be factory prime painted with a
rust inhibitive modified alkyd primer according to Steel Structures Painting Council (SSPC-SP2) as outlined in
AISC 6.5. The columns&frame shall be finished painted in the field with a weather resistant paint, supplied
and applied by the installer.
V. Columns: Columns shall be 6" x 6" x 8'-10 7/8" in length, complete with a coverplate assembly (to
conceal the hidden single anchor bolt). The shelter shall be set on prepared footings. Foundation will be
designed to meet the local code &good construction practices for the specific site conditions.The structure
shall be attached to the top of the concrete pier by use of anchor bolt(s)as specified by the manufacturer.
Anchor bolts not supplied by shelter manufacturer, rather by the installer, a.b.'s shall be a minimum 3/4"

VI. Metal Roofing System:The roof system shall be 24-gage painted galvanized roof decking with 1-3/16"
high ribs, 12"on center. It shall be precut into panels 3'wide by the length from the eave to the ridge. Angles
shall be factory precut. Ribs shall run with the pitch of the roof for proper drainage. Panels shall be pre-
painted with a "Kynar 500" paint system to a color selected from the standard color chart. Matching roof trim

SUMMARY: The Parks Department operating budget for fiscal 2005 includes an allocation of$16,800 for
concrete work in Eureka Park (formerly Cimarron Estates Park) consisting of a pavilion foundation slab,
playground landing slab and sidewalks. The 4B Parks budget includes funding for a concrete parking lot at
Oak and Jackson which will serve Olde City Park. The budget estimate for that project is $36,000.00. Staff
has solicited competitive sealed bids for the work, in accordance with Chapter 252 of the Texas Local
Government Code. One bid has been submitted by Holley & Holley Concrete. The total bid for the concrete
work at Eureka Park is $16,550.00 and the parking lot bid is $34,035.00, for a grand total of$50,585.00.

THIS AGREEMENT, made and entered into this 10th day of May, 2005, by and
between The City of Wylie, a municipal corporation of the County of Collin and the State
of Texas, Party of the First Part (hereinafter termed "City"), and Holley & Holley
Concrete Co., Inc. of the City of Wylie, County of Collin and State of Texas, Party of the
Second Part(hereinafter termed"Contractor").
WITNESSETH: That for and in consideration of the payments and agreements
hereinafter set forth,the City and Contractor agree as follows:
THE CONTRACTOR shall perform all of the work as specified in the contract
documents, generally described as:

PARKING LOT CONSTRUCTION AT OAK&JACKSON
and all extra work in connection therewith under the terms of the contract documents and,
at Contractor's own proper cost and expense, shall furnish all materials, supplies,
machinery equipment, tools, superintendence, labor, insurance and other accessories and
services necessary to complete said work in accordance with the conditions and prices
stated in the bid attached hereto.
THE CITY shall pay the Contractor for the performance of the work, subject to
additions or deductions by change order or as otherwise provided in the contract
documents, in current funds, the sum of Fifty Thousand Five Hundred Eighty Five
Dollars ($50,585.00).
THE CONTRACT DOCUMENTS shall consist of this written agreement, the bid
specifications, Contractor's Bid Submittal and the construction plans, all of which

RECOMMENDED ACTION:
The Planning& Zoning Commission voted to recommend adoption of these revisions on April 5, 2005.
SUMMARY:
The public hearing was convened as published on April 26,2005, but the Council tabled discussion until
the May 10 meeting so that additional research and recommendation could be provided concerning the
sufficiency of retail and commercial uses and the proportion of residential densities (lot sizes). The
Council has tabled any decision on the proposed revisions until the May 24,2005 meeting.
At a work session held May 3, the Planning and Zoning Commission discussed further the proposed
retail locations and residential lot sizes. It was the general consensus of the Commission that retail
continue to be limited to the major highway corridors and to major intersections of thoroughfares
(reaffirming specific locations identified on the Land Use Map). The Commission generally reaffirmed
the recommendation that 10,000 sq. ft. be the smallest lot permitted in new single-family subdivisions,
with smaller lots and multifamily residential being restricted to areas already zoned and platted for
such densities. It is recommended that undeveloper areas closer in to Wylie's urban core be developed
with 10,000 to 20,000 sq. ft. lots while those areas further outlying areas of the Extraterritorial
Jurisdiction be restricted to rural developments with lots in excess of one acre.
Once the revised Comprehensive Plan is adopted, the Zoning Ordinance and Subdivision Regulations will be
revised accordingly. Lands already zoned and platted for uses other than those recommended by the current
Plan have a legal right to develop to the code which was in effect at the time of platting regardless of the
recommendations of the Plan. However, lands which are not yet platted have no vested rights and must be
developed in full compliance with the revised Plan and requirements of the Zoning Ordinance.

