Generally located at the northeast corner of McCreary Rd and McMillan Rd. (1400 McCreary Rd.) ZC 2016-17 (R. 011ie, Development Services Director) H. Consider, and act upon, Resolution No. 2017-06(R) of the City Council of the City of Wylie, Collin, Dallas and Rockwall Counties, Texas, amending Resolution No. 2017-02(R) which ordered the May 6, 2017 General Election; Modifying the method of voting in Dallas and Rockwall Counties to paper ballots; and providing that the entire City shall constitute one election precinct for the election. Hold a Public Hearing and consider, and act upon, Ordinance No. 2017-08, supporting a Municipal Setting Designation to prohibit the use of groundwater in the designated area; generally located north of FM 544 and east of Commerce Street, and more specifically being 605 Commerce Street of the EC Davidson Survey; Tract 54, Abstract A0266, EC Davidson Survey; 900A W. Kirby; 900 Kirby; 908 W Kirby of the Wallace Industrial Park MSD2017- 01 (R. 011ie, Development Services Director) Executive Summary In January 2016,the City Council adopted Ordinance 2016-01 in accordance with Subchapter W of Chapter 361 of the Texas Health and Safety Code that authorizes the TCEQ to identify and designate certain areas as Municipal Setting Designations(MSD)to prohibit groundwater as potable water if there is contamination in excess of the applicable potable water protective concentration levels. 2. Hold a Public Hearing and consider, and act upon, approval of a Replat for Creekwood Estates, creating twenty-two single family residential lots, one open space lot and a private street on 20.613 acres, generally located in the City of Wylie ETJ southeast of the intersection of Whitley Road and Hunters Glen Drive. (R. 011ie, Development Services Director) Executive Summary The 20.613 acre tract is located in the City's ETJ in the county of Dallas and is southeast of the intersection of Whitely Road and Hunter's Glen Drive. The Replat will abandon a public street and replace it with a private street that will also be known as Creekwood Place.The two open space lots and private street will be maintained by a home owners association. Hold a Public Hearing and consider, and act upon approval of Ordinance No. 2017-09, establishing a curfew for minors in the City of Wylie; creating offenses for minors, parents, guardians of minors and business establishments for violating curfew regulations; defining terms and providing for defenses; providing for enforcement; providing for waiver of jurisdiction by the court when required under the Texas Family Code; providing for review of this ordinance; providing a penalty for the violation of this ordinance; providing for repealing, savings and severability clauses; providing for an effective date of this ordinance; and providing for the publication of the caption thereof. (A. Henderson, Police Chief) Executive Summary The Curfew Ordinance requires Public Hearing and review every three years in order to abolish,modify,or continue the ordinance. Generally located at the northeast corner of McCreary Rd and McMillan Rd. (1400 McCreary Rd.) ZC 2016-17 (R. 011ie, Development Services Director) Staff Comments Development Services Director 011ie addressed Council stating that the subject property is located on the northeast corner of McMillen Road and McCreary Road. The Planned Development on the property was adopted by City Council on October 6, 1999 (PD 99-32). This amendment will only be affecting the Commercial Corridor tract of land within the PD being lot 1 and lot 2, Block A of the Creekside Retail Addition. The site is currently developed with a Neighborhood Walmart and Fuel Station. Staff has reviewed the request and the changes to the signage ordinance within the PD will not negatively affect the visibility or safety in the area. Staff has also confirmed that there are other instances within the city where more than one price reader sign has been allowed. Notification/Responses: Eleven notifications were mailed to property owners within 200 feet of the proposal; none were retuned in favor or in opposition of the request. The Planning and Zoning Commissioners voted 6-0 to recommend approval. Public Hearinci Mayor Hogue opened the public hearing on Zoning Case 2016-17 at 6:28 p.m. asking anyone present wishing to speak to come forward. No one was present wishing to address Council. The lot will be labeled as Lot 1, Block B of the Inverness Pharmacy Addition. Dallas County has completed the following upgrades: 3" asphalt overlay (1" level up and finished with 2" mat), including striping and additional maintenance in the 2800 block of Sachse Road on the east and west bound lanes and in the eastbound lane adjacent to Woodbridge Phase 16 housing development. 