Board members present with the Chairman were; Board Member Zachary Herrera, Board Member Sunil Verma, Board Member Billy McClendon, Board Member Bobby Heath Jr. and Board Member Dale Davenport. Staff present was Building Official Brian Killebrew, Code Enforcement Officer Pat Mitchell, Code Enforcement Officer Wendy Williamson and Secretary Alicia Chavez CITIZENS COI NTS Chairman Rogers opened the Citizens Participation. With no one approaching the Commissioners, Chairman Rogers closed the Citizens Participation. gin CONSENT ITEMS 1. Consider and act upon approval of the Minutes from the April 9, 2015, Regular Meeting. Board Action A motion was made by Board Member McClendon and seconded by Board Member Verma to approve the Minutes with corrections from the April 9, 2015 Regular Meeting. Motion passed 6-0. REGULAR AGENDA Public Hearing 1. Hold a public hearing, consider, and act upon providing evidence, seeking a determination that a building(s) located at or near 1413 Scottsdale Dr, Quail Meadow, Block G, Lot 7, Wylie, Collin County, Texas was in violation of standards set out in Ordinance #2008-49 DANGEROUS BUILDINGS and or PUBLIC NUISANCES Ordinance 92-14 of the City of Wylie, Texas; and seeking an order of approval of the Emergency Secure conducted on May 11, 2015. Minutes December 03,2015 Wylie Construction Code Board Page 1 of 5 Staff Comments Ms. Mitchell stated that she was contacted by a neighbor that the home had a in the ground pool with stagnant water and the fence was falling down. The pool was treated and the property was secured. Liens were filed and have not been satisfied. This home is still vacant. Chairman Rogers opened the Public Hearing. With no one approaching the Board, Chairman Rogers closed the Public Hearing. Board Action A motion was made by Board Member Herrera and seconded by Board Member Verma to approve the emergency secure of 1413 Scottsdale Dr. Motion carried 6-0. 2. Hold a public hearing, consider, and act upon providing evidence, seeking a determination that a buildings) located at or near 1515 Schooner Bay Dr, Newport Harbor#1, Block 14, Lot 4, Wylie, Collin County,Texas was in violation of standards set out in Ordinance #2008-49 DANGEROUS BUILDINGS and or PUBLIC NUISANCES Ordinance 92-14 of the City of Wylie, Texas; and seeking an order of approval of the Emergency Secure conducted on June 23, 2015. Staff Comments Ms. Mitchell stated that she was contacted by a neighbor that the home was unsecured. House appeared vacant. Ms. Mitchell contacted the contractor to board the entire home up from the inside and out. The house was ss ld after city secured. Liens were filed and paid by previous homeowner. Someone is currently living in house. Chairman Rogers opened the Public Hearing. With no one approaching the Board, Chairman Rogers closed the Public Hearing. Staff Comments Ms. Mitchell stated that she was contacted by a neighbor complaining house was trashed and had an in ground pool with unsecured fence around it. Wylie Police Department was called to verify house was vacant. Board Action A motion was made by Board Member Verma and seconded by Board Member Herrera to approve the emergency secure of 1625 Teakwood Dr. Motion carried 6-0. 4. Hold a public hearing, consider, and act upon providing evidence, seeking a determination that a building(s)located at or near 329 S 2nd St,Fairview,Lot 33,Wylie, Collin County, Texas was in violation of standards set out in Ordinance # 2008-49 DANGEROUS BUILDINGS and or PUBLIC NUISANCES Ordinance 92-14 of the City of Wylie, Texas; and seeking an order of approval of the Emergency Secure conducted on June 23, 2015. Chairman Rogers opened the Public Hearing. Sageen Adum property owner, stated he purchased the home in the beginning of June and that he had a contract with an investment company to buy the property. Plan of action is to have repairs made 2 months after house closes. Staff Comments Ms. Williamson stated that she was contacted by a neighbor stating the door was open and house was vacant. The Wylie Police Department investigated home and found it to be vacant. Ms. Williamson contacted the contractor to board the entire home up. Liens were filed and have been satisfied. This home is vacant. Board Action A motion was made by Board Member Verma and seconded by Board Member Heath to approve the emergency secure of 1625 Teakwood. Motion carried 6-0. 