Consider, and act upon, approving the property tax increase reflected in the budget. (L. Bantz, Finance Director) Executive Summary The tax rate used in preparing the FY 2017-2018 Proposed Budget is $0.781 per $100 of assessed valuation. This tax rate is below the effective tax rate of$.781014 and represents a decrease of$0.0679 (6.79 cents) from the tax rate in FY 2016-2017. This agenda item is required by state law because there will be an increase in total tax revenue the City receives due to new property that was added to the tax roll and an increase in the total property assessed valuation. Section 102.007 of the Texas Local Government Code and Texas HB 3195 require the governing body to hold a separate vote to ratify this increase in property tax revenue that is reflected in the budget. 2. Consider, and act upon, Ordinance No. 2017-26 adopting a budget and appropriating resources for Fiscal Year 2017-2018, beginning October 1, 2017, and ending September 30, 2018. (L. Bantz, Finance Director) Executive Summary The tax rate being proposed for Fiscal Year 2017-2018 is $0.781 per$100 of assessed valuation which is less than the effective tax rate of$.781014. 3. Consider, and act upon, Ordinance No. 2017-27 fixing the tax rate/levy for Tax Year 2017 and Budget Year FY 2017-2018 at $0.781 per $100 of assessed valuation. (L. Bantz, Finance Director) Executive Summary The tax rate needed to fund the FY 2017-2018 budget is $0.781 per $100 of assessed valuation. The tax rate is broken down with$0.580307 being used for operations and maintenance and$0.200693 being used to fund the General Debt Service Fund. This tax ordinance will generate levies of$21,917,097 for the General Fund and$7,579,813 for the I& S Fund. The adopted Fiscal Year 2017-2018 budget requires the support of this ordinance for funding. This tax rate represents a decrease of 6.79 cents from the 2016-2017 tax rate. Mayor Eric Hogue called the meeting to order at 6:00 p.m. City Secretary Carole Ehrlich took roll call with the following City Council members present: Mayor pro tem Keith Stephens, Councilman Jeff Forrester, Councilwoman Diane Culver, Councilwoman Candy Arrington, Councilman David Dahl, and Councilman Timothy Wallis. Resident David Hoppe spoke with concerns with the widening of Hwy 2514. Traffic, speed, and large trucks were some of his concerns. Resident Sylvia Lansing addressed Council regarding the great experience she had with the Wylie Building Inspection staff, specifically Kim Mayberry, Chris Montgomery, and Building Official Bret McCullough. She stated that her family was looked after during the April 2016 hail storm and again when they built an addition on their home. Hold a Public Hearing and consider, and act upon, approval of a Replat for Railroad Addition Lot 15R, Block 30; being a Residential Replat of Lot 15 and 16, Block 30 of Railroad Addition, located at 208 South 3rd Street creating one residential lot. (R. 011ie, Development Services Director) Minutes August 22, 2017 Wylie City Council Page 2 Staff Comments Planner Jasen Haskin addressed Council stating that the applicant is requesting a residential Replat to establish one residential lot of 0.402 aces (17,515sf). The lots are zoned Single Family 10/24. The purpose of the Replat is to combine the two lots and allow for the existing owner of the two lots to place an accessory structure on the combined lots. Mayor Hogue voiced some concern with the size of the accessory structure and seeing it from the roadway. Haskin assured the Mayor that the building would be within the Comprehensive Zoning Ordinance and the setback required would deter anyone from seeing it from the roadway. Public Hearing Mayor Hogue opened the public hearing on Item #1 at 6:18 p.m. asking anyone present wishing to address Council to come forward. There were no citizens wishing to address Council. Mayor Hogue closed the public hearing at 6:19 p.m. Council Action A motion was made by Councilman Dahl, seconded by Councilwoman Culver to approve a Replat for Railroad Addition Lot 15R, Block 30; being a Residential Replat of Lot 15 and 16, Block 30 of Railroad Addition, located at 208 South 3rd Street creating one residential lot. A vote was taken and the motion passed 7-0. 2. Hold a Public Hearing on the fiscal year 2017-2018 Proposed Budget and provide all interested persons an opportunity to be heard, either for or against any item in the proposed budget; and set and announce the date, time and place of the meeting at which Council will vote on the final proposed budget. Staff Comments Finance Director Bantz addressed Council stating that a Public Hearing is required to be held on the fiscal year 2017-2018 Proposed Budget. In addition the date, time, and place that the vote will be taken on the final budget must also be scheduled. Any changes made to the proposed tax rate or Proposed Budget could affect required publications and steps in the tax rate and budget approval process. Public Hearing Mayor Hogue opened the public hearing on Item #2 Budget at 6:22 p.m. asking anyone present wishing to address Council to come forward. There were no citizens wishing to address Council. Consider, and act upon, Resolution No. 2017-13 (R) of the City Council of the City of Wylie, Texas, supporting the proposed FM 2514 roadway improvements,from north of Drain Drive to Brown Street, in the City of Wylie; and providing for an effective date. (T. Porter, City Engineer) Staff Comments City Engineer Tim Porter addressed Council stating that TxDOT is requesting a resolution of support for the subject