08-31-2004 (City Council) Minutes MINUTES SPECIAL CALLED MEETING Wylie City Council Tuesday, August 31, 2004—6:00 p.m. Wylie Municipal Complex—Council Chambers 2000 State Highway 78 North CALL TO ORDER Mayor John Mondy called the meeting to order at 6:00 p.m. Council Members present were: Mayor Pro Tem Eric Hogue, Councilwoman Reta Allen, Councilman Chris Trout, Councilman Earl Newsom, Councilman Merrill Young,and Councilman J.C.Worley. Staffs present were: City Manager, Mark B. Roath; Assistant City Manager, Mindy Manson; City Engineer, Chris Holsted; Interim Finance Director,Ron Hutchison;Planning&Zoning Director,Claude Thompson; Fire Chief Shan English; Chief of Police, Jeff Butters; Library Director, Mignon Morse; Human Resource Director, Lynn Fagerstrom; Community Services Director, Mike Sferra; Public Information Officer,Mark Witter,and City Secretary,Carole Ehrlich. INVOCATION&PLEDGE OF ALLEGIANCE Mayor Pro Tem Eric Hogue gave the invocation and Councilman Merrill Young led the Pledge of Allegiance. CITIZENS PARTICIPATION There were no citizens present to address council. INDIVIDUAL CONSIDERATION Public Hearint=_s 1. Hold the second of two Public Hearings for the annexation of a 185.1449 acre tract of land out of the E.M. Price Survey, Abstract No. 725, the D. W. Williams Survey, Abstract No. 980, the Nathaniel Atterberry Survey, Abstract No. 1099, and the William Sutton Survey, Abstract No. 860, Collin County, Texas and the E. M. Price Survey, Abstract No. 1114, Dallas County, Texas, and generally located at the northwest corner of Vinson Road and FM 544. Staff Comments Assistant City Manager Mindy Manson addressed council stating that this was the second of two public hearings required for this annexation. The annexation is at the request of the property owner. A zone change request is being processed concurrently with the annexation.This property was previously before Council in May 2004 for annexation and was withdrawn at the request of the property owner.Before a municipality may begin annexation proceedings,the governing body of the municipality must conduct two (2) public hearings at which persons interested in the annexation are given the opportunity to be heard. In compliance with state law,staff has prepared the public hearing schedule with the notice being published August 11,2004;first public hearing August 24,2004;second public hearing August 31,2004;and adoption of the proposed ordinance September 28, 2004. Hold the second of two Public Hearings for the annexation of a 66.194 acre tract out of the Francisco De La Pina Survey, Abstract #688, Collin County, Texas and generally located west of Stone Road,east of Kreymer. Hold a Public Hearing on the proposed tax rate for fiscal year 2004-2005 and provide taxpayers an opportunity to express their views on the tax rate. At the end of the hearing, the City Council must set and announce the date,time and place of the meeting at which it will vote on the final proposed tax rate. Staff Comments Acting Finance Director Ron Hutchison addressed council stating that the tax rate for fiscal year 2004-2005 is proposed to decrease$0.01 per$100 assessed valuation from$0.705 to$0.695. This will be the fourth year in a row that the tax rate has decreased.The combined decrease for the four-year period is$0.03 per$100 assessed valuation. A rapid increase in our total assessed taxable valuation has made this decrease possible. In accordance with the"Truth in Taxation" laws of the State of Texas, on August 10, 2004; the City Council took a roll call vote on the proposed tax rate of$0.695 and scheduled a public hearing on the tax rate for August 31,2004. The results of the record vote on the proposed tax rate and the notice of the public hearing were published in the McKinney Courier-Gazette on August 23,2004,and the Wylie News on August 25,2004. This public hearing has been advertised in compliance with the publication requirements set forth in the Truth in Taxation Law. Mr. Hutchison explained that the purpose of the public hearing on August 31,2004, is to give the taxpayers an opportunity to express their views on the tax rate. The City Council may not adopt the tax rate at this hearing. Instead, at the end of the hearing, it must set and announce the date,time and place of the meeting at which it will vote on the final proposed tax rate. The vote on the final tax rate for 2004-2005 will be during the regular meeting of September 14,2004. After the August 31, Minutes—August 31,2004 Wylie City Council Page 2 2004, meeting and before the meeting scheduled for the final tax vote, the City Council must publish a second quarter-page notice,"Notice of Vote on Tax Rate."Mr.Hutchison stated that he would be happy to answer any questions. Mayor Mondy closed the public hearing at 6:05 p.m. Council Announcement City Council set the date for the final vote on the 2004-2005 Tax Rate for September 14, 2004 at the Regular City Council Meeting to be held at the Wylie Municipal Complex, 2000 Highway 78 North, Wylie,Texas 75098 at 6:00 p.m. 4. Hold a public hearing on the proposed budget of the City of Wylie, Texas for Fiscal Year 2005,beginning October 1,2004,and ending September 30,2005. Staff Comments Acting Finance Director Ron Hutchison addressed council stating that the tax rate for fiscal year 2004-2005 is proposed to decrease$0.01 per$100 assessed valuation from$0.705 to$0.695. A rapid increase in our total assessed taxable valuation has made this decrease possible.Since fiscal year 2000,the taxable tax base has increased$852 million or 157.1%.For fiscal year 2004-2005,the total assessed value increased by$253,858,535.Of this amount$182,573,710 represented new construction. An increase in the assessed valuation in FY2004 in combination with a decrease in the tax rate will generate an additional $1,729,584 in ad valorem tax revenues. Because no general obligation debt was issued during FY2004 the tax revenues required for debt service will remain constant and the increased revenues will be credited to the General Fund. The FY2005 budget was prepared to maintain the same level of fund balance as in prior years.(15%of total estimated expenditures) Mr.Hutchison explained that two action items will be placed on the September 14,2004,City Council agenda. The first item will be an ordinance to adopt the FY2005 budget. An ordinance to adopt a tax rate of$0.695 per$100 of assessed valuation will be the second item. Council Discussion Mayor Mondy commented that Council had attended several work sessions on this proposed budget and asked if Council Members had any questions before the public hearing was opened.
