1. Hold a Public Hearing, consider, and act upon, a change of zoning from Agricultural (AG),
Light Industrial(LI)and Multifamily(MF)to Planned Development(PD),to allow for a mixed-
use master planned community on 20.433 acres, located from 2535-2701 S. SH 78. (ZC 2020-

Executive Summary
In accordance with the Development Agreement approved by City Council and executed in December 2019,
the applicant is requesting to rezone 20.433 acres for a multi-use Planned Development(PD).
The purpose of the PD is to create a development that consists of an area for townhomes and another for mixed-
use(residential and commercial)on vacant property located from 2535-2701 S. State Highway 78.

Executive Summary
The applicant is requesting to rezone 24.5 acres located at 1751 McMillen Road. The property is currently
zoned Agricultural. The reason for the requested rezoning to a Planned Development (PD) is to allow for an
age restricted mixed-use senior residential community. The PD contains three subdistricts that are proposed to
contain different categories of residential development for senior living.
3. Consider, and act upon, Resolution No. 2020-18(R) Postponing to the November 3, 2020
Uniform Election Date the General and Special Elections Scheduled to be held on May 2, 2020,
for the purpose of electing persons to the Offices of Mayor and Councilmembers for Places 5
And 6 and the remaining term for Place 2 in response to the Covid-19 Pandemic and Public
Health Emergency; Designating Polling Places; Authorizing Execution Of Joint Election
Contract for the November 3, 2020 Election; and take all other appropriate action. (S. Storm,

Executive Summary
On March 18,2020,the Governor of the State of Texas issued a proclamation suspending certain provisions of
the Texas Election Code and the Texas Water Code to allow all local political subdivisions such as the City of
Wylie that would otherwise hold elections on May 2, 2020, to move their general and special elections to the
November 3, 2020,uniform election date without otherwise adjusting the terms of office.

Mayor pro tern Jeff Forrester called the regular meeting to order at 6:00 p.m. The following City Council
members were present: Councilman David R. Duke, Councilman Matthew Porter, Councilwoman Candy
Arrington, Councilman Timothy T. Wallis, and Councilman David Dahl. Mayor Eric Hogue was absent.

in Volume 644,Page 325 and Volume 644, page 316 of the Deed of Records of Collin County, Texas

Mayor pro tern Forrester requested that Consent Item E be removed from Consent and considered individually
as a Councilmember had a conflict. Consensus of the Council was to remove Item E from Consent and
consider individually.
Council Action
A motion was made by Councilman Porter, seconded by Councilman.Wallis, to approve the Consent Agenda
items A-D and F-L as presented. A vote was taken and motion passed 6-0 with Mayor Hogue absent.
REGULAR AGENDA
E. Consider, and act upon, a final plat of Woodbridge Centre Phase 1 Lot 2D, Block B, being a replat
of lots 2A and 2B, Block B, generally located at 799 and 801 Woodbridge Parkway. (J. Haskins,

Councilman Porter filed a conflict of interest with the City Secretary prior to the start of the meeting and
stepped out of the Council Chambers during the consideration of this item.
Council Action
A motion was made by Councilman. Dahl, seconded by Councilwoman Arrington, to approve a final plat of
Woodbridge Centre Phase 1 Lot 2D, Block B, being a replat of lots 2A and 2B, Block B, generally located at
799 and 801 Woodbridge Parkway. A vote was taken and motion passed 5-0 with Councilman Porter
abstaining and Mayor Hogue absent.

establishing 21 residential lots and three HOA lots on 4.839 acres,generally located northwest of the
intersection of Spencer Lane and Colby Lane. (J. Haskins, Planning Manager)
Staff Comments
Planning Manager Haskins addressed Council stating the applicant has submitted a revised preliminary plat
for Wylie Lake Townhomes, creating 21 residential lots and three HOA lots on 4.839 acres. The subject
property is zoned within Planned Development 2003-18 and Townhomes are an allowed use by right.
Revisions occurred after the February 4, 2020 P&Z meeting but before the February 25, 2020 City Council
consideration. During consideration, City Council elected to refer the revised plat to P&Z for a
recommendation before making a final decision. The P&Z Commission reviewed the revised plat at their last
meeting as requested and the Commissioners recommended approval by a vote of 6-0.
Citizen Comments
Al Schoelen,representing Wylie Lakes HOA,addressed Council with concerns that the townhome subdivision
does not have two points of access out of their subdivision.
Domineca Irula, resident, addressed Council with concerns regarding the proposed townhomes including a
lack of communication from the builder and privacy fencing, and she requested an environmental impact
assessment.