project from City Council in order to emphasize the City's willingness to partner on the project as well as to assist in processing Finding of No Significant Impact (FONSI) and other possible documentation. The scope of the project will improve the existing roadway from 2-lane asphalt to a 4- lane concrete street, with associated drainage and utilities. Porter explained that TxDOT is currently working on Environmental Clearance and right-of-way document preparation. A public hearing is now expected in January 2018, with a construction letting currently scheduled for the year 2021. Due to the lengthened schedule of the public hearing and previous tabling of this item by the City Council to a date following the public hearing, TxDOT has agreed to withdraw this item until a date that better aligns with City Council consideration. Council Discussion Mayor pro tem Stephens asked City Engineer Porter if questions posed by the Council had been answered by TxDOT. Porter replied that he had not heard back from TxDOT on any of the questions posed by the Wylie City Council. Councilwoman Culver asked if the public hearing was postponed until January 2018 is TxDOT proceeding with construction. Porter replied that Council is considering a resolution of support to TxDOT however it is not required before construction or design starts. The City may have some impact on small changes but the process will continue with or without a resolution from Wylie. The support of a resolution helps them during the environmental process and to move the process along quicker. Culver asked if the public hearings are required prior to construction. Porter replied that he believed they were. Councilwoman Culver asked Engineer Porter to find out what the City can do if they are not agreeable with the widening of Ballard. Porter replied that he would. Mayor pro tem Stephens asked the City Engineer to insure that all construction was done properly so none would be required at the end of construction for the City to fund. Mayor Hogue commented that if a citizen had concerns regarding the widening of Ballard they should look for the notices for TxDOT public hearings and speak their concerns at that time. The study incorporates the water and sewer capital improvements plan (CIP), outstanding debt service, the proposed wholesale water rate increases from the North Texas Municipal Water District, the transfer to the general fund, and future utility fund staffing needs. The study recommends a water rate increase of 9%, and a wastewater rate increase of 7.5% for all rate types through FY 2021. A work session was also held at the August 8"' Council meeting to discuss the proposed rate increase by Community Waste Disposal (CWD) for solid waste and recycling services. The proposed residential rate of $12.18 is a 2.44% increase and includes monthly trash and recycling service, bulk pickup and two Extreme Green events per year. CWD has not requested a rate increase since their contract was last renewed in September 2013. Staff also recommends an increase to the afterhours inspection fee for the Fire Department. Any person, firm, corporation or entity that violates this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined a sum not exceeding two thousand dollars ($2,000.00) if the violation relates to the public health and sanitation, otherwise the fine shall be a sum not exceeding five hundred dollars ($500.00). Wylie retains all legal rights and remedies available to it pursuant to local, state and federal law. SECTION 4: Savings/Repealing. All provisions of the Code of Ordinances shall remain in full force and effect, save and except as amended by this or any other ordinance. All provisions of any ordinance in conflict with this Ordinance are hereby repealed to the extent they are in conflict; but such repeal shall not abate any pending prosecution for violation of the repealed ordinance, nor shall the repeal prevent a prosecution from being commenced for any violation if occurring prior to Ordinance No.2017-24 Amendment to the Wylie Comprehensive Fee Schedule Page 7 2093673 the repeal of the ordinance. Any remaining portions of said ordinances shall remain in full force and effect. SECTION 5: Severability. Discussion A multi jurisdictional planning effort has not taken place in Collin County to determine the role of public transportation in the future movement of people within the County. The proposed Resolution is to support the development of a comprehensive public transportation plan for Collin County. The Resolution also supports seeking funding from the Metropolitan Planning Organization (MPO)*, the Texas Department of Transportation, the Federal Transit Administration and private companies to pay the cost of the development of a strategic public transportation plan. As a part of Wylie's program with DART for the provision of transit services for senior citizens and persons with disabilities, Wylie agreed to participate in public transportation planning for Collin County. This Resolution has been approved by the City of Allen and is under consideration by the cities of Frisco, Richardson, Plano and McKinney. *The MPO is a local decision-making body that is responsible for overseeing the metropolitan transportation planning process. An MPO is required for each urban area with a population of more than 50,000 people. The North Central Texas Council of Governments serves as this region's MPO. The Regional Transportation Council (RTC)is the policy-making body for the MPO. Discussion House Bill 62 was approved during the recent