011ie noted, if annexed, the City of Wylie will be responsible for maintenance, operation, enforcement, police and/or emergency services within these rights-of-way. Orozco, Library Director) Staff Comments Library Director Orozco addressed Council stating that Mrs. Karen Adams, a long-time volunteer with our Wagging Tales program in addition to being a Library Board member passed away in November 2016. She was a longtime volunteer for over 10 years with her dog Abby. Staff is requesting that someone be appointed to take her position for the unexpired term, February 2017-July 2017. Council Action A motion was made by Mayor pro tem Stephens, seconded by Councilwoman Arrington to appoint Mark Crader as the new Library Board member for the unexpired term of February 2017 to July 2017 per the City Charter Section 2(c), article VIII to replace Mrs. Karen Adams. A vote was taken and the motion passed 7-0. 5. Consider, and act upon, a request to provide alternative roofing options to the current cedar shingle roof located at 301 N. Ballard Avenue, for City of Wylie Brown House. (R. 011ie, Development Services Director) Staff Comments Assistant City Manager Hoisted addressed Council stating that this item was tabled on January 10, 2017. Alternatives to the cedar shingles were discussed previously and Council requested additional product samples that appeared more like wood shingles. Hoisted explained the current roof only has the cedar shingles and no plywood decking under the shingle. He provided information about a product from DaVinci Roofscapes which has a Class A fire rating and a lifetime warranty. The appearance of the roofing appears more like cedar shingles. Installation of this product does require a roof decking. Hoisted reported staff had additional discussion with the Texas Historical Commission in regards to the roof replacement. The project is required to be submitted for review by the THC staff and we expect that the THC will recommend the roof be replaced with material matching the existing roof— cedar shingles. While a synthetic cedar shingle may not be recommended by the THC, the house would not lose its historical site designation because roofing types are reversible. The product is a fiber glass base shingle with randomly applied tabs and authentic depth and dimensions of natural slate. City Secretary Ehrlich read the caption to Ordinance No. 2017-06 into the official records. Mayor Hogue convened Council into a Work Session at 6:45 p.m. WORK SESSION • Discuss a potential multi-family mixed use development on approximately 20 acres, generally located southeast of S.H. 78 and south of Alanis Drive. (M. Manson, City Manager) Jason Lane, representing OM Housing, gave a short presentation for a multi-family mixed use development on approximately 20 acres. Lane explained that 129 apartment units and 1.3 acres of retail were planned. The developer will integrate 9.9 acres with existing Parks and Recreations network of nature trails, playing fields and other open space amenities. He explained a large portion of the subject site lies within FEMA designated Flood Plain and ecologically sensitive conditions. The developer will be required to work with City of Wylie and FEMA to reclaim several acres of land. Lane reported the Housing Credits (HC) will allow for additional funds to overcome all the flood plain related issues, as well as provide for very high end finishes on facades with curb appeal. The requested contribution by the City would be $10.00. Lane requested a resolution from the Wylie City Council supporting the project to be submitted to Texas Housing and Community Affairs. Councilman Whitney asked if more than one retail facility would fit on the proposed 1.3 acre tract. Mr. Lane replied that would depend on the retail business. Mayor Hogue asked any Council members wishing to support the development to contact the City Manager for inclusion on a future agenda. Discussion In December 2015, the City was awarded $500,000 in Collin County grant funds for the installation of new concrete hike and bike trail and pedestrian connection for the Municipal Complex East Meadow Trail project in the City of Wylie. The project includes approximately 6,300 linear feet of 12-foot wide concrete trail, a boardwalk connection to the Creekhollow subdivision located to the east of the Municipal Complex property, lighted parking lot, signage, and benches. The proposed improvements comply with the recommendations of the City of Wylie's 2010 Parks, Recreation and Open Space Master Plan, and the City of Wylie's 2012 Trails Master Plan. In May 2016, the City began design work on the project with Dunaway Associates, L.P., a firm located in Fort Worth. This firm also designed the first phase of the Municipal Complex trail system that is currently in place. Site plans were reviewed with the Park and Recreation Board at various stages throughout development, and the Board concurs with the final trail design and layout. The construction plans were reviewed and approved