The attached Analysis of Comparable Annual Tax Revenue compares the economic impact of varied densities
of residential and retail land uses. This analysis indicates that lower-density residential of larger lots, even
when occupied by larger and more expensive houses, provides less annual property tax revenue to the City
than does smaller lots of higher-density residential with less expensive houses. It also indicates that a similar
acreage of commercial uses provides at least four times the annual revenue (combined property and sales
taxes)than does residential uses.
The following is a summary of the revised land use philosophy of the Comp Plan. At their February 22
hearing, the P&Z Commission voted to expand lands allocated to light industrial uses to include the area west
of the Regency Business Park, and to add additional neighborhood service retail to the far southeast quadrant.
These amendments are reflected on the attached Land Use Map.
1. A more vehicular-oriented land use allocation criteria will be substituted for the current pedestrian-
oriented "Village Center" philosophy of the Plan, more closely reflecting the realities of Wylie's natural
land character and existing rural development pattern, and will result is less commercial uses and lower-
density residential developments.
2. Retail and commercial uses will be limited and oriented to major traffic corridors for vehicular access and
to avoid impacting residential areas, including a hierarchy of development patterns.
• Neighborhood services such as convenience goods and personal services will be limited to less than
10 acres at selected major intersections.
• Community retail offer comparison/shoppers goods in centers of about 30 acres and will be limited
to three areas—the new Town Center at SH 78 and FM 544, FM 544 at CR 1378/Hooper and SH 78
and Park Blvd/Spring Creek.
• Diverse and intensive mixture of commercial uses will be allocated along the major traffic corridors
of SH 78 and FM 544, but designed in unified clusters.
3. Residential development patterns will provide three density levels in attempt to provide a balanced variety
of housing options.
• High-density residential, including small-lot detached and collective attached dwellings, will be
allocated to infill areas already developed or zoned for such densities and house types.
• New residential developments will be limited to three density levels, and located by their distance
from traffic corridors
- 10,000 sf lots with 2,400 sf houses
- 20,000 sf lots with 2,600 sf houses
- acreage lots with 3,000 sf houses.
4. Industrial uses will be divided into two types.
• Light industrial will accommodate assembly and warehousing/distribution envisioned by the Business
Center zoning, largely within existing centers platted for smaller developments and the expansion of
the existing Wyndham and Regency Additions.
• Heavy industrial will accommodate manufacturing within campus settings envisioned by the Industrial
zoning, allocated to existing zoning within the Premier and railroad yards areas.
5. Institutional and public/semi-public uses may be located within any use areas, as appropriate to best
service the other land uses which they support but designed to be compatible with surrounding uses.

THE COMPREHENSIVE MASTER PLAN OF THE CITY OF
WYLIE; PROVIDING FOR A PENALTY FOR THE VIOLATION OF
THIS ORDINANCE; PROVIDING FOR REPEALING, SAVINGS AND

WHEREAS, Section 211.004 of the Texas Local Government Code ("Law") provides
that zoning and certain other land use and development regulations of municipal governments
must be in accordance with a Comprehensive Plan; and
WHEREAS, the City of Wylie, Texas ("Wylie") did, on July 27, 1999, in compliance
with such State laws, adopt a Comprehensive Master Plan to serve as a guide for land use
development and regulations; and
WHEREAS, the City Council of the City of Wylie, Texas ("City Council"), has
determined that the Comprehensive Master Plan of the City of Wylie should be amended,
through investigations by its Planning and Zoning Commission; and
WHEREAS, Wylie has complied with all notices and public hearings as required by
State law.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WYLIE,TEXAS:
SECTION 1: Adoption: The Comprehensive Master Plan of the City of Wylie, Texas,
be, and the same is hereby, adopted, said Plan being described in Exhibit A "Land Use
Distribution Philosophy" and Exhibit B "Land Use Plan Map" attached hereto and made a
part hereof for all purposes.