Carlos Irula, resident, addressed Council asking for support from Council and stated he would like to be part
of the process.
Council Comments
Forrester asked about the lack of two points of access. Haskins replied that fire and city engineer comments
were as long as the cul-de-sac is less than the maximum allowed, and this cul-de-sac is at about 350-400 feet
in length, two points of access weren't necessary for such a small subdivision and it's within a larger
subdivision that has two points of access. Forrester asked about the privacy fencing. Haskins reported that they
will be held to whatever subdivision requirements were in place at that time; however, staff would prefer a
living screen so there is no gap between a privacy fence and a wrought iron fence where tall weeds grow in
between.
Applicant Comments
Milton Colegrove, legal counsel for Taas Investments, addressed Council stating he has reached out to the
president of the HOA on a few occasions. He stated it is their intent to have their own HOA within the
subdivision and to completely follow the planning development guidelines given by the City.
Council Comments
Wallis and Porter asked about the two points of access and the cul-de-sac regulations. Holsted reported in the
thoroughfare standards the City allows a cul-de-sac up to a certain length and is within the maximum length
of the cul-de-sac. Holsted confirmed with Haskins that the townhomes would be sprinkled. Haskins reported
based on the information provided by the fire marshal,they would be sprinkled.Dahl expressed that he believes
in property rights and zoning. Porter asked if the access points would be moot or meet a technical reason for
denial if so chosen by Council. Holsted replied the cul-de-sac is less than the max length allowed.
Council Action
A motion was made by Councilman.Dahl, to approve a revised preliminary plat for Wylie Lake Townhomes
Addition, establishing 21 residential lots and three HOA lots on 4.839 acres, generally located northwest of
the intersection of Spencer Lane and Colby Lane. The motion died for the lack of a second and no vote was
taken.
City Secretary Storm requested clarification that no action was taken on the item. Hoisted stated the Council
has a 30-day time frame to act on the plat. Haskins reported if no action is taken,the item is approved. If there
is a denial staff would request a reason for denial to provide the applicant with a letter.
Council Comments
Porter asked Holsted how the subdivision requirements interact with the thoroughfare standards since the
townhomes are a separate subdivision.

Hoisted reported the plat, as submitted, meets the intent of the Subdivision Regulations and the International
Fire Code requirement because they are sprinkling the townhomes and the cul-de-sac length is less than the
maximum allowed. Forrester asked if it meets the technical requirements of the Subdivision Regulations.
Holsted confirmed it does.

A motion was made by Councilman Dahl, seconded by Councilwoman Arrington, to approve a revised

WORK SESSION
AMI Project Update (M. Beard, Finance Director)
Finance Director Beard gave a brief update on the AMI Project. Currently, over 3,200 meters are having to be
read manually by various departments in order to stay within the 30 day billing cycle. A final contract is
proposed to come for Council approval at the May 12 meeting with the project completed in November 2020.
Beard reported a portal has not been chosen, but the one chosen will allow residents to see leaks, track usage,
and provide accurate and close to real-time information.
oc Parks & Recreation Presentation to Council (R. Diaz, Parks &Recreation Director)
Parks and Recreation Director Diaz showed a video overview presentation of the Parks and Recreation
department. Diaz stated the vision for the department is to set the standard for connection, service, and quality
of parks and recreation. Diaz introduced Parks and Recreation staff that were present.
The video presentation covered statistics of the Parks and Recreation department, spoke on public art, the
Brown House,the Senior Recreation Center, and the Recreation Center, gave examples showing the values of
the department, stated the mission, which is to spark connection, wellness, and learning, showed training that
staff has completed, awards and recognitions the department has received, and the different funding sources.
oc Wylie Parks, Recreation, and Open Space Master Plan (R. Diaz, Parks &Recreation Director)
Parks and Recreation Director Diaz announced there were three Parks and Recreation Board members present:
Gloria Suarez, Brian Willeford, and Brett Swendig.
Elizabeth McIlrath and Philip Neeley, with Dunaway Associates, gave a Parks, Recreation and Open Space
Master Plan and Municipal Complex Preliminary Master Plan Update presentation to Council. The Parks,
Recreation and Open Space Master Plan presentation included parks inventory,population and demographics,
park service areas, the needs assessment that was completed by the citizens, most needed facilities based on
priority rankings, and an action plan worksheet and showed examples of the priorities based on rankings. The
Municipal Complex Preliminary Master Plan presentation showed the preliminary master plan, key features,
and examples of the key features.
Consensus from Council was to move the amphitheatre to the East Meadow and bring back an updated
Municipal Complex Preliminary Master Plan at the March 24 Council meeting.

The applicant has submitted an amended plat for Lot 1,Block A of W.I.S.D Center Addition on 55.494 acres. The purpose
of the amended plat is to relocate and label utility and firelane easements,due to Wylie ISD renovating Harrison.Intermediate
School. The site plan for the renovation was approved by the Planning and Zoning Commission on March 3,2020.
The plat is technically correct and abides by all aspects of the City of Wylie Subdivision Regulations.
Approval is subject to additions and alterations as required by the City Engineering Department.
For conditional approval, or disapproval, City Council must provide a written statement of the reasons to the applicant in
accordance with Article 212, Section 212.0091 of the Texas Local Gov't Code.

