08-22-2017 (City Council) Minutes 111 Wylie City Council CITY OF WYLIE Minutes Regular Meeting Tuesday, August 22, 2017—6:00 p.m. Wylie Municipal Complex — Council Chambers 300 Country Club Road, Bldg. 100 Wylie, TX 75098 CALL TO ORDER Announce the presence of a Quorum. Mayor Eric Hogue called the meeting to order at 6:00 p.m. City Secretary Carole Ehrlich took roll call with the following City Council members present: Mayor pro tern Keith Stephens, Councilman Jeff Forrester, Councilwoman Diane Culver, Councilwoman Candy Arrington, Councilman David Dahl, and Councilman Timothy Wallis. Staff present were: City Manager, Mindy Manson; City Engineer, Tim Porter; Human Resource Director, Lety Yanez; Police Chief, Anthony Henderson; Fire Chief, Brent Parker; WEDC Executive Director, Sam Satterwhite; Building Official, Bret McCullough; Public Information Officer, Craig Kelly; City Secretary, Carole Ehrlich, and various support staff. INVOCATION & PLEDGE OF ALLEGIANCE Mayor pro tern Stephens gave the invocation and Finance Director Bantz led the Pledge of Allegiance. CITIZENS COMMENTS ON NON-AGENDA ITEMS Residents may address Council regarding an item that is not listed on the Agenda. Residents must fill out a non- agenda form prior to the meeting in order to speak Council requests that comments be limited to three (3)minutes. In addition, Council is not allowed to converse, deliberate or take action on any matter presented during citizen participation. Resident David Hoppe spoke with concerns with the widening of Hwy 2514. Traffic, speed, and large trucks were some of his concerns. Resident Sylvia Lansing addressed Council regarding the great experience she had with the 111 Wylie Building Inspection staff, specifically Kim Mayberry, Chris Montgomery, and Building Official Bret McCullough. She stated that her family was looked after during the April 2016 hail storm and again when they built an addition on their home. There will not be separate discussion of these items. If discussion is desired, that item will be removed from the Consent Agenda and will be considered separately. A. Consider, and act upon, approval of the Minutes of August 8, 2017 Regular Meeting of the Wylie City Council. (C. Ehrlich, City Secretary) B. Consider, and act upon, approval of a Preliminary Plat for Woodbridge Townhomes, establishing 370 single family residential lots and 13 open space lots on 51.916 acres, generally located on the southwest corner of Hooper Road and Hensley Road. Consider, and act upon, approval of a Final Plat for Lewis Ranch Addition, creating 97 single family residential lots and 1 open space lotl on 29.590 acres, generally located at the southeast corner of North State Highway 78 and Wylie East Drive. Consider, and act upon,approval of a Preliminary Plat for Bozman Farms Ph 7,establishing 195 single family residential lots,3 open space lots,on 77.3695 acres, generally located south of Stone Road and between FM 544 and Beaver Creek Road. Consider, and act upon, proposals for employee group health insurance, including major medical, dental, term life, accidental death/dismemberment, long-term disability, and prescription drug coverage. Satterwhite, WEDC Director) Council Action A motion was made by Councilwoman Culver, seconded by Councilman Dahl to approve the Consent Agenda as presented. A vote was taken and the motion passed 7-0. REGULAR AGENDA 1. Hold a Public Hearing and consider, and act upon, approval of a Replat for Railroad Addition Lot 15R, Block 30; being a Residential Replat of Lot 15 and 16, Block 30 of Railroad Addition, located at 208 South 3rd Street creating one residential lot. (R. 011ie, Development Services Director) Minutes August 22, 2017 Wylie City Council Page 2 Staff Comments Planner Jasen Haskin addressed Council stating that the applicant is requesting a residential Replat to establish one residential lot of 0.402 aces (17,515sf). The lots are zoned Single Family 10/24. The purpose of the Replat is to combine the two lots and allow for the existing owner of the two lots to place an accessory structure on the combined lots. Mayor Hogue voiced some concern with the size of the accessory structure and seeing it from the roadway. Haskin assured the Mayor that the building would be within the Comprehensive Zoning Ordinance and the setback required would deter anyone from seeing it from the roadway. Public Hearing Mayor Hogue opened the public hearing on Item#1 at 6:18 p.m. asking anyone present wishing to address Council to come forward. There were no citizens wishing to address Council. Mayor Hogue closed the public hearing at 6:19 p.m. Council Action A motion was made by Councilman Dahl, seconded by Councilwoman Culver to approve a Replat for Railroad Addition Lot 15R, Block 30; being a Residential Replat of Lot 15 and 16, Block 30 of Railroad Addition, located at 208 South 3rd Street creating one residential lot. A vote was taken and the motion passed 7-0. 