SECTION 2: Savings/Repealing Clause: Wylie's Comprehensive Master Plan, as
adopted July 1999, shall remain in full force and effect, save and except as amended by this or
any other Ordinance. All provisions of any ordinance in conflict with this Ordinance are
hereby repealed, but such repeal shall not abate any pending prosecution for violation of the
repealed ordinance, nor shall the repeal prevent a prosecution from being commenced for any
violation if occurring prior to the repeal of the ordinance. Any remaining portions of said
ordinance shall remain in full force and effect.
SECTION 3: Severability: Should any section, subsection, sentence, clause or phrase
of this Ordinance be declared unconstitutional or invalid by a court of competent jurisdiction,
it is expressly provided that any and all remaining portions of this Ordinance shall remain in
full force and effect. Wylie hereby declares that it would have passed this Ordinance, and
each section, subsection, clause or phrase thereof irrespective of the fact that any one or more
sections, subsections, sentences, clauses and phrases be declared unconstitutional or invalid.
SECTION 4: Penalty Provision. Any person, firm, corporation or business entity
violating this Ordinance or any provision of Wylie's Comprehensive Master Plan, or as
amended, shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be
fined a sum not exceeding Two Thousand Dollars ($2,000.00). Each continuing day's
violation under this Ordinance shall constitute a separate offense. The penal provisions
imposed under this Ordinance shall not preclude Wylie from filing suit to enjoin the violation.
Wylie retains all legal rights and remedies available to it pursuant to local, state and federal
law.
SECTION 5: Effective Date: This Ordinance shall become effective from and after its
adoption and publication as required by law the City Charter and by law.

COMPREHENSIVE PLAN
LAND USE DISTRIBUTION PHILOSOPHY
The Comprehensive Plan provides general guidelines for the appropriate location and concentration of
development for the major types of land uses, and, thereby, provides a basis for planning public
services and infrastructure,within Wylie and its Extraterritorial Jurisdiction. The Plan offers
generalized criteria for the testing of zoning regulations and requests for changes in current use, as well
as for evaluating newly arising issues and uses. Both the quality and quantity of public as well as
private development can be directed by the philosophy of the Plan, in order to determine how best to
utilize Wylie's only nonexpendable resource—our land.
The following philosophy provides criteria for allocating commercial, residential, industrial and public
land uses within the Comprehensive Plan. Application of these criteria will assure the suitability of
future land development patterns to achieve the common goals of both the public and private sectors.
COMMERCIAL
Commercial land uses provide retail goods and personal services as well as employment opportunities
to support the local residential population, and public sales tax revenues to supplement property taxes.
However, commercial uses are also major traffic generators, and these uses should be located along
thoroughfares, preferably at major street intersections, to avoid negatively impacting residential
neighborhoods. Wylie's potential to support commercial land uses is constrained by its limited
ultimate population and the competition of near-by regional-scale commercial centers. To serve the
future population, three types of commercial categories are proposed, defined by their primary service
function and named by the appropriate zoning classification of the current Zoning Ordinance.
Neighborhood Services
These are retail/office centers smaller than 10 acres intended to serve immediately adjacent residential
neighborhoods with convenience goods and services, and accommodate the uses of the Neighborhood
Services (NS) and Office(0) zoning. These uses should be clustered in unified centers and designed
to reflect the character of the adjacent neighborhoods which they serve. The centers should be evenly
distributed throughout Wylie, located at least two miles apart at one or two corners of 4-way
intersections of major thoroughfares(4 to 6 lanes).
Community Retail
Community commercial centers serve the populations of several residential neighborhoods with
comparison shoppers' goods as well as convenience goods and personal services. These should
accommodate the uses of the Community Retail(CR) zoning, be unified in plan and design, and be
located at major intersections. The growing commercial complex at SH 78 and FM 544 should be
encouraged to become Wylie's New Town Center, attracting the broadest diversity of commercial
functions and reflecting the community's overall character as its central place and focal point. Other
community retail centers should be more residential in character to blend with adjacent neighborhoods
and subordinate to and not competing with the Town Center, and these should be located on SH 78 at
Park Blvd. and FM 544 at CR 1378/Country Club.
Mixed-Use Corridor Commercial
This category should be the most diverse and intensive mixture of commercial uses. These uses are
located along major thoroughfares to accommodate easiest vehicular access. They accommodate the
broadly-varied uses of the current Corridor Commercial (CC)zoning district, from convenience retail
and services to light industry. Such uses are planned and constructed as common"strip" developments
or independent free-standing establishments with common joint/cross access, but are guided by design
regulations of the Zoning Ordinance and screened from residential adjacency.
RESIDENTIAL
Wylie has historically been primarily a residential settlement, and most of its remaining land is suitable
for a variety of housing types. Wylie should continue to grow as a"bed-room community, with
residential as the principal land use, while providing a balanced variety of housing opportunities.
Future residential development should be planned to provide a choice of dwelling types but in
compatible neighborhoods which reflect this historic low-density rural character. This philosophy
demands that less land be allocated to nonresidential service uses, but more to roads, parks, and
schools and other residential-support uses. Three levels of residential density are proposed, based on
the current zoning classifications.
High-Density Residential
This category includes small-lot detached and collectively attached dwellings, and should be limited to
infill areas already developed or zoned for such densities and housing types with no expansion.
Variances from the current code regulations may be required to accommodate such in-fill development
or the redevelopment of older areas developed in compliance with earlier codes.
Medium-Density Residential
This category includes only detached single-family dwellings of not more than 4 dwelling units per
acre(minimum lots size of 10,000 sq. ft.). These are designed as traditional suburban residential
neighborhoods located closest to vehicular thoroughfares and urban services such as retail, schools and
parks.
Low-Density Residential
This category is to accommodate the rural residential development, with lots exceeding 1-acre in size.
Such lots need not accommodate agriculture uses, and must be 2 acres or larger to accommodate
livestock or cultivated crops. These areas may have rural/estate streets with no curb or subsurface
drainage, and be furthest from thoroughfares.
INDUSTRIAL
Industrial land uses primarily provide employment for the local population while providing
manufactured products for the region and world beyond, as well as generating private revenues
through employment and sales and public revenues through taxes. Industrial uses can generally be
divided into two categories, depending on the intensity of the operations and their consequences, and
their locational requirements depend on such impacts.
Heavy Industry
Heavy industry generally includes the more-intensive processing and manufacturing of raw materials
into usable products, and such operations normally create the most obnoxious consequences. Heavy
industry requires access to regional transportation (highways and rail) and resources (water) as well as
special utilities, and should be isolated or buffered from other land uses on larger campus settings. The
northeast area of Wylie, as well as the existing Premier Business Park in the southwest, provide these
unique locational criteria. This category corresponds to the Industrial (I)District of the current Zoning
Ordinance.
Light Industry
Light industry includes less-intensive assembly, warehousing and distribution of products, as well as
people-based office-oriented operations and even intensive commercial activity. These uses are related
to the Business Center(BC)zoning district, although setback requirements of the BC must be adjusted
to accommodate the platted smaller lots. Such operations can be located on the smaller lots within
existing Century, Regency and Wyndham industrial districts, as well as the expansion of the Wyndham
area toward the north and Regency to the west.
INSTITUTIONAL/PUBLIC AND SEMI-PUBLIC
All private development requires certain public or quasi-public support use, which must be planned in
coordination with the private uses.
Municipal Uses
Some municipal uses(such as business offices) need to be centrally located and equally accessible y
all residents, while others(such as fire stations) need to be decentralized and equally accessible to all
residences. New municipal offices should be located within or adjacent to the planned Town Center to
help enforce the image of this area as Wylie's central address and destination place.
Utilities (such as water and energy) have unique design criteria which largely dictate their location.
Public utilities must be within or adjacent to the other land uses which they serve, but should be
located as well as designed so as to blend with rather than detract from the character of the surrounding
primary uses.
Streets and roads make development possible, and their capacity largely dictate (or are dictated by)the
potential density/intensity of the various uses of land. Thoroughfares should be planned in accordance
with the current Thoroughfare Plan and Engineering Design Standards.
Schools and Houses of Worship
Schools and day care operations as well as churches and other religious instructions generally belong
in proximity to the residential populations which they serve. However, as major traffic generators,
these institutional uses should be placed to the exterior of residential neighborhoods and clustered
together when possible.
Parks and Recreation
Public parks and recreational facilities should be located in accordance with the adopted Parks,
Recreation and Open Space Master Plan. Both public and private leisure amenities should be designed
as an asset to the residential uses rather than detract from them with traffic and other nuisances.

