08-30-2005 (City Council) Minutes MINUTES WYLIE CITY COUNCIL AGENDA Special Called Meeting Tuesday, August 30, 2005 6:00 p.m. Wylie Municipal Complex/Conference Room 2000 Highway 78 North Wylie,Texas 75098 CALL TO ORDER Mayor Mondy called the meeting to order at 6:00 p.m. Council Members present were: Councilman Merrill Young, Councilman Earl Newsom, Councilman Rick White, and Councilman Carter Porter. Mayor Pro Tern Eric Hogue and Councilwoman Reta Allen were absent. Staff present were: City Manager, Mark Roath, Assistant City Manager, Mindy Manson; Finance Director, Larry Williamson; Planning &Zoning Director, Claude Thompson; Library Director, Rachael Orozco; WEDC Director, Sam Satterwhite; City Secretary, Carole Ehrlich, and Public Information Officer,Mark Witter. INVOCATION&PLEDGE OF ALLEGIANCE Councilman Newsom gave the invocation and Councilman Porter led the Pledge of Allegiance. CITIZENS PARTICIPATION There was no one present to address Council during Citizen Participation. CONSENT AGENDA All matters listed under the Consent Agenda are considered to be routine by the City Council and will be enacted by one motion. There will not be separate discussion of these items. If discussion is desired,that item will be removed from the Consent Agenda and will be considered separately. A. Approval of the Minutes from the Special Called Meeting/Work Sessions of August 16,2005 and the Regular City Council Meeting of August 23, 2005. (C. Ehrlich, City Secretary) B. Consider and act upon approval of a Joint Election Contract between Collin County and the City of Wylie for election services to be administered by Collin County Elections Administration to be held November 8, 2005. C. Consider and act upon Ordinance No. 2005-39 that the City of Wylie finds certain rate case expenses of CoSery Gas Ltd. are reasonable; providing for recovery of rate case expenses; providing for repeal of conflicting ordinances. Council Action A motion was made by Councilman Young, seconded by Councilman White to approve the Consent Agenda as presented. A vote was taken and passed 5-0 with Mayor Pro Tern Hogue and Councilwoman Allen absent. All interested persons shall be given an opportunity to be heard, either for or against any item on the proposed budget. At the end of the hearing,the City Council will schedule the time and place that the vote will be taken on the proposed budget. Staff Comments Finance Director Williamson addressed Council stating that the purpose of the public hearing on August 30, 2005, is to give the taxpayers an opportunity to express their views on the proposed budget. At the end of the hearing, The City Council must schedule and announce the meeting to adopt the proposed budget currently set for September 13, 2005 at 6:00 p.m.at the City Council Chambers,Wylie Municipal Complex,2000 Highway 78 North,Wylie,Texas 75098. Public Hearing Mayor Mondy opened the Public Hearing at 6:04 p.m. asking anyone present wishing to speak on the proposed budget to come forward,state their name and address for the record. No one was present to address Council during the public hearing for the proposed budget. Mayor Mondy closed the Public Hearing at 6:05 p.m. Council Announcement City Council set the date for the final vote on the adoption of the Proposed FY 2005-2006 Budget for September 13, 2005 at the Regular City Council Meeting to be held at the Wylie Municipal Complex, 2000 Highway 78 North, Wylie,Texas 75098 at 6:00 p.m. 2. Hold the Second Public Hearing on the proposed tax rate for fiscal year 2005-2006 and provide taxpayers an opportunity to express their views on the tax rate. At the end of the hearing, the City Council must set and announce the date, time, and place of the meeting at which it will vote on the final proposed tax rate. Staff Comments Finance Director Williamson addressed Council stating that In accordance with the "Truth in Taxation" laws of the State of Texas, on August 9, 2005, the City Council took a roll call vote on the proposed tax rate and scheduled two public hearings on the tax rate.The first public hearing was held on August 23,2005.The second public hearing is scheduled for August 30, 2005. The notices of the two public hearings were published in the McKinney Courier-Gazette on August 15, 2005, and the Wylie News on August 17, 2005. The purpose of the second public hearing on August 30, 2005, is to give the taxpayers an additional opportunity to express their views on the tax rate. At the end of the hearing, the City Council must set and announce the date,time,and place of the meeting at which it will vote on the final proposed tax rate. City Secretary Carole Ehrlich read the caption of Ordinance#2005-39 into the official record. ORDINANCE NO.2005-39 AN ORDINANCE OF THE CITY OF WYLIE, TEXAS FINDING, AFTER REASONABLE NOTICE, THAT CERTAIN RATE CASE EXPENSES OF COSERV GAS LTD. ARE REASONABLE; PROVIDING FOR RECOVERY OF RATE CASE EXPENSES;PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES.