for accessibility compliance by Texas Department of Licensing and Regulation. Staff verified Wall Enterprises' past-experience references, and this vendor has successfully completed recent installation of$49,000 worth of additional concrete parking space at the Wylie Senior Recreation Center. Staff and the design firm both recommend award of bid #W2017-29-B to Wall Enterprises for the Base Bid, Alternate A-1 and Alternate A-6 in the total amount of$939,581.20 as the lowest responsive, responsible bid. The purpose of the MSD Law is to protect the public against exposure to contaminated groundwater and to provide a less expensive and faster alternative to existing state environmental regulations governing the investigation and cleanup, and directed toward protection of human health and the environment balanced with the economic welfare of the citizens of the City. The City, along with the WEDC, worked with the EPA to clean up the site near the railroad track and Burger King along FM 544 with the goal of redeveloping the property for retail/restaurant use. Part of the process, as mandated by the State, requires the City Council to pass a resolution in support of an MSD for the site prohibiting the use of shallow groundwater as potable (drinking)water. The prohibition must be in the form of a city ordinance, or a restrictive covenant that is enforceable by the city and filed in the property records. The City does not utilize groundwater as a source for public drinking water. SECTION 2: That for purposes of this municipal setting designation ordinance, "designated groundwater" means water below the surface of the designated property to a depth of 150 feet. SECTION 3: That use of the designated groundwater from beneath the designated property as potable water, as defined in Section 361.801(2) of the Texas Health and Safety Code, and the following uses of or contacts with the designated groundwater are prohibited: (1) Human consumption or drinking (2) Showering or bathing (3) Cooking (4) Irrigation of crops for human consumption. SECTION 4: That the City Council supports the application to the Texas Commission on Environmental Quality for certification of a municipal setting designation for the designated property. SECTION 5: A person who has received approval of a MSD from the City shall, upon issuance from the TCEQ, provide the director with a copy of the certificate of completion or other documentation issued for the MSD area, showing that response actions, if required, have been completed. SECTION 6: The applicant shall execute, deliver and file, no later than thirty (30) days from the date of the TCEQ's certification, in the official real property records of the appropriate county, a deed restriction approved as to form by the city attorney prohibiting the drilling of wells and the use of designated groundwater for any purpose, including but not limited to any potable purpose, and excepting only: (i) wells used as monitoring wells for the collection of groundwater samples for chemical or biological laboratory analyses; and (ii) wells used for the purposes of remediation of soil or groundwater contamination. SECTION 7: A file-stamped and recorded copy of said deed restriction shall be delivered to the city attorney's office and the director's office within three (3)business days after the date of filing. The deed restriction shall be enforceable by the City and may be amended or terminated only with the prior written consent of the City after at least thirty (30) days prior written notice to the TCEQ of any pending amendment or termination. SECTION 8: A person commits an offense if the person fails to provide the city attorney and the director with the documentation required in this section within the specified time frames. SECTION 9: A person commits an offense if the person intentionally, knowingly, or with criminal negligence uses groundwater in a designated area for a purpose prohibited in the municipal setting designation ordinance. Ordinance No.2017-08-Prohibiting the use of groundwater from beneath property generally located north of FM 544 and east of Commerce Street SECTION 10: The city attorney is authorized to commence an action for appropriate legal or equitable relief in a court of competent jurisdiction in addition to the penalty mentioned in subsection (f) above. Such additional relief may include a civil fine of up to one thousand dollars ($1,000.00) per day for violations of section 42-138, and all other damages, costs, remedies and legal processes to which the City may be entitled. SECTION 11: Penalty. Any person, firm, corporation or entity violating or refusing to comply with any provision of this Ordinance, as it exists or may be amended, shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be fined in an amount not exceeding two thousand dollars ($2,000.