The Planning & Zoning Commission voted on April 5, 2005 to recommend approval of this request, with
certain stipulations on April 5, 2005 (incorporated into the following information and attachments).
SUMMARY:
The public hearing was convened as published on April 26, 2005, but Council tabled discussion and
decision on the request until the May 10 meeting in order to allow time for an expanded traffic study to
be completed.
The PD proposes to extend Mainstream Drive to link with Riverway Lane for additional traffic
access/egress. Consultants have performed an expanded traffic analysis, which is attached. This study
concludes that the proposed connection is justified and will reduce traffic on Claybrook to levels below
those currently existing regardless of the number of lots (proposed 8,500 sq. ft. or 10,000 sq. ft.) allowed
in Phase 9. The closure of Claybrook to the east, disconnecting it directly from Phase 9, would not
reduce the traffic volumes.
Notification/Responses— Sixty-six (66) notifications were mailed, including the 48 properties within the legal
notification area and the 18 providing written response for the March 1 hearing. Written responses
representing thirty-six (36) properties were returned, thirty-two (32) opposed and four (4) favoring. Requires
simple majority of the Council for approval.
Property totals 59.24 acres, effectively land-locked between the existing Sage Creek development and the
Muddy Creek floodplain. The request is to expand the existing Sage Creek Planned Development District
(PD 99-9) for single-family residential uses. The floodplain occupies the eastern two-thirds of the tract.

