Wylie City Council CITY OF WYLIE Minutes Regular Meeting Tuesday,April 24, 2018—6:00 p.m. Wylie Municipal Complex—Council Chambers 300 Country Club Road, Bldg. 100 Wylie, TX 75098 CALL TO ORDER Announce the presence of a Quorum. Mayor Eric Hogue called the meeting to order at 6:00 p.m. City Secretary Stephanie Storm took roll call with the following City Council members present: Mayor pro tern Keith Stephens, Councilman David Dahl, Councilman Jeff Forrester, Councilwoman Candy Arrington, Councilwoman Diane Culver, Councilman Timothy Wallis, and Junior Mayor Lana Gillispie. Staff present included: City Manager Mindy Manson; Assistant City Manager Chris Holsted; Police Chief Anthony Henderson; Fire Chief Brent Parker; Development Services Director Renae 011ie; Public Works Director Tim Porter; Communications Specialist Judy Truesdell; Finance Director Melissa Beard; Parks and Recreation Director Robert Diaz; City Secretary Stephanie Storm, and various support staff. INVOCATION& PLEDGE OF ALLEGIANCE Mayor pro tern Keith Stephens gave the invocation and Junior Mayor Lana Gillispie led the Pledge of Allegiance. PRESENTATIONS • Junior Mayor Lana Gillispie Mayor Hogue introduced Junior Mayor Lana Gillispie, administered the oath of office, and presented a proclamation for"Mayor of the Day." • Proclamation for Animal Control Officer Appreciation Week Mayor Hogue presented a proclamation proclaiming April 8 - April 14, 2018 as Animal Control Officer Week in Wylie, Texas. Staff members from the Animal Shelter were present to accept the proclamation. • Presentation by the Wylie Baseball Softball Association to donate $48,000 to the City of Wylie for park improvements at Founders and Community Parks. Minutes April 24,2018 Wylie City Council Page 1 Lance Wallace, Wylie Youth Baseball Association, presented a donation of$48,000 to contribute to park improvements at Founders and Community Parks. CITIZENS COMMENTS ON NON-AGENDA ITEMS Residents may address Council regarding an item that is not listed on the Agenda. Residents must fill out a non- agenda form prior to the meeting in order to speak. Council requests that comments be limited to three(3)minutes. In addition, Council is not allowed to converse, deliberate, or take action on any matter presented during citizen participation. No citizens were present wishing to address Council during Citizen Comments. CONSENT AGENDA All matters listed under the Consent Agenda are considered to be routine by the City Council and will be enacted by one motion. There will not be separate discussion of these items. If discussion is desired, that item will be removed from the Consent Agenda and will be considered separately. A. Consider, and act upon, approval of the Minutes of April 10, 2018 Regular Meeting of the Wylie City Council. (S. Storm, City Secretary) B. Consider, and act upon, Resolution No. 2018-18(R) authorizing the City Manager to execute an Interlocal Cooperation Agreement with Collin County,Texas, for Road Improvements in accordance with Court Order No. 97-576-08-25. (T. Porter, Public Works Director) C. Consider, and act upon, Resolution No. 2018-19(R) of the City of Wylie, Texas, finding that Oncor Electric Delivery Company LLC's application for approval of a Distribution Cost Recovery Factor pursuant to 16 Tex. Admin. Code §25.243 to increase distribution rates within the City should be denied; finding that the City's reasonable rate case expenses shall be reimbursed by the Company; finding that the meeting at which this resolution is passed is open to the public as required by law; requiring notice of this resolution to the company and legal counsel. Consider, and act upon,Resolution No. 2018-20(R) establishing a temporary moratorium on the acceptance, processing and approval of any application for a city permit or license for use of public right-of-way in the city of Wylie for races, competitions or other special events involving running, walking or cycling; imposing the moratorium to maintain the status quo for a period of one hundred twenty (120) days or until the adoption and implementation of new regulations governing such uses of the public right-of-way; providing for waivers; making various findings and provisions related to the subject; and providing for an effective date. Consider, and place on file, the City of Wylie Monthly Revenue and Expenditure Report for March 