OWNER: Wylie Independent School District APPLICANT: RLK Engineering
The applicant has submitted an amended plat for Lot 1,Block A of Wally W. Watkins Elementary School on 10.818 acres.
The purpose of the amended plat is to relocate and label utility and firelane easements,due to Wylie ISD renovating Watkins
Elementary School. A site plan for those renovations was approved by P&Z on March 3, 2020.
The plat is technically correct and abides by all aspects of the City of Wylie Subdivision Regulations.
Approval is subject to additions and alterations as required by the City Engineering Department.
For conditional approval, or disapproval, City Council must provide a written statement of the reasons to the applicant in
accordance with Article 212, Section 212.0091 of the Texas Local Gov't Code.

A.Property Tax Collections for FY19-20 as of February 28,2020 are 97.36%,in comparison to FY18-19 for the same time period of 97.86%. Sales tax is on a 2
month lag.
B.Franchise Fees:The majority of franchise fees are recognized in the third and fourth quarter with electric fees making up the majority.
C.Intergovernmental Rev: The majority of intergovernmental revenues come from WISD reimbursements and Fire Services which are billed quarterly. Lucas and
Fairview paid in full FY 2020 dispatcher reimbursement of$159k.
D.Service Fees:Trash fees billed in October are applicable towards FY 2018-19 revenue with the remaining fees coming from other seasonal fees. Development
Fees are already over budget by$65k due to Woodbridge Townhomes and Bozman Phase 7.
E. Fines and Forfeitures are down 20%from February 2019 which is a continuation of the decreasing trend in fines.
F. The Interest rate has gone from 2.39%in July 2019 when budget was prepared to 1.58%for February 2020.

Discussion
This contract provides mowing and litter control services for various right of ways,medians, fire stations,and the Public
Safety Building. Total acres include the consolidation of approximately 40 acres previously mowed by the Public Works
staff for pump and lift stations. The approved FY 2019-2020 budget for this contract is $365,000.00; which consists of
an original amount of$315,000.00 plus the approved increase of$50,000.00 for areas previously moved by Public Works.
The annual budget is based on an average mowing season with approximately 19-21 mowing cycles (mowing every 2
weeks), and the City is invoiced only for completed mowing cycles.
Staff issued a competitive sealed bid, and received six (6)bids. The bids were evaluated to determine the overall best
value to the City based on pricing,work history,longevity of business and employees and equipment. Staff recommends
the award of an annual contract with renewals to J. Nichols Construction, Inc. in the estimated annual amount of
$365,000.00 as providing the best overall value to the City.

Discussion
OWNER: Serene District Townhomes LLC and The District Lifestyle LLC
APPLICANT: Ryan Cole/Charles Branch
In accordance with the Development Agreement approved by City Council and executed in December 2019, the applicant
is requesting to rezone 20.433 acres for a multi-use Planned Development(PD).
The purpose of the PD is to create a development that consists of an area for townhomes and another for mixed-use
(residential and commercial) on vacant property located from 2535-2701 S. State Highway 78.
The PD closely follows the development standards outlined within the executed Development Agreement.The text has been
reorganized to reflect the City's usual PD format. Some edits and changes to wording have also been made, including;
• A development schedule (Exhibit B)
• References to the City Zoning Ordinance in areas not addressed by the PD
• Additions to exclude and include certain uses from the underlying TH and CR zoning.
The PD allows for a maximum of 34 townhomes on Tract 1 and over 230,000 sq. ft. of commercial/multi-family
development on Tracts 2-5,both with private and public amenities. PD conditions require 40,000 sq. ft. of development be
in place on Tracts 2-5 before CO's can be issued for any townhomes on Tract 1.
Construction shall be masonry. Sample elevations are provided in Exhibits C and E.

Parking on Tracts 2-5 is shared across the development with a 15% per use reduction of required parking based on the
mixed-use nature of the development.
All open spaces, easements, and access drives, will be maintained by the Home Owners Association on Tract 1 and the
Property Owners Association on Tracts 2-5.A pedestrian bridge is proposed to cross Maxwell Creek and must be completed
before COs are issued for the townhomes. Open space along the creek will be open to the public.
Platting will be required for all properties, and site plans will be required for each commercial or multi-family lot.
Notifications/Responses: Nine notifications were mailed; with no responses received in favor or opposed to the request.
P&Z Commission Discussion
The Commissioners asked the applicant about access to utilities as is required for platting. The applicant responded that
work is continuing in that area. The applicant was also asked about the amount of secured funding for the project.
The Commission voted to recommend approval 4-2, with the dissenting Commissioners expressing concerns about the
applicant's ability to complete the project.

