03-22-2020 (City Council) Minutes Special Called Wylie City Council CITY O WYLIE Minutes Special Called Meeting March 22,2020—4:00 p.m. Wylie Municipal Complex—Council Chambers 300 Country Club Road, Bldg. 100 Wylie, TX 75098 CALL TO ORDER Mayor Eric Hogue called the special called meeting to order at 4:00 p.m. The following City Council members were present: Councilman David R. Duke, Mayor pro tern Jeff Forrester, Councilman Matthew Porter, Councilwoman Candy Arrington, Councilman Timothy T. Wallis, and Councilman David Dahl (4:05 p.m.). Staff present included: City Manager Chris Hoisted; Assistant City Manager Brent Parker; Assistant Police Chief Tommy Walters; Public Information Officer Craig Kelly; Fire Chief Brandon Blythe; Assistant Fire Chief Brian Ritter; Planning Manager Jasen Haskins; and Deputy City Secretary Tina Link. INVOCATION&PLEDGE OF ALLEGIANCE Mayor Hogue gave the invocation and led the Pledge of Allegiance. CITIZEN COMMENTS ON NON-AGENDA ITEMS Melissa Kenfield submitted a citizen comment form that Mayor Hogue read aloud requesting extensions for developers during this time of crisis. REGULAR AGENDA 1. Consider, and act upon, Ordinance No. 2020-24 Continuing or Renewing the Mayor's Declaration of Local Disaster for a Public Health Emergency. (B. Blythe, Fire Chief) Staff Comments City Manager Hoisted spoke to Council regarding the amended Order from Dallas County. The City would like to match the Dallas County Order, which is the most stringent right now. Wylie is comprised of three counties so there is some confusion about which Order the citizens would follow. The Order with the most stringent guidelines would be followed, but the desire is to match theirs as closely as possible to eliminate any confusion. Minutes March 22,2020 Wylie City Council Page 1 Council Comments Councilman Porter asked whether, since Wylie is comprised of three counties, the Dallas statutes apply to the whole City or only the portion within Dallas County limits, and the Collin County policies apply to the portion within Collin County. He asked whether, if Collin County's policies do not match those of Dallas County, the City is required to put Collin's in place or would those restrictions apply only to subdivisions located in Dallas County, and would that supersede the City Ordinance. Hoisted replied that if a county adopts an Order that is more stringent than ours, then it would apply to the city limits of that county. Mayor pro tern Forrester commented that he would like to see the verbiage changed in the City's new Ordinance to reflect the timeline to read April 3, 2020 rather than 60 days and that it takes Council to terminate the disaster declaration. The consensus of Council was to make the two changes suggested. Councilwoman Arrington said that, although Wylie's small businesses were one of the reasons she relocated here, she is more concerned with the health of the citizens during the pandemic and supports closure of the designated businesses so that life can return to normal sooner. Councilman Dahl and Forrester recommended allowing laundromats to stay open. Councilman Wallis expressed his desire for healthcare operations to remain open. Porter and Forrester asked some questions on Section 3 regarding employees continuing to be paid while not at work. Hoisted commented employees who can work from home will log in as usual; if they are choosing to stay home, they will use their own sick or vacation time; on-site staff will be reduced to those performing essential functions; and part-time staff will be used as much as possible to perform other duties as needed. Porter asked about adding language to Section 4 regarding purchases related directly to the disaster. Porter stated he would like to see Council and the Planning and Zoning Commission to continue to meet in person. Council recommended keeping the fines in line with the Governor's Order. Porter and Forrester asked if verbiage could be added to specify that hospital buildings be used only with county, state or federal guidance. Fire Chief Blythe stated that there is the old hospital facility on Highway 78 that could be utilized as needed. Assistant Fire Chief Ritter added that there had been discussion regarding using former medical facilities as needed. The consensus of Council was to leave verbiage regarding nail and beauty salons in the Order. Hoisted confirmed the following changes: change 60 days to April 3, 2020; Council vote to cancel the Declaration; add verbiage to Section 4 related to the virus; Section 5 Council and P&Z meet in person unless changed by Council; Section 7 remove language examining and regulating hospitals and regulating ingress and egress from City; and in Section 8 reduce fine to$1,000 or 180 days in jail. Council Action A motion was made by Mayor pro tern Forrester and seconded by Councilman Porter to approve the Ordinance No. 2020-24 as amended. A vote was taken and motion passed 7-0. Councilman Porter requested that a special called meeting be set in place before the April 3 deadline. READING OF ORDINANCE Deputy City Secretary Link read the caption to Ordinance No. 2020-24 into the official record, noting the changes in the verbiage and time addition.