5. Hold a public hearing, consider, and act upon providing evidence, seeking a determination that a building(s) located at or near 326 S 2nd St, Fairview, Lot 15b, 16, Wylie, Collin County,Texas was in violation of standards set out in Ordinance#2008- 49 DANGEROUS BUILDINGS and or PUBLIC NUISANCES Ordinance 92-14 of the City of Wylie, Texas; and seeking an order of approval of the Emergency Secure conducted on June 23, 2015. Wylie Police Department checked the house found it was full of furniture but was vacant. Ms.Williamson contacted the contractor to secure the home. Liens were filed and notices have been sent. Nothing has been paid. This home is vacant. Chairman Rogers opened the Public Hearing. With no one approaching the Board, Chairman Rogers closed the Public Hearing. Board Action A motion was made by Board Member McClendon and seconded by Board Member Herrera to approve the emergency secure of 326 S 2r St. Motion carried 6-0. 6. Hold a public hearing consider, and act upon providing evidence, seeking a determination that a building(s) located at or near 2902 Misty Way, Pheasant Creek Addn Ph 2,Block G, Lot 14,Wylie,Collin County,Texas was in violation of standards set out in Ordinance # 2008-49 DANGEROUS BUILDINGS and or PUBLIC NUISANCES Ordinance 92-14 of the City of Wylie, Texas; and seeking an order of approval of the Emergency Secure conducted on June 30, 2015. Staff Comments Ms. Williamson stated that she was contacted by the Wylie Police Department because front door and garage door where open on a vacant house. Ms. Williamson contacted the contractor to secure the home. Liens were filed and notices have been sent. Nothing has been paid. This home is vacant. This is the second time house has been secured. Board Member Sunil asked if the balance keeps accruing. Ms. Williamson stated yes it does. Board Member Sunil asked how this compares to other cities. Ms.Williamson stated she was not sure. Chairman Rogers opened the Public Hearing. With no one approaching the Board, Chairman Rogers closed the Public Hearing. Board Action A motion was made by Board Member McClendon and seconded by Board Member Davenport to approve the emergency secure of 2902 Misty Way. Motion carried 6-0. 7. Hold a public hearing, consider, and act upon providing evidence, seeking a determination that a building(s) located at or near 806 Mardi Gras Ln, Holiday Terrace #1, Block 1, Lot 4, Acres 0.1720, Wylie, Collin County, Texas was in violation of standards set out in Ordinance#2008-49 DANGEROUS BUILDINGS and or PUBLIC NUISANCES Ordinance 92-14 of the City of Wylie, Texas; and seeking an order approval of the Emergency Secure conducted on August 08, 2015 Minutes December 03,20 t5 Wylie Construction Code Board Page 4 of 5 Staff Comments Ms. Williamson stated she was contacted by the Wylie Police Department due to kids playing at this property. Ms. Williamson stated the house was open, back patio cover was falling down and there was a storage building in the back that was open. Ms. Williamson contacted the contractor to secure the home. Liens were filed and notices have been sent. Liens have been paid, homeowner will make repairs at a later date. This home is vacant. Board Member McClendon asked how long emergency secure lasted. Ms. Mitchell stated that it depended on the property and could last as long as it was not a life safety issue. Board Member Verma asked if it deprecated the value of neighborhood. Ms. Mitchell stated it could but we can't demolish unless life safety issue. Chairman Rogers opened the Public Hearing. With no one approaching the Board, Chairman Rogers closed the Public Hearing. Board Action Bobby Heath abstained from this item since he had contact with the owner about purchasing this property. A motion was made by Board Member McClendon and seconded by Board Member Verma to approve the emergency secure of 806 Mardi Gras Ln.