2. Hold a Public Hearing on the fiscal year 2017-2018 Proposed Budget and provide all interested persons an opportunity to be heard, either for or against any item in the proposed budget; and set and announce the date, time and place of the meeting at which Council will vote on the final proposed budget. Staff Comments Finance Director Bantz addressed Council stating that a Public Hearing is required to be held on the fiscal year 2017-2018 Proposed Budget. In addition the date, time, and place that the vote will be taken on the final budget must also be scheduled. Any changes made to the proposed tax rate or Proposed Budget could affect required publications and steps in the tax rate and budget approval process. Public Hearing Mayor Hogue opened the public hearing on Item#2 Budget at 6:22 p.m. asking anyone present wishing to address Council to come forward. There were no citizens wishing to address Council. Mayor Hogue closed the public hearing at 6:23 p.m. Council Action A motion was made by Councilman Forrester, seconded by Mayor pro tern Stephens to set September 12, 2017 at 6:00 p.m. in the Council Chambers of the Wylie Municipal Complex, 300 Minutes August 22, 2017 Wylie City Council Page 3 Country Club Road, Wylie, TX as the date, time and place at which Council will vote on the final budget. A vote was taken and the motion passed 7-0. Tabled from 07-11-2017 Remove from table and consider Council Action A motion was made by Councilwoman Culver, seconded by Councilman Dahl to remove Item #3 from the table and consider. A vote was taken and the motion passed 7-0. 3. Consider, and act upon,Resolution No. 2017-13 (R) of the City Council of the City of Wylie, Texas,supporting the proposed FM 2514 roadway improvements,from north of Drain Drive to Brown Street, in the City of Wylie; and providing for an effective date. (T. Porter, City Engineer) Staff Comments City Engineer Tim Porter addressed Council stating that TxDOT is requesting a resolution of support for the subject project from City Council in order to emphasize the City's willingness to partner on the project as well as to assist in processing Finding of No Significant Impact (FONSI) and other possible documentation. The scope of the project will improve the existing roadway from 2-lane asphalt to a 4- lane concrete street,with associated drainage and utilities. Porter explained that TxDOT is currently working on Environmental Clearance and right-of-way document preparation. A public hearing is now expected in January 2018, with a construction letting currently scheduled for the year 2021. Due to the lengthened schedule of the public hearing and previous tabling of this item by the City Council to a date following the public hearing, TxDOT has agreed to withdraw this item until a date that better aligns with City Council consideration. Council Discussion Mayor pro tern Stephens asked City Engineer Porter if questions posed by the Council had been answered by TxDOT. Porter replied that he had not heard back from TxDOT on any of the questions posed by the Wylie City Council. Councilwoman Culver asked if the public hearing was postponed until January 2018 is TxDOT proceeding with construction. Porter replied that Council is considering a resolution of support to TxDOT however it is not required before construction or design starts. The City may have some impact on small changes but the process will continue with or without a resolution from Wylie. The support of a resolution helps them during the environmental process and to move the process along quicker. Culver asked if the public hearings are required prior to construction. Porter replied that he believed they were. Councilwoman Culver asked Engineer Porter to find out what the City can do if they are not agreeable with the widening of Ballard. Porter replied that he would. Mayor pro tern Stephens asked the City Engineer to insure that all construction was done properly so none would be required at the end of construction for the City to fund. Mayor Hogue commented that if a citizen had concerns regarding the widening of Ballard they should look for the notices for TxDOT public hearings and speak their concerns at that time. Minutes August 22, 2017 Wylie City Council Page 4 Council Action A motion was made by Councilman Forrester, seconded by Councilwoman Arrington to accept the withdrawal from TxDOT and take no action on Resolution No. 2017-13(R) of the City Council of the City of Wylie, Texas, supporting the proposed FM 2514 roadway improvements, from north of Drain Drive to Brown Street, in the City of Wylie; and providing for an effective date. A vote was taken and the motion passed 7-0.