31,2018. (M. Beard, Finance Director) G. Consider, and place on file, the monthly Revenue and Expenditure Report for the Wylie Economic Development Corporation as of March 31,2018. (S. Satterwhite, WEDC Director) H. Consider, and act upon, authorizing the Mayor to enter into a Cooperative Agreement for additional Law Enforcement Services, between the City of Wylie, Lavon Lake, Texas initiates Agreement No. W9126G-18-T-0001 and the U.S. Army Corps of Engineers. This Minutes April 24,2018 Wylie City Council Page 2 agreement is for the provisions of additional Law Enforcement Services from May 19, 2018 through September 8,2018 for a sum not to exceed $61,880.04. Consider, and act upon, the approval of the purchase of an annual Microsoft Enterprise License Agreement from SHI Government Solutions, Inc. in the estimated annual amount of $87,416.00 through a cooperative purchasing contract with the Texas Department of Information Resources (DIR), and authorizing the City Manager to execute any necessary documents. Consider, and act upon, the approval of the purchase of water meter boxes, repair sleeves, lids, and manhole covers from Ferguson Inc. and Fortiline Waterworks in the estimated annual amount of$55,000.00 through a cooperative purchasing contract with Collin County Governmental Purchasing Forum, and authorizing the City Manager to execute any necessary documents. (G. Hayes, Purchasing) Council Action A motion was made by Mayor pro tem Stephens, seconded by Councilwoman Arrington, to approve the Consent Agenda as presented. A vote was taken and the motion passed 7-0. Councilwoman Arrington left the City Council meeting at 6:23 p.m. REGULAR AGENDA 1. Hold a Public Hearing and consider, and act upon, a Replat for Railroad Addition, Lot 1R, Block 6; Being a Replat of Lots 1, 2, and 3, Block 6, establishing one lot on 0.557 acres, located on the southwest corner of Brown and 1" Street (305-307 1" Street). RP 2018-02. (R. 011ie, Development Services Director) Staff Comments Development Services Director 011ie addressed Council stating the item is a replat request to reconfigure two lots to establish one lot on 0.557 acres. 011ie stated 20 notifications were mailed with no responses returned at the time of posting. During the public comments at the Planning and Zoning meeting, residents from the surrounding area spoke of concerns with on-street parking. The applicant stated that the WEDC will be paving the unimproved alley. Once the alley is paved, Citipointe will pave the rear of their property. The Commission voted 6-0 to recommend approval. Public Hearing Mayor Hogue opened the public hearing on RP2018-02 at 6:24 p.m. asking anyone present wishing to address Council to come forward. No one was present wishing to address Council. Mayor Hogue closed the public hearing at 6:25 p.m. Council Action A motion was made by Councilman Dahl, seconded by Mayor pro teen Stephens, to approve a replat for Railroad Addition, Lot 1R, Block 6; Being a Replat of Lots 1, 2, and 3, Block 6, establishing one lot on Minutes April 24,2018 Wylie City Council Page 3 0.557 acres, located on the southwest corner of Brown and 1st Street (305-307 1st Street). RP 2018-02. A vote was taken and the motion passed 6-0 with Councilwoman Arrington absent. 2. Hold a Public Hearing and consider, and act upon, a change in zoning from Agricultural-30 (AG/30) District to Commercial Corridor (CC) District to set the boundaries on 19.76 acres, generally located at the northeast quadrant of SH 78 and Brown Street. ZC2018-05. (R 011ie, Development Services Director) Staff Comments Development Services Director 011ie addressed Council stating the applicant is requesting to rezone a 19.76- acre property from Agricultural (AG/30) to Commercial Corridor (CC). The purpose of the rezoning is for the development of the property. The applicant has tentative plans to develop the SH 78 frontage as retail/restaurant uses. 011ie stated 34 notifications were mailed with no responses returned. One citizen spoke during the Planning and Zoning meeting with concerns for crime, noise from traffic, and decrease of property values. The Commissioners voted 6-0 to recommend approval of the request. Public Hearing Mayor Hogue opened the public hearing on ZC2018-05 at 6:28 p.m. asking anyone present wishing to address Council to come forward. No one was present wishing to address Council.