legislative session and adds Section 545.4251 to the Texas Transportation Code making it illegal to use a portable wireless communication device to read, write, or send an electronic message while operating a motor vehicle unless the vehicle is stopped. The law went into effect September 1st. This law preempts any ordinance that prohibits the use of a portable wireless communication device by the operator of a motor vehicle to read, write, or send electronic messages. Wylie previously adopted an ordinance that restricts the use of wireless telecommunication services in a school zone unless it is a hands free device. A summary of the law is provided below. Summary HB 62 adds Section 545.4251 to the Texas Transportation Code and makes it illegal to use a portable wireless communication device' to read, write, or send an electronic message2 while operating a motor vehicle unless the vehicle is stopped. However, the legislature also included a number of affirmative defenses if the person was using a portable wireless communication device: 1. With a hands-free device3; 2. To navigate using a GPS or navigation system; 3. To report illegal activity, summon emergency help, or enter information into a software application that provides information relating to traffic and road conditions to users of the applicant; 4. To read an electronic message that the person reasonably believed concerned an emergency; 5. That was permanently affixed to the vehicle to relay information in the course of the operator's occupational duties and a dispatcher or a digital network or software application service; or, 6. To activate a function that plays music. Exceptions: The prohibition does not apply to an operator of an authorized emergency vehicle or law enforcement vehicle using a portable wireless device while acting in an official capacity, or 1 A portable wireless communication device means a commercial mobile service. 2 Electronic message means data that is read from or entered into a wireless communication device for the purpose of communicating. Fines: The fines are limited to a range of $25 to $99 for the first offense. If the defendant has been previously convicted for any violation under Section 545.4521, the minimum fine is $100 and maximum is $200. It is a Class A misdemeanor with a $4000 fine and confinement in jail for one year if the offense resulted in serious bodily injury or death. Preemption: This law preempts any ordinance that prohibits the use of a portable wireless communication device by the operator of a motor vehicle to read, write, or send electronic messages. Wylie restricts the use of wireless telecommunication services in a school zone unless it is a hands free device.4 The state law preemption against local regulations only applies to electronic messages; therefore, the provisions in Wylie's ordinance that relate to text messages should be removed. A copy of a draft ordinance that includes those changes is attached for your review. If Wylie does not adopt the attached ordinance prior to September 1, please instruct the Police Department to implement the new law and not enforce the existing ordinance as it relates to text messages for any violations that occur after August 31st. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1: Findings Incorporated. The findings set forth above are incorporated into the body of this Ordinance as if fully set forth herein. SECTION 2: Amendment to Chapter 110 (Traffic and Vehicles), Article III (Operation of Vehicles), Section 110-115 (Use of hand-held mobile telephones prohibited in school zones) of the Wylie Code of Ordinances. Section 110-115 (Use of hand-held mobile telephones prohibited in school zones) of the Wylie Code of Ordinances is hereby amended as follows': "ARTICLE III OPERTION OF VEHICLES Sec. 110-115. Use of hand-held mobile telephones prohibited in school zones. (a) The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning: Engaging in a call shall mean talking into, dialing, or listening on a hand- held mobile telephone. Ordinance No.2017-25 Page 1 of 4 Amending Sec. 110-115(Use of hand-held mobile telephones prohibited in school zones) 2249324 Hands free mobile telephone shall mean a mobile telephone that has an internal feature or function or that is equipped with an attachment or addition, whether or not permanently part of such mobile telephone, by which a user engages in a call without the use of either hand (or prosthetic device or aid, in the case of a physically disabled person) whether or not the use of the hand (or prosthetic device)is necessary to activate, deactivate, or initiate a function of such telephone. Hand-held mobile telephone shall mean a mobile telephone with which a user engages in a call using at least one hand (or prosthetic device or aid, in the case of a physically disabled person). Mobile communication device shall mean a text-messaging device or other electronic, two-way communication device that is designed to receive and transmit voice communication, text communication, or both. The term includes a mobile telephone and a personal digital assistant (PDA). Mobile telephone shall mean the device used to access a wireless telecommunications service. School zone shall mean those school zones as designated in section 110- 133 of this chapter. Text message shall mean a two way communication (whether real time or asynchronous) in which data (composed in whole or in part of text, numbers, o� o o � o 0 0 and transmitted through either a short message service (SMS) or a computer network. The term does not