Development Standards
(Zoning Case 2020-03)
1.0 Purpose:
The purpose of this Planned Development is to provide the appropriate development standards
and controls to allow a residential development on Tract 1 and a mixed-use development on Tracts 2-5,in
line with the approved Development Agreement and shown in the included Zoning Exhibits.
Unless expressly stated otherwise within this Planned Development,Development Agreement, or
Annexation Services agreement, or their exhibits, all development shall be subject to all applicable
Zoning and City Ordinances and/or design standards.
1.1 Development Schedule:
The owner of Tracts 2 &3 and the owner of Tracts 4& 5 shall complete or cause completion of
construction of at least Forty-Thousand(40,000) square feet of commercial/retail/office/residential space
(of which no less than 20,000 square feet of commercial/retail space and no less than 10,000 square feet
of office space), and all necessary infrastructure, on any of Tracts 2, 3,4, or 5 and obtain from the City of
Wylie all corresponding certificates of occupancy prior to receiving final inspections or certificates of
occupancy for any building on Tract 1.
Necessary infrastructure shall include,but may not be limited to;required utilities, access drives,
fire lanes,parking,landscaping, signage, and a completed perimeter sidewalk,including a pedestrian
bridge per Zoning Exhibits A and D, along State Highway 78.
The development schedule shall generally adhere to the schedule provided as Exhibit B. The
applicable sections of the Texas Local Government Code and other Texas State law shall govern the
expiration of plats,plans, or inactive permits.
2.0 Residential Townhome Standards: Unless included herein (Section 2 and 3) or attached zoning
exhibit,Tract 1 design standards shall follow the requirements of Article 3,Residential District Regulations,
and Figure 3-5 (Townhouse District)of the September 2019 City of Wylie Zoning Ordinance.

3.0 Residential Townhome Standards:
3.1 Allowed Uses:
a. The only allowed uses,as defined in the September 2019 City of Wylie Zoning Ordinance,
on Tract I are:
i. Single Family Dwelling, Attached
ii. Community Park(Public)
iii. Neighborhood Park or Playground
iv. By Special Use Permit—any use required by local, state, or federal law.
3.2 Site Plans and Plats
a. Upon approval of zoning, the developer will submit a plat for the property in accordance
with the City of Wylie's Subdivision Regulations.
b. A landscape plan shall be provided in conjunction with the preliminary plat. The landscape
plan shall require City approval including open space approval by the City of Wylie Park
Board.. The plan shall comprehensively address edge treatments, perimeter screening, and
individual townhouse landscape design. The Developer shall coordinate with the City on
the selection of type, style location, and size of all landscape improvements, including but
not limited to plants, trees, mulch, irrigation, and benches.
c. Concurrent with the above submittals for Tract 1, the developer shall submit a preliminary
plat and site plan, in accordance with the City of Wylie's Zoning Ordinance, for such lots
on Tracts 2, 3, 4, and/or 5 that meet the requirements of Section 1.1 of this Exhibit.
3.3 Architectural Design Standards Tract 1:
a. All townhome units in Tract 1 shall have 100 percent of each facade comprised of masonry and
shall confoiin to the exterior design appearance of Exhibit E.
b. Masonry shall include brick, stone or masonry stucco.
c. EIFS may be used as an accent material and comprise no more than 15 percent of any facade.
d. Roofing Materials shall be architectural grade overlap architectural shingles, metal, or
composite Spanish roof tile and other roof appearances shall be painted to match the color of
the roof.
3.4 The maximum number of townhomes in The District Townhome Community (Tract 1) shall be 34
Townhomes or approximately 8.2 Townhomes per gross acre.
3.5 A masonry and wrought iron perimeter screen shall be provided along the property adjacent to State
Highway 78 as generally shown on Exhibit F.
3.6 Entry Features: Architectural features shall be stone, brick, and wrought iron screening wall
monuments.
3.7 Signage at Community Entrance: Illuminated community identification shall be incorporated into
a stone screening wall or monument at the Community entrance. The sign shall be illuminated by
means other than streetlights. Landscaping and upright towers for the Community entrance signage
shall be constructed to generally conform to those shown in Exhibit F.
3.8 Sidewalk Locations: Five-foot sidewalks shall be provided within the property. Primary walkway