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. The penal provisions imposed under this Ordinance shall not preclude Wylie from filing suit to enjoin the violation. Wylie retains all legal rights and remedies available to it under local, state and federal law. SECTION 12: Savings/Repealing. The Code of Ordinances shall remain in full force and effect, save and except as amended by this or any other Ordinance. All provisions of any ordinance in conflict with this Ordinance are hereby repealed to the extent they are in conflict, but such repeal shall not abate any pending prosecution for violation of the repealed ordinance, nor shall the repeal prevent a prosecution from being commenced for any violation if occurring prior to the repeal of the ordinance. Any remaining portions of said ordinances shall remain in full force and effect. SECTION 13: Severability. Should any section, subsection, sentence, clause or phrase of this Ordinance be declared unconstitutional and/or invalid by a court of competent jurisdiction, it is expressly provided that any and all remaining portions of this Ordinance shall remain in full force and effect. The City Council hereby declares that it would have passed this Ordinance, and each section, subsection, clause or phrase thereof, regardless of whether any one or more sections, subsections, sentences, clauses or phrases is declared unconstitutional and/or invalid. The purpose of an MSD Designation is to prevent groundwater from being used for potable purposes. The MSD is also a tool used in conjunction with Voluntary Cleanup Program (VCP) to address environmental contamination. The site includes multiple parcels. • 900 W Kirby Minutes February 16,2017 Wylie MSD Public Meeting Page 1 of 2 • 908 W Kirby • 605 Commerce An investigation on the soil and groundwater of a piece of vacant land north of 605 Commerce Street initiated the further search for contaminated soil and groundwater. The property that contained a dry cleaning company, which operated from 1987 to 2013, is the source of the contamination. The local geology consists of layers of impervious bedrock with intermittent minor water-bearing units to a depth of about 2500 feet which is basically half-mile below ground surface. The chemical that is most prevalent is Tetrachloroethylene, a common dry cleaning solvent, which is present in groundwater above ingestion standards. The flow of the groundwater is west to east and has migrated to the parcels located at 900 West Kirby and 908 West Kirby. These sites meet the City of Wylie and State criteria for MSD. As of 2016, 330 MSD sites have been approved within State of Texas and over 45 municipalities have adopted an MSD Ordinance. An MSD will address contamination in the groundwater; and all other exposures and receptors are addressed through the VCP in Austin. Once property is cleaned up and contaminated chemicals are removed, re-development is promoted. The timeline is approximately 60 to 90 days. The MSD is not only a designation from the city, but also included in the deed restrictions. There are no negative impacts to offsite properties. Discussion The Curfew Ordinance requires Public Hearing and review every three years in order to abolish, modify, or continue the ordinance. This Ordinance gives officers a tool to reduce juvenile crime by specifying times and locations where unsupervised juveniles under the age of 17 can be. Statistics have shown that when unsupervised juveniles gather late at night they are at higher risk of becoming a victim of crime or becoming involved in criminal activity. In 2015 Wylie officers issued 14 citations for curfew violations. From January 1, 2016 to December 31, 2016, officers responded to 6 calls in regards to curfew violations and issued 15 curfew citations. Since the last ordinance review in 2013 Wylie officers have responded to 14 calls in regards to curfew violations and issued 48 citations. Staff is recommending approval of the Curfew Ordinance. Page 1 of 1 ORDINANCE NO. 2017-09 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS, ESTABLISHING A CURFEW FOR MINORS IN THE CITY OF WYLIE; CREATING OFFENSES FOR MINORS,PARENTS,GUARDIANS OF MINORS AND BUSINESS ESTABLISHMENTS FOR VIOLATING CURFEW REGULATIONS; DEFINING TERMS AND PROVIDING FOR DEFENSES; PROVIDING FOR ENFORCEMENT; PROVIDING FOR WAIVER OF JURISDICTION BY THE COURT WHEN REQUIRED UNDER THE TEXAS FAMILY CODE; PROVIDING FOR REVIEW OF THIS ORDINANCE;PROVIDING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE; PROVIDING FOR REPEALING, SAVINGS AND SEVERABILITY CLAUSES;PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE;AND PROVIDING FOR THE PUBLICATION OF THE CAPTION THEREOF. WHEREAS,the City Council of the City of Wylie, Texas ("City Council")has investigated and determined that there is a continued presence of juvenile violence,juvenile gang activity and crime by persons under the age of seventeen (17) in the City of Wylie, Texas ("Wylie"); and WHEREAS,the City Council has further investigated and determined that persons under the age of seventeen (17) are particularly susceptible by their lack of maturity and experience to participate in unlawful and gang-related activities and to be victims of older perpetrators of crime; and WHEREAS,Wylie previously enacted Ordinance No.2005-08("Curfew Ordinance"),under which citations have been issued to minors in violation of the Curfew Ordinance, and such Curfew Ordinance has expired; and WHEREAS, the City Council, on behalf of Wylie and its citizens, has an obligation to provide for the protection of minors from each other and from other persons;for the enforcement of parental control over and responsibility for children;for the protection of the general public; and for the reduction of the incidence of juvenile criminal activities; and WHEREAS, the City Council has further investigated and determined that its goals in enacting this Ordinance include, but are not limited to, the following: (1) reducing the number of juvenile crime victims; (2)reducing injury accidents involving juveniles; (3)reducing the time and resources required to address juvenile crime activities and accidents; (4)providing tools to address gang activity; (5) reducing juvenile peer pressure to stay out late; and (6) assisting parents in the control of their children; and WHEREAS, the City Council has further investigated and determined that it is in the best interests of Wylie and its citizens to re-establish a curfew for those under the age of seventeen(17), as set forth below, which will promote public health, safety and general welfare; help attain the foregoing objectives; and diminish the undesirable impact of such conduct on the citizens of Wylie. Ordinance No.2017-09 Juvenile Curfew Page 1 2100606 NOW THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1: FINDINGS INCORPORATED. The findings set forth above are incorporated into the body of this Ordinance as if fully set forth herein. SECTION 2: DEFINITIONS. 2.1 For the purposes of this Ordinance, when not inconsistent with the context, words used in the present tense include the future tense,words in the plural include the singular,and words in the singular include the plural, and the use of any gender shall be applicable to all genders whenever the sense requires. Words not defined in this Section shall be given their common and ordinary meaning. 2.2 For the purposes of this Ordinance, the following words, terms, phrases and their derivations shall have the meaning given in this Section 2.2: (A) CURFEW HOURS means: (1) 11:00 p.m. on any Sunday, Monday, Tuesday, Wednesday or Thursday until 6:00 a.m. of the following day; and (2) 12:01 a.m. until 6:00 a.m. on any Friday or Saturday. (B) EMERGENCY means an unforeseen combination of circumstances or the resulting state that calls for immediate action. The term includes,but is not limited to, a fire, a natural disaster, an automobile accident or any situation requiring immediate action to prevent serious bodily injury or loss of life. (C) ESTABLISHMENT means any privately-owned place of business operated for a profit to which the public is invited, including but not limited to, any place of amusement or entertainment. (D) GUARDIAN means: (1) a person who, under court order, is the guardian of the person of a minor; or (2) a public or private agency with whom a minor has been placed by a court. (E) MINOR means any person under seventeen (17)years of age. (F) OPERATOR means any individual, firm, association, partnership or corporation operating,managing or conducting any establishment. The term includes the members or partners of an association or partnership and the officers and directors of a corporation. Ordinance No.2017-09 Juvenile Curfew Page 2 2100606 (G) PARENT means a person who is: (1) a natural parent, adoptive parent or step-parent of another person; or (2) at least eighteen (18) years of age and authorized by a parent, guardian, court order, or by the court, or by a court-appointed guardian to have the care and custody of a minor. (H) PUBLIC PLACE means any place to which the public or a substantial group of the public has access and includes,but is not limited to, streets,highways, and the common areas of schools, hospitals, apartment houses, office buildings, transport facilities and shops. (I) REMAIN means to: (1) linger, stay, walk, run, stand, drive or ride; or (2) fail to leave premises when requested to do so by a police officer or the owner, operator or other person in control of the premises. (J) SERIOUS BODILY INJURY means bodily injury that creates a substantial risk of death or that causes death, serious permanent disfigurement or protracted loss or impairment of the function of any bodily member or organ. SECTION 3: OFFENSES. 3.1 A minor commits an offense if he remains in any public place or on the premises of any establishment within Wylie during curfew hours. 