include a communication transmitted through a global positioning or navigation system. Wireless 4elecommunication service shall mean two-way real time voice or other data telecommunications service that is interconnected to a public switched telephone network and commonly referred to as cellular service or personal communication service. (b) It shall be unlawful for any person to use a hand-held mobile telephone to engage in a call or use a mobile communication device to send, read, or write a text message, while operating a moving motor vehicle in school zone: (1) On an official school day; (2) During the hours when the school zone is in effect. See Section 110-113 for the list of times in which school zones are in effect; and Ordinance No.2017-25 Page 2 of 4 Amending Sec. 110-115(Use of hand-held mobile telephones prohibited in school zones) 2249324 (3) When signs stating, "NO TEXT MESSAGING OR HAND-HELD CELL PHONE USE IN ACTIVE SCHOOL ZONE", or similar language is conspicuously posted at each entrance to the school zone. (c) An operator of a motor vehicle who holds a mobile telephone to or in the immediate proximity of his or her ear while the vehicle is in motion is presumed to be engaging in a call under this section. Immediate proximity is any distance that permits the user of a mobile telephone to hear telecommunications transmitted over the telephone and does not require physical contact with the user's ear. (d) It is a defense to prosecution under this section if a person is: (1) Using the mobile telephone or mobile communication device to report illegal activity to a law enforcement agency; to communicate with an emergency response operator, a fire department, a law enforcement agency, a hospital, a physician's office, or a health clinic regarding a medical or other emergency situation; or to prevent injury to a person or property; or (2) Operating an authorized emergency vehicle and using the mobile telephone or mobile communication device in the course and scope of the person's official duties; or (3) Using a hands-free mobile telephone in a hands-free manner. (e) Any person violating this section shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined a sum not exceeding $500.00. An offence under this section is not a moving violation and may not be made a part of a person's driving record or insurance record. (Ord. No. 2008-19, § 2, 4-8-2008; Ord. No. 2009-06, § 2, 2-10-2009)" SECTION 3: Penalty. Any person, firm, corporation or entity violating or refusing to comply with any provision of this Ordinance, as it exists or may be amended, shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be fined in an amount not exceeding two thousand dollars ($2,000.00) for each offense if the offense relates to public health and sanitation, otherwise the fine shall be in an amount not exceeding five hundred dollars ($500.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. The penal provisions imposed under this Ordinance shall not preclude Wylie from filing suit to enjoin the violation. Wylie retains all legal rights and remedies available to it under local, state and federal law. SECTION 4: Severability. Should any section, subsection, sentence, clause or phrase of this Ordinance be declared unconstitutional or invalid by a court of competent jurisdiction, it is Ordinance No.2017-25 Page 3 of 4 Amending Sec. 110-115(Use of hand-held mobile telephones prohibited in school zones) 2249324 expressly provided that any and all remaining portions of this Ordinance shall remain in full force and effect. The City Council hereby declares that it would have passed this Ordinance, and each section, subsection, clause or phrase thereof, regardless of whether any one or more sections, subsections, sentences, clauses or phrases is declared unconstitutional and/or invalid. SECTION 5: Savings/Repealing. All provisions of the Code of Ordinances shall remain in full force and effect, save and except as amended by this or any other ordinance. All provisions of any ordinance in conflict with this Ordinance are hereby repealed to the extent they are in conflict, but such repeal shall not abate any pending prosecution for violation of the repealed ordinance, nor shall the repeal prevent a prosecution from being commenced for any violation if occurring prior to the repeal of the ordinance. Any remaining portions of such ordinances shall remain in full force and effect. SECTION 6: Effective Date. This Ordinance shall become effective from and after its adoption and publication as required by the City Charter and by law. The City shall have available all the rights and remedies provided by law for the enforcement of the collection of taxes levied under this ordinance. Section 4. That the tax roll presented to the City Council, together with any supplements thereto, be and same are hereby accepted and approved. Section 5. Should any paragraph, sentence, sub-division, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal, or invalid, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof, other than the part or parts as declared to be invalid, illegal, or unconstitutional. Section 6. This ordinance shall be in full force and effect from and after its adoption by the City Council and publication of its caption as the law and the City Charter provide in such cases. That all other ordinances and code provisions in conflict herewith are hereby repealed to the extent of any such conflict or inconsistency and all other provisions of the Wylie City Code not in conflict herewith shall remain in full force and effect.