paving shall be enhanced using earth-tone colored concrete (stain mixed, not applied after),
stamped/pattern concrete, aggregate or brick/paver stone at a minimum of 7.5 feet every 75 feet.
3.9 Sidewalk Lighting: Decorative street pole lighting shall be provided throughout the Community.
The Developer shall pay for the installation including electrical connections. Operation and
maintenance shall transfer to the HOA thereafter.
3.10 Mailboxes: Shall be located in a dedicated area as required by the United States Postal
Service. Mailboxes shall be of a uniform style selected by the Developer and shall be stylistically
consistent with the The District Townhomes Community.
3.11 A minimum of 15% of the land within the District Townhome shall be used as Open Space as
shown on Exhibit A.
a. The swimming pool/grill open space area will be owned and maintained by the
homeowners' association(the BOA).
b. All open spaces within the Community with the exception of the swimming pool area shall
be accessible to the public.
3.12 Public open spaces shall be dedicated by plat to the City of Wylie in accordance with City's
Subdivision Regulations.
3.13 Maintenance of the Open Space Area:
Maintenance of the open space area will be the responsibility of the Developer until it is turned
over to the Homeowners Association(BOA).
Developer will be the contact entity with the City for all concerns regarding the maintenance of
open space until 100%of HOA control is turned over to the homeowners.
A. Developer/HOA typical maintenance and responsibilities of amenities include but are not
limited to:
a. Clean up and litter removal.
b. Landscaping installation,care,and maintenance.
c. Trimming, clearing, and removal of unwanted vegetation as determined by the City Parks
Department or Code Enforcement.
d. Maintain irrigation system, pay for the water used in the system and test all backflow
devices annually as per City requirements.
3.14 Water and sanitary sewer will be extended by the Developer to the site, per the Annexation.
Services Agreement (City of Wylie Ordinance 2020-17) and to Texas Department of
Transportation and/or City of Wylie standards.
3.15 Minimum drive concrete pavement specifications shall be: six(6")inches of concrete, 3,600 psi,
with# 3 rebar at 18-inch center to center, except in required fire lanes which shall be built to fire
code or city engineering standards.
3.16 Exteriors shall have contrasting colors to achieve an architecturally enhanced appearance. Trim
shall be painted one color and a side surface and garage doors shall be painted or stained a second
color.
3.17 Roof pitches shall be a maximum of 6:12 for main gables and hips. Dormer roofs and roofs over
porches may have a lesser pitch.
3.18 Roofing materials shall be architectural grade overlap architectural shingles,metal,or composite
Spanish roof tile and other roof appearances shall match the color of the roof.
3.19 Garage doors shall be carriage style in appearance. This requirement shall be accomplished with
the following:
a. Garage door panels shall be wood clad or have the appearance of wood.
b. Decorative hardware shall be attached to the garage doors. Such hardware shall include handles
and hinges in a complementary color.
3.20 Landscaping: Sodded front yards must be provided with a minimum of one - three-inch caliper
trees. Landscaping shall also be provided along the primary walkway to any home. When
automated, subsurface irrigation systems are provided, rain sensors shall be installed and
operational.
3.21 Energy: All homes shall comply with the then-current ICC Energy Code adopted by the City
(including all local amendments).
3.22 Lighting:
a. Entrances to homes and garage doors shall be illuminated.
b. Lighted house number plaques shall be provided on the front of all homes.
c. The color and shape of lighting hardware must be compatible with other building hardware.
d. Lighting must be uniformly spaced.
e. Lighting must be integrated with other accents and reveals.
f. Specialty lighting shall be coordinated with predominate architectural features.
g. Lighting fixtures along rights-of-way must be spaced to avoid conflicts with tree plantings.The
heights of lighting fixtures must also avoid conflicts with tree plantings.
4.0 Commercial Design Standards-Unless included herein(Section 4 and 5)or attached zoning exhibit,
Tracts 2-5 design standards shall follow the requirements of Article 4 (Non-Residential District
Regulations), Figure 4-2 (Community Retail District), and Article 5 (regarding allowed uses and required
parking) of the September 2019 City of Wylie Zoning Ordinance.