The currently-adopted Comprehensive Plan recommends lots of 1 acre or larger, and revisions to the Comp
Plan currently being considered recommend medium-density residential (10,000 to 20,000 square feet lots).
The requested smaller lot size of the PD (8,400 sq. ft.)does not conform to either of these recommendations.
The stated purpose of a Planned Development District is to permit flexibility and innovation in the use and
design of land and development. The proposed PD offers somewhat larger minimum lot and house size than
currently exists within the Sage Creek development, but little innovation beyond the standard requirements of
the Zoning Ordinance. No site constraints have been documented requiring lots smaller than recommended
by the Comp Plan and neighboring properties to the east. The PD zoning is not justified
The Conditions of the PD establish a minimum lot size of 8,400 square feet, which is smaller than the
minimum currently allowed by the Zoning Ordinance but somewhat larger than those being developed in
neighboring subdivisions (67% of Sage Creek lots are 7,200 sq. ft. or larger and the average lot size in
Wooded Creek is 8.5K s.f.). Ranch Creek Estates, across the creek to the east, is developed with rural lots in
excess of 10 acres. The previous proposal requested a minimum lot size of 7,200 sq. ft.
The PD provides that 50% of the houses must be 2,400 square feet or larger, and a minimum house size of
2,000 square feet. For two-story houses, the second floor cannot measure more than 40% of the total area of
the house. At least 15% of the total houses must have either 3-car garages or side entry garages from swing
drives. This size is larger than the existing Sage Creek subdivision and Wooded Creek as well as the
minimum currently required by Wylie's zoning regulations (1,700 sq. ft.). The remainder of Sage Creek has
front-entry garages while Wooded Creek has rear-entry garages.
The PD generally follows the design requirements of the current Zoning Ordinance, except for narrower lot
widths (60 feet rather than 70 feet), side yards (5 feet rather than 7) and smaller porches (14 feet rather than 20
feet). The applicant has not documented why the development cannot comply fully with the standard
regulations of the ZO.
The PD waives the required alleys, to continue the character of the existing Sage Creek development which
does not provide alleys and has front-entry garages. Alleys with rear-entry garages are provided within the
Wooded Creek subdivision.
The PD provides 30 acres of land as public park and proposes to construct a parking lot and trail through the
Muddy Creek floodplain, as well as a private amenity center of approximately one acre. The proposed 95 lots
require 4.75 acres of park dedication (fees or equivalent in lieu of land because under 100 lots). The Park and
Recreation Board has recommended acceptance of this concept.

provisions of this ordinance shall remain in full force and effect.
SECTION 3.
That the above described property shall be used only in the manner and for the purposes
provided for in the Comprehensive Zoning Ordinance of the City, as amended herein by the
granting of this zoning classification.
SECTION 4.
Any person, firm or corporation violating any of the provisions of this ordinance or the
Comprehensive Zoning Ordinance, as amended hereby, commits an unlawful act and shall be
subject to the general penalty provisions of Section 1.5 of the Zoning Ordinance, as the same
now exists or is hereafter amended.
SECTION 5.
Should any paragraph, sentence, subdivision, clause, phrase or section of this ordinance
be adjudged or held to be unconstitutional, illegal or invalid,the same shall not affect the validity

The repeal of any ordinance, or parts thereof, by the enactment of this Ordinance, shall
not be construed as abandoning any action now pending under or by virtue of such ordinance;
nor shall it have the effect of discontinuing, abating, modifying or altering any penalty accruing
or to accrue, nor as effecting any rights of the municipality under any section or provisions of
any ordinances at the time of passage of this ordinance.

General Conditions:
1. This Planned Development District shall not effect any regulation within the Code of
Ordinances, except as specifically provided herein.
2. All regulations of SF-8.5/17 District set forth in Article 3, Section 3.3 A.3 of the
Comprehensive Zoning Ordinance(adopted as of February 27, 2002) are included by reference
and shall apply except as provided herein.
3. The attached Development Plan(Exhibit C) shall serve as a Preliminary Plat. The Development
Plan shall conform to the written conditions of the Planned Development, but in case of conflict
between the two, the written conditions shall prevail.
Special Conditions:

Maximum number of Single Family dwelling units permitted in this Planned Development
shall not exceed 95 units
Minimum Lot Size will be 8,400 square feet