3.2 A parent or guardian of a minor commits an offense if he knowingly permits or by insufficient control allows the minor to remain in any public place or on the premises of any establishment within Wylie during curfew hours. 3.3 The owner, operator or any employee of an establishment commits an offense if he knowingly allows a minor to remain upon the premises of the establishment during curfew hours. SECTION 4: DEFENSES. 4.1 It is a defense to prosecution under Section 3 that the minor was: (A) accompanied by the minor's parent or guardian; (B) on an errand at the direction of the minor's parent or guardian, without any detour or stop; (C) in a motor vehicle involved in interstate travel; Ordinance No.2017-09 Juvenile Curfew Page 3 2100606 (D) engaged in an employment activity, or going to or returning home from an employment activity, without any detour or stop; (E) involved in an emergency; (F) on the sidewalk abutting the minor's residence or abutting the residence of a next-door neighbor if the neighbor did not complain to the police depai anent about the minor's presence; (G) attending an official school, religious, or other recreational activity supervised by adults and sponsored by Wylie,the Wylie Independent School District,a civic organization or another similar entity that takes responsibility for the minor or going to or returning home from,without any detour or stop, an official school,religious or other recreational activity supervised by adults and sponsored by Wylie, a civic organization or another similar entity that takes responsibility for the minor; (H) exercising First Amendment rights protected by the United States Constitution, such as the free exercise of religion, freedom of speech or the right of assembly; or (I) married or had been married or had disabilities of minority removed in accordance with Chapter 31 of the Texas Family Code, as amended. 4.2 It is a defense to prosecution under Subsection 3.3 that the owner, operator or employee of an establishment promptly notified the police department that a minor was present on the premises of the establishment during curfew hours and refused to leave. SECTION 5: ENFORCEMENT. Before taking any enforcement action under this Section,a peace officer shall ask the apparent offender's age and reason for being in the public place. The officer shall not issue a citation or make an arrest under this Section unless the officer reasonably believes that an offense has occurred and that, based on any response and other circumstances, no defense in Section 4 is present. SECTION 6: PENALTIES. 6.1 Any person violating this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction therefore, shall be fined a sum not exceeding Five Hundred and No/100 Dollars ($500.00). Each and every day that such violation continues shall be considered a separate offense. Wylie retains all legal rights and remedies available to it pursuant to local, state and federal law. 6.2 When required by Section 51.08 of the Texas Family Code, as amended, the court shall waive original jurisdiction over a person who violates Section 3 and shall refer the person to the appropriate court. SECTION 7: REVIFW OF ORDINANCE. Before the third anniversary of the date of the adoption of this Ordinance, and every third year thereafter, the City Council shall: Ordinance No.2017-09 Juvenile Curfew Page 4 2100606 (A) review the effects of the Ordinance on the community and on problems the Ordinance was intended to remedy; (B) conduct at least two public hearings on the need to continue the Ordinance; and (C) abolish, continue or modify the Ordinance. The failure of the City Council to act in accordance with this Section shall cause this Ordinance to expire without further action by the City Council. SECTION 8: SAVINGS/REPEALING CLAUSE. All provisions of any ordinance in conflict with this Ordinance are hereby repealed to the extent they are in conflict; but such repeal shall not abate any pending prosecution for violation of the repealed ordinance,nor shall the repeal prevent a prosecution from being commenced for any violation if occurring prior to the repeal of the ordinance. Any remaining portions of said ordinances shall remain in full force and effect. SECTION 9: SEVERABILITY. Should any section,subsection,sentence,clause or phrase of this Ordinance be declared unconstitutional or invalid by a court of competent jurisdiction, it is expressly provided that any and all remaining portions of this Ordinance shall remain in full force and effect. The City Council hereby declares that it would have passed this Ordinance, and each section, subsection, clause or phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional or invalid. SECTION 10: EFFECTIVE DATE. This Ordinance shall become effective from and after its adoption and publication as required by law.