5.0 Commercial Retail Standards:
5.1 Allowed Uses:
a. All uses listed in the Community Retail Zoning District as by-right uses, as defined in the
September 2019 City of Wylie Zoning Ordinance, are allowed on Tracts 2,3,4, and 5
except:
i. Commercial Greenhouse
ii. Hospital
iii. Financial Institution,Alternative
iv. Automobile Rental
b. All the uses listed below are included as allowed by-right uses:
i. School, Business
ii. School,Technical or Trade
iii. Used Merchandise/Resale Shop/Consignment/Thrift Store

c. All other proposed uses are strictly prohibited without the approval of a Special Use Permit,
unless required by local, state, or federal law.
5.2 Site Plans and Plats
a. Upon approval of zoning, the developer will submit plats for the property(ies) in
accordance with the City of Wylie's Subdivision Regulations.
b. Concurrent with preliminary plat submittal, the developer shall submit a site plan, in
accordance with the City of Wylie's Zoning Ordinance, for such lots that meet the
requirements of Section 1.1 of this Exhibit.
5.3 Architectural Design Standards Tracts 2,3,4 & 5
a. Primary front facade materials shall be a minimum of 80 percent masonry product with at
least 20 percent stone on the front facade.
b. Approved primary masonry materials include, brick, stone, masonry stucco, or decorative
concrete.
c. Up to 20 percent of the front facades may be stucco with decorative accents such as
cementitious fiberboard and metal trims.
d. The remaining three facades shall be a minimum of 60 percent brick or stone, and up to 40
percent may be stucco with decorative accents such as cementitious fiberboard and metal
trims.
e. EIFS shall not be considered acceptable primary exterior material but shall be accepted
when applied as accent or architectural features and shall not exceed 15% of any façade
face.
f. To achieve façade articulation, visual variety and/or architectural detailing buildings shall
use two complementary primary facade materials.
g. Composite Spanish roof tile with a 30 to 50-year warranty must be used on visible roofing,
or a similar product.
h. The exterior design appearance of all buildings in Tracts 2,3,4 & 5 shall conform to the
appearance of Exhibit C.
5.4 The Development will be a private development with public access with Property Owners
Association maintained improvements and floodplain.
5.5 Public open spaces shall be dedicated by plat to the City of Wylie in accordance with City's
Subdivision Regulations.
5.6 Maintenance of the Open Space Areas
a. Maintenance of the open space areas will be the responsibility of the Developer until it is turned
over to a Property Owners Association(POA).
b. Developer/POA maintenance and responsibilities of open space and/or amenities include:
i. Clean up and litter removal.
ii. Landscaping installation, care, and maintenance.
iii. Trimming, clearing, and removal of unwanted vegetation as determined by the City Parks
Department or Code Enforcement.
iv. Maintain irrigation system,pay for the water used in the system and test all backflow devices
annually as per City requirements.
5.7 Parking:
a. Due to the mixed-use and interconnected nature of the development, parking shall be
shared across Tracts 2 & 3 and Tracts 4 &5. per Exhibit D.
b. Parking will be provided per use at a 15%reduction from typical requirements as provided
in the City of Wylie Zoning Ordinance.
c. At no time will temporary parking be allowed in any uncompleted area of the development.
There shall be adequate required permanent concrete parking for each use before a
certificate of occupancy is issued, in the case a single use and tenant occupies an entire
building, or before a building permit for `finish out' is issued in the case of a multi-use /
tenant shell building.
5.8 Lighting:
a. The color and shape of lighting hardware must be compatible with other building hardware.
b. Lighting must be uniformly spaced.
c. Lighting must be integrated with other accents and reveals.
d. Specialty lighting shall be coordinated with predominate architectural features.
e. Decorative lighting and sconces shall be provided at all main entrances.
f. Lighting fixtures along rights-of-way must be spaced to avoid conflicts with tree plantings. The
heights of lighting fixtures must also avoid conflicts with tree plantings.
5.9 Signage at Community Entrance: Illuminated community identification shall be incorporated into
a stone screening wall or monument located at the Community entrance. The sign shall be
illuminated by means other than streetlights. Subject to visibility triangle standards. Shown on
Exhibit G.
5.10 Roofing:
a. A minimum variable roof pitch of`/ inch to 12 inches and/or a flat TPO must be used.
b. Composite Spanish roof tile with a 30 to 50-year warranty must be used on visible roofing.
c. Building roof types, forms, and elements should provide variation and interest in building
profiles and contribute to the architectural identity of the buildings without creating an
imposing scale on adjacent uses.
5.11 Five-foot sidewalks shall be provided within and throughout the property.
5.12 Landscaping: Trees and specimens should be planted to coincide with the overall style and quality
of the development project.
a. Ground-level utility connections and mechanical equipment must be completely screened with
walls and landscape material which are compatible with the overall building and landscape
design.
b. Shall be provided close to the building to emphasize the pedestrian scale.
5.13 Energy Conservation:
a. Energy-efficient architectural lighting must be used.
b. LED lighting must be used for street lighting.
c. An HVAC of 18 to 23 SEER must be used.
d. Insulation, door, and window standard `R values' must exceed the minimum requirement of
the current International Building Code,as adopted by the City of Wylie at time of construction.

EXHIBIT D—AGREED BUILI)ING MATERIALS AND MIJiff/DS STANDARDS
Architectural Design requirements for exterior building materials shall be achieved in
accordance with the following criteria:
1. Tract 1 Townhome Development
a. All townhome units shall have 100 percent of each facade composed of masonry.
b. Masonry shall include brick, stone,or masonry stucco,
c. EIFS may be used as an accent material and comprise no more than 15 percent of any
facade.
d. Roofing materials shall be architectural grade overlap architectural shingles,metal,or
composite Spanish roof tile and other roof appearances shall be painted to match the
color of the roof
2. Tracts 2,3,4,& 5 Mixed-Use Development
a. Primary front facade materials shall be a minimum of 80 percent tn. In*, product
with at least 20 percent stone on the front facade.
b. Approved primary masonry materials include, brick, stone, masonry stucco, or
decorative concrete,
c. Up to 20 percent of the front facades may be stucco with decorative accents such as
cementitious fiberboard and metal trims.
d. The remaining three facades shall be a minimum of 60 percent brick or stone,and up
to 40 percent may be stucco with decorative accents such as cementitious fiberboard
and metal trims.
e. EIFS shall not be considered acceptable primary exterior material but shall be
accepted when applied as accent or architectural features and shall not exceed 15%
of any facade face,
f. To achieve façade articulation, visual variety and/or architectural detailing buildings
shall use two complementary primary facade materials.
g. Composite Spanish roof tile with a 30 to 50-year warranty must be used on visible
roofing, or a similar product.