10. Crosswalk Construction
Specialty pavers will be installed at all crosswalks within subdivision. Pavers will be installed at a
minimum width of 4 feet
11. Park Dedication
City of Wylie Park Fees shall not be waived or reduced for development within this Planned
Development District. The Owner/Developer may dedicate acreage in lieu of fees and/or use
comparable funds to provide park improvements within this Planned Development District. The
cost of park improvements shall be equal to or greater than the park land dedication requirements in
effect at the time of platting. All park improvements shall be coordinated with the Director of
Community Services or his designee, prior to initial construction of the development. All park
improvements shall be installed and/or fees paid prior to City acceptance of the development or as
otherwise agreed to between Owner/Developer and the City of Wylie.
Subject to Parks Board approval, Owner/Developer shall dedicate to the City of Wylie
approximately 30 acres of land within this Planned Development District. Park land dedication is
located on the eastern portion of the Planned Development District.
Conditions for Planned Development-Sage Creek Phase 9 3
Subject to Parks Board approval, Owner/Developer shall construct an 8' trail system within this
Planned Development District. Trail shall be located in the area just west of Muddy Creek. Trail
will tie into trail constructed within Sage Creek Phase 8 to the north of this Planned Development
District. This trail will be located within the dedicated park land referenced in the paragraph above.
12.Access Bridge Construction
Subject to Parks Board and City approval, Owner/Developer shall construct a 2 lane roadway and
bridge across City owned land that extends Midstream Drive westerly across the creek and connects
to Riverway Lane. Bridge shall include sidewalks on both sides of the roadway.

Dear Mr. Holstead:
Ashton Woods is currently proposing to improve a tract of land located to the east of
the existing Sage Creek Phase 7 subdivision and to the south of Sage Creek Phase 8.
The issue of increasing traffic in the existing subdivisions if the proposed addition is
approved has been raised by the residents and the City Council.
There have been discussions between the City and the Developer of Sage Creek
Phase Nine about the possibility of constructing a connection from the intersection of
Midstream Drive and Rockton Drive located at the north end of Sage Creek Phase
Four to Riverway Lane. The connection would be constructed over an existing
drainage channel located on property owned by the City of Wylie. This connection
would reduce the amount of traffic traveling on Claybrook Drive, provide better access
for Phases Four and Eight of Sage Creek and improve emergency access for fire and
police for all of Sage Creek. Although the capacity calculated for Claybrook Drive on a
previous traffic study provides an adequate avenue so that the traffic is not delayed
due to congestion, the amount of vehicles on the street has raised concerns from
existing homeowners. This study evaluates different scenarios of street and lot
configurations in order to provide information to the City Council.
The following data analyzed the existing conditions of the traffic on Claybrook and then
the future traffic conditions, of various options for Sage Creek Phase Nine, was also
analyzed. The methodology for trip generation is from the Institute of Transportation
Engineers (ITE) Trip Generation.
I. Under the existing conditions, the number of homes that access Claybrook Drive is
100% of Sage Creek Phase Eight(111 lots), 100% of Sage Creek Phase 4 located
north of Claybrook Drive (59 lots) and 100% of the residential homes located on
Claybrook Drive (41 lots).

Under the current conditions the maximum calculated peak-hour trips are 173 along
Claybrook Drive.
II. The second scenario was calculated based on platting the Sage Creek Phase Nine
with 95 lots as depicted in the Proposed PD and building the proposed connection.
The construction of Sage Creek Phase Nine will allow traffic from Sage Creek Phase
Eight to also exit south on Wooded Creek Avenue (denoted as S. Wooded Creek)
through Wooded Creek Estates to FM 544. It is estimated that 32 lots from Sage
Creek Phase Four and 71 lots from Phase Eight will travel over the proposed
connection. It is estimated that 80% of the traffic from the remaining lots in Sage
Creek Phase Eight (40 X 80% = 32 lots) and 80% of the traffic from Sage Creek Phase
Nine (95 X 80% = 76 lots)will continue to travel along Claybrook Drive by way of N.
Wooded Creek and the remaining 20%will travel along S. Wooded Creek. Note: North
Wooded Creek Avenue (denoted as N. Wooded Creek) is the main road in Phase Eight
and serves as a collector for the traffic in Phase Eight except for Midstream Drive.

Phase Nine with 80 lots (10,000 sf lots) as per the comprehensive plan and not
building the proposed connection. The construction of Sage Creek Phase Nine will
allow traffic from Sage Creek Phase Eight to also exit south on Wooded Creek Avenue
through Wooded Creek Estates to FM 544. It is estimated that 80% of the traffic from
Sage Creek Phase Eight(111 X 80% = 89 lots) and 80% of the traffic from Sage Creek
Phase Nine (80 X 80% = 64 lots) will continue to travel along Claybrook Drive and the
remaining 20%will travel along Wooded Creek Avenue.