OWNER: Shaw Children GS Trust and Carole C Shaw APPLICANT: Ping Interest
The applicant is requesting to rezone 24.5 acres located at 1751 McMillen Road. The property is currently zoned
Agricultural.The reason for the requested rezoning to a Planned Development(PD)is to allow for an age restricted mixed-
use senior residential community. The PD contains three subdistricts that are proposed to contain different categories of
residential development for senior living.
The single-family subdistrict is proposed to contain a maximum 56 single family residential lots that measure a minimum
of 4,000 sq. ft. with dwellings that are a minimum of 1,100 sq. ft. The proposed setbacks are 10' for the front, 5' for the
sides, and 20' for the rear. The subdistrict will be providing one garage space and two spaces per driveway. The exterior
material within the subdistrict is comprised of masonry or fiber cement lap siding and panels with at least 20%of the facade
being offset a minimum of 1'.
The multiplex subdistrict is proposed to contain a maximum of 45 residential rental units with a minimum dwelling square
footage of 470 sq. ft. for studio units,675 sq. ft. for one-bedroom units and 875 sq.ft. for two-bedroom units.The proposed
setbacks are 10' for the front, 5' for the sides and 20' for the rear.The subdistrict will be providing 82 parking spaces being
2 spaces per unit. The exterior material within the subdistrict is comprised of masonry or fiber cement lap siding and panels
with at least 20%of the facade being offset a minimum of 1'.
The multiple-care family subdistrict is proposed to contain a maximum of 160 assisted living residential units with a
minimum dwelling square footage of 470 sq. ft. for studio units, 675 sq. ft. for one-bedroom units and 875 sq. ft. for two-
bedroom units. The proposed setbacks are 10' for the front, 5' for the side of corner lots,and 15' for the rear on any interior
lot line.This subdistrict will also allow the following accessory uses: civic center,cultural arts facility, financial institution

(without drive-thru), medical clinic, commercial amusement (low density), health club, theater, cleaners, general
merchandise store, grocery store, personal service use, restaurant without drive-through service, and a post office. The
subdistrict will be providing 166 parking spaces with 7 of those being handicapped parking spaces. The exterior material
within the subdistrict is comprised of masonry or fiber cement lap siding and panels with at least 25% of the facade being
offset a minimum of 2'.
Access to this development will be provided by private roads that have entrances from both McMillen Road and FM 1378.
All of the private roads will be striped and labeled as fire lanes. On-street parking shall be prohibited and so marked with
signage.
This development will be providing a variety of landscaping open space areas with trails,benches,fitness stations and picnic
tables. A 40' wide landscaped buffer with a 6' wrought iron fence between brick or stone columns will also be provided
adjacent to both of the main street frontages.
Notifications/Responses: Twenty-three notifications were mailed; with one response in favor and one in opposition of the
request.

A. Purpose
The purpose of this planned development district is to allow an age restricted mixed-use development
on an approximate 24.5 acre parcel located on Tract 27 of the Williams Patterson Survey, West of FM
1378 and North of McMillen Road. This community will contain retail, personal service, health club,
outdoor recreation, multifamily, assisted living, and single family uses. The regulations in this Planned
Development (PD) District will encourage high-quality site planning and design
in accordance with the City of Wylie's Comprehensive Plan.
B. District Regulations
1. General.
a. Subdistricts established:This PD shall be developed in three subdistricts as follows:
i. Subdistrict 1: Single Family Subdistrict
ii. Subdistrict 2: Multiplex Subdistrict
iii. Subdistrict 3: Multiple-Care Subdistrict
iv. The zoning exhibit(Exhibit C) shall serve as a subdivision concept plan for purposes of
Zoning and Land Design, Street, and Sidewalk requirements. Separate plat submittals
for all subdistricts shall be required. A separate site plan submittal for Subdistrict 3
shall be required.
2. Development of the Property shall generally conform to the following regulations:
a. Single Family Subdistrict
i. Except as otherwise provided herein, development of the Single Family Subdistrict
shall comply with the Single Family-10 District regulations of the 2019 City of Wylie
Zoning Ordinance.
ii. Permitted Uses: Uses permitted in the Single Family-10 are permitted in the Single
Family Subdistrict. Residential uses are restricted to a head of household aged 55
and older.

Minimum roof pitch shall be 4:12.
Repetition of floor To avoid repetitious feel, a minimum of five (5) platted residential lots
plan and elevation must be skipped on the same side and three (3) lots must be skipped on
the opposite side of a street before rebuilding the same single-family
residential unit with an identical (or nearly identical) street elevation
design. The same floor plan shall not be repeated on neighboring,side by
side lots or directly across the street. Identical or nearly identical floor plan
means that the layout, size and function of the rooms are essentially the
same. Identical or nearly identical street elevation design means little or
no variation in the articulation of the facade, height or width of façade,
placement of the primary entrances, porches, number and placement of
windows,and other major architectural features. It does not mean similar
colors, materials, or small details.
Garage Entry To maximize the useable rear yards, garage doors can be located on the
primary street elevation of a single-family residential unit. The primary
street would be the addressed street front. Garages may face the street
on a corner lot side yard. To provide ample parking and storage, each
garage shall be a minimum of 400 square feet.
Fencing No front yard fences are allowed.
Side and rear yard fences shall be permitted to a height of 8 feet maximum
and constructed of wood or wrought iron.
Landscaping Each residential dwelling unit shall have sodded front, side, and rear yard
with a minimum of 1 ornamental tree and 5 shrubs in front yard.

While I realize the property on the North side will not look like ours om
the South side,{ the lssues are density and iimapact. doth of these and other
concerns were ralsed In previous pu]bllc form with Mr. Ping., as it related
to prior proposals. One impact concern was schools. Mr. Pang addressed
that one with the most recent proposal by going to the complete opposite
spectrum, elderly. But, more importantly, he went back to high density.
This is no place for a 4 -story building of any kind. If you would not build
it in your front -yard, don't build it in mine. Not to mention my view will
include the dumpsters.
Density is still an issue, even worse now_ moble the previous 50 -foot wide
lots were not popular, the newly proposed 40 -foot lots and multiplex housing
is even less acceptable. Based on Mr. Ping's original statement about how
the land is zoned..."we can build anything we want"...and his initial scare
tactic of a rough plan of multi -story apartments and retail, he is not
interested in our community, only profit. I suspect he will continue to
bring un -popular proposals until we the people are numb and give up_ Please
'tie our v is i ce .
What I am looking for is a deslgn1plan that will blend the acreage on the
South with the existing housing on the Norah, keeping as much open
atmosphere as we can. The pond and open space immediately North of McMillen
is a great start. A housing addition with various lots sizes and top
builders as were used in the closest sub -division to the North, eg. Paul
Taylor and Grand, would blend nicely. Keep the smaller 50 -foot lots to
less than l5%_ Add in 15% of 70 -foot lots and the g 60 -foot or
larger. Where should be a living squ re' foottage nnaii4ai m,m of 2000 sq ft or
larger. This should reduce the impacts. -and lower density, as well as
address the asthectics of the area.

On March 18, 2020, the Governor of the State of Texas issued a proclamation suspending certain provisions of the Texas

election date without otherwise adjusting the terms of office.
Pursuant to the Governor's proclamation authorizing the City of Wylie to postpone the May 2, 2020 election date, the City
Council does by this Resolution exercise its authority to move to November 3, 2020, the General and Special Elections
previously ordered for May 2, 2020, for the purpose of electing persons to the offices of Mayor and Councilmembers for

ELECTION DATE THE GENERAL AND SPECIAL ELECTIONS
SCHEDULED TO BE HELD ON MAY 2, 2020, FOR THE PURPOSE OF
ELECTING PERSONS TO THE OFFICES OF MAYOR AND
COUNCILMEMBERS FOR PLACES 5 AND 6 AND THE REMAINING
TERM FOR PLACE 2 IN RESPONSE TO THE COVID-19 PANDEMIC
AND PUBLIC HEALTH EMERGENCY; DESIGNATING POLLING
PLACES; AUTHORIZING EXECUTION OF JOINT ELECTION
CONTRACT FOR THE NOVEMBER 3, 2020 ELECTION; PROVIDING A

WHEREAS, in accordance with the general laws and Constitution of the State of Texas
and the Charter of the City of Wylie, Texas, and pursuant to Resolution No. 2020-06(R) and
Resolution No. 2020-10(R), General and Special Elections were ordered to be held on May 2,
2020, for the purpose of electing persons to the offices of Mayor and Councilmembers for Places
5 and 6 and the remaining term for Place 2; and
WHEREAS, on March 18, 2020, the Governor of the State of Texas issued a proclamation

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WYLIE, TEXAS:
SECTION 1: That the City of Wylie General and Special Elections previously ordered
for May 2, 2020, are hereby moved to November 3, 2020.
Resolution No. 2020-18(R) - Moving the May 2, 2020 General and Special Election to the November 3, 2020
Uniform Election Date
SECTION 2: That the candidate filings for the General and Special Elections shall remain
valid for the elections to be held on November 3, 2020, and that the filing period for candidates
will not be re -opened.
SECTION 3: That all annual applications ballot by mail (ABBMs) for voters that are
voting by mail due to being over the age of 65 or due to disability will still be valid for the
November 3, 2020, elections; and that ABBMs for voters who submitted ABBMs based on
expected absence from the county shall not be valid for the postponed November 3, 2020 elections.
SECTION 4: That the voter registration deadline for the November 3, 2020, election is
October 5, 2020, the deadline to submit an ABBM is October 23, 2020, and the dates for early
voting are October 19, 2020, through October 30, 2020.
SECTION 5. That the City Manager is authorized to negotiate and execute an amendment
to each existing election contract with Collin, Dallas, and Rockwall Counties, as necessary, for the
purposes of conducting the postponed elections on November 3, 2020.
SECTION 6. That should any word, sentence, paragraph, subdivision, clause, phrase or
section of this ordinance be adjudged or held to be void or unconstitutional, the same shall not
affect the validity of the remaining portions of said ordinance, which shall remain in full force and
effect.
SECTION 7. This Resolution shall take effect immediately from and after its passage as
the law and charter in such cases provide.