V. The final scenario was calculated based on platting the Sage Creek Phase Nine
with 95 lots as depicted in the Proposed PD, building the proposed connection and
closing Claybrook. The construction of Sage Creek Phase Nine will allow traffic from
Sage Creek Phase Eight and Nine to also exit south on Wooded Creek Avenue
(denoted as S. Wooded Creek) through Wooded Creek Estates to FM 544. It is
estimated that 32 lots from Sage Creek Phase Four and 100% lots from Phase Eight
will travel over the proposed connection. It is estimated that 50% (95 X 50% =48 lots)
of the traffic from Sage Creek Phase Nine (95 X 50% =47 lots)will also travel over the
proposed connection by way of N. Wooded Creek and the remaining 50%will travel
along S. Wooded Creek.

For a residential street, a density of less than 11 pc/mi/In is required for a Level of
Service of A. Under the proposed condition of platting Phase Nine without constructing
the proposed connection provides the worst case scenario for traffic along Claybrook
with the following calculations : the density of Claybrook is calculated by 217 pc/hr=2
lanes= 109 pc/hr/In. The design speed of Claybrook is 30 mph. The current density is
109 pc/hr/In _30 mi/hr= 3.6 pc/mi/In. At peak-hour there will be approximately 3.6
vehicles per lane under the proposed conditions without constructing the connection
along a mile section of Claybrook at any given time. Claybrook is adequately
designed to carry the calculated traffic with a level of service of A.
Since Claybrook is at a level of service A for the worst case scenario, it will be a level
of service A for the remaining scenarios. The other factor to evaluate is the various
options to improve the overall traffic in the area. In short, the following table
summarizes the findings of this report

CONCLUSION:
The data would support that by constructing the connection, the traffic on Claybrook
will be reduced from existing conditions and will be significantly lower than if 10,000 sf
lots are platted per the comprehensive plan without a connection. Furthermore, by
closing Claybrook, it appears to not solve the traffic issue in the area but rather shift it
to a different location. Therefore, the data supports Proposal II for distributing existing
traffic and proposed traffic with as many alternatives as possible.

In response to Mr. Bruce Miller's email about an alternative to the proposal
suggested by the developer, please consider the following:
Mr. Miller suggested one option to construct the bridge as an extension of Ryan Lane
westward to Riverway Lane. This proposal would direct additional traffic onto Ryan
Lane, and that situation is not desirable. The developer has constructed a
playground in the dedicated park area immediately adjacent to north side of Ryan
Lane, and additional traffic along Ryan Lane would pose a danger to children playing
in and around this area.
Mr. Miller's second option, and the more desirable of the two options from a Park
Department point of view, is preferred. Mr. Millers suggests that the bridge structure
be aesthetically pleasing and be complimented with desirable materials of
construction, landscape features, and adequate traffic signs.
Mr. Miller also asks whether he could "take over approximately 35 feet of dedicated
open space so that he can maintain it rather than allowing the Park Department to
maintain it. The Park Department has recently improved its maintenance of this area
and desires to continue such in the future. As additional park amenities are
completed and installed in Riverway Park and in the park area in Sage Creek Phase
VIII, Park Department employees will be conducting more routine operations in the
area, and overall maintenance of this particular site referenced by Mr. Miller shall
continue to improve.

The following are notes from personally calling the citizens that spoke to Council on
April 26`", 2005 in favor and opposition to the development and bridge of Sage Creek
Phase 8 &9.
Jim Byrne (spoke to wife):
• In Favor of the bridge to ease traffic concerns on Claybrook.
• In favor of Claybrook being opened up to Phase 9 to ease traffic and give
phase 9 3 points of entry.
• Stated the 17 homes east of Dylan on Claybrook should have known it would
not be a dead end due to the barricade not being a permanent structure.
• Felt that the people who opposed the development and Bridge suffered no ill
effect due to being on the East side of Claybrook and the traffic influx would
be minimal as people would tend to drive the same way they always have.
• She was going to forward letter of Favor. (see attachment)
Jessica Kattenbach:
• In favor of Bridge to ease traffic concerns for Claybrook.
• Is opposed to new development because of the Traffic it would bring to the
neighborhood.
• Feels as thought the platting of the land was handled poorly and the reason
why the need for the bridge was there
• Concern about children's safety on Claybrook due to traffic.
• Claybrook was not built to handle the influx of traffic phase 8 and 9 are going
to bring
• Opposed to Claybrook being opened up on the east to Phase 9
Bruce Miller:
• Opposed to bridge due to increase of traffic
• The possibility of backup traffic causing him to be unable to exit his driveway

with no direct access to his street.

• Extremely opposed to Claybrook being shut down to a Cul de sac

• Would be less opposed to the bridge if Claybrook were to stay open and be
opened up on the east for Phase 9

Dear Beth Zoucha:
We are writing you once again in favor of Phase 9 in Sage Creek to be built by Ashton Woods. One
thing we would like to point out to you,that has never come up for discussion,regarding the opposition
of Claybrook to this Phase 9,is the fact that the largest majority of the people opposing this live east of
Dylan. They are 17 homes on a street of 41 who get no traffic flow from Phase 4 or Phase 8(now
being built).These 17 houses won't even get any real traffic past their homes until Phase 9 is built.
Meanwhile the other 24 homes are and have been getting traffic all along since the building of Phase 4.
Ashton Woods has offered to put in an extra road off of Rockton(when Phase 9 is being built)to help
this problem. This would take a lot of traffic off of Claybrook west of Dylan and would mean that the
people going into Phase 9 would have three different ways to enter their community. As we see it,if
Claybrook is totally closed off into Phase 9,then this puts the burden of traffic on the new bridge off of
Rockton which isn't fair to that street. It seems to us that by opening Claybrook up to the east,is the
only fair solution to the problem. Meanwhile,if this Phase 9 isn't passed because of 17 homes on
Claybrook opposing,then the other 800 plus homes in Sage Creek will suffer the loss of a the
completion of the land in our area with move up housing,a very nice Amenity Center with a full kitchen,
a 30 acre park and additional walking trails. So we would urge you to pass Phase 9 as it was presented
to you with Claybrook continuing into the new addition.

11. TEMPORARY DIRECTIONAL SIGNS
On properties located at the intersection of two major thoroughfares or a major
thoroughfare and a collector street, panel/directional signs are permissible subject to the
following conditions and upon the issuance of a sign permit:
A. The sign design and location must be approved the City Council;
B. Permits for such signs shall be temporary in nature and shall expire two years
from the date of permit issuance;
C. The maximum height of the sign is ten feet (10');
D. The maximum width of the sign is six feet(6');
E. The font, lettering and color of the sign shall be uniform throughout the entire
sign;
F. The sign may be located within the right-of-way, provided that, the sign is
located at least ten feet (10') from the back of the curb or road pavement and at
least two feet (2')from any sidewalk; and
G. The permit applicant, property owner or developer shall be responsible for the
cost of production, maintenance of the sign and removal of the sign.

SUMMARY:
The proposed agreement would be entered into between the City and new Police employees who are not
Certified Peace Officers. Uncertified Individuals hired for the position of Police Officer must be sent to a
sixteen-week Police Academy. The proposed agreement requires the employee to reimburse the City of Wylie
for the cost of his/her training if the employee separates from the City of Wylie prior to their two-year
anniversary. This agreement is designed to protect the City from being used as a training ground for Officers
who desire to work at a larger City, but need some experience to do so.
Rebecca Brewer of The City of Wylie's Attorney's Office developed the employment agreement
The agreement is narrowly written to provide for the reimbursement of training costs to the City and cannot be
construed as an employment contract.

NEW HIRE COST OF TRAINING REPAYMENT AGREEMENT
I, , the undersigned, acknowledge and understand that the
City of Wylie, Texas ("Wylie") is hiring me as a Wylie Police Department Recruit and
paying for my training to become a certified peace officer in exchange for me agreeing to
provide the Wylie Police Department a minimum of two(2) years of service.
I acknowledge and agree that the cost associated with my academy training, including
tuition, supplies and travel expenses, is and No/100 Dollars
($ .00) ("Costs of Training").
I acknowledge and understand that if I voluntarily leave the Wylie Police Department for
any reason prior to , 20_, I agree to repay Wylie all of the Costs of
Training within ( ) days of the date of my separation from employment with
Wylie. Notwithstanding anything to the contrary herein, I hereby authorize Wylie to
deduct any and all sums from my final paycheck to satisfy all or a portion of my
obligation to repay Wylie the Costs of Training as required herein, and I further waive
any and all rights,title and/or claim to said amount deducted from my final paycheck.
I understand that my failure to repay the full amount of the Costs of Training under the
conditions set forth and provided herein will subject me to any and all legal remedies
available to Wylie, including, without limitation, the collection of any and all applicable
interests and fees.
I AGREE TO INDEMNIFY AND HOLD HARMLESS WYLIE FROM ANY AND ALL
LIABILITY WHICH MAY RESULT FROM THE DEDUCTION OF ALL, OR A
PORTION THEREOF, OF THE COSTS OF TRAINING FROM MY FINAL
PAYCHECK WITH WYLIE.
I further acknowledge and agree that this agreement is not nor will it ever be construed,
under any circumstance, as a contract for employment with Wylie. I further acknowledge
and agree that I am an at-will employee of Wylie and that, notwithstanding anything to
the contrary herein, Wylie may terminate my employment with the Wylie Police
Department at any time and for any reason, or no reason at all.
I further acknowledge that I have carefully read this agreement and had an opportunity to
consult with an attorney prior to executing this agreement. I fully understand its binding
effect, and I am signing this agreement voluntarily.
