04-02-2020 (City Council) Minutes Special Called �►'''� Wylie City Council CITY OF WYLIE Minutes Special Called Meeting April 2,2020—6:00 p.m. Wylie Municipal Complex—Council Chambers 300 Country Club Road, Bldg. 100 Wylie, TX 75098 CALL TO ORDER Mayor Eric Hogue called the special called meeting to order at 6:10 p.m. The following City Council members were present: Councilman David R. Duke, Councilman Matthew Porter, Mayor pro tern Jeff Forrester, Councilman Timothy T. Wallis, and Councilman David Dahl. Councilwoman Candy Arrington was absent. Staff present included: City Manager Chris Hoisted; Assistant City Manager Brent Parker; Assistant City Manager Renae 011ie; Assistant Police Chief Tommy Walters; Fire Chief Brandon Blythe; Assistant Fire Chief Brian Ritter; Finance Director Melissa Beard; Public Information Officer Craig Kelly; and City Secretary Stephanie Storm. INVOCATION&PLEDGE OF ALLEGIANCE Councilman Dahl gave the invocation and Councilman Porter led the Pledge of Allegiance. CITIZEN COMMENTS Melissa Kenfield addressed Council expressing concerns with Council voting to keep the elections in May. City Secretary Storm read aloud 36 citizen comments received via email and through the electronic citizen comment form. The comments included additional cross walks, COVID-19 questions and concerns, extending local Declaration of Disaster, streets and curbs cracking, and postponing May elections to November. Mayor Hogue convened the Council into Executive Session at 6:38 p.m. EXECUTIVE SESSION Recess into Closed Session in compliance with Section 551.001, et.seq. Texas Government Code, to wit: Sec. 551.071. CONSULTATION WITH ATTORNEY; CLOSED MEETING. A governmental body may not conduct a private consultation with its attorney except: (1)when the governmental body seeks the advice of its attorney about: Minutes April 2,2020 Wylie City Council Page 1 (A) pending or contemplated litigation; or (B) a settlement offer; or (2) on a matter in which the duty of the attorney to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with this chapter. Receive legal advice regarding response to COVID-19 emergency and Executive Order GA-14 RECONVENE INTO OPEN SESSION Take any action as a result from Executive Session. Mayor Hogue reconvened into Regular Session at 7:50 p.m. Mayor Hogue announced an emergency special called meeting will be held at 8:45 p.m. on April 2,which has been posted by the one-hour requirement. REGULAR AGENDA 1. Consider, and act upon, the adoption of an Ordinance amending Ordinance Nos. 2020-24 and 2020-25, Continuing or Renewing the Mayor's Declaration of Local Disaster for a Public Health Emergency and establishing new orders to help abate the COVID-19 public health crisis. (B. Blythe, Fire Chief) Council Action A motion was made by Councilman Porter, seconded by Mayor pro tern Forrester, to approve Ordinance No. 2020-26 amending Ordinance Nos. 2020-24 and 2020-25, Continuing or Renewing the Mayor's Declaration of Local Disaster for a Public Health Emergency and establishing new orders to help abate the COVID-19 public health crisis with the following modifications: Section 5 updated to allow City Council members and staff to attend virtually if otherwise unable to attend the meeting in person for the duration of the Order, Section 16 moved to Recommendations, Section 28 would add "facilities" after the word Park, Section 32 have the language after the word fewer in sub-letter i stricken, Section 33 the word "must" changed to "should" and moved to Recommendations, and authorize staff to prepare an Ordinance with the stated modifications and the Mayor to sign the new Ordinance. A vote was taken and motion passed 6-0 with Councilwoman Arrington absent. 2. Consider, and act upon, authorizing the Mayor and City Secretary to execute a General Election Rental Services Contract between the City of Wylie and the Collin County Elections Administrator for the May 2, 2020, General and Special Elections, including Exhibit A thereto (Cost of Services), and rescinding the Joint General and Special Election Services Contract dated March 16,2020 between the City of Wylie and the Collin County Elections Administrator. A vote was taken and motion passed 6-0 with Councilwoman Arrington absent. 3. Consider, and act upon, Resolution No. 2020-20(R) of the City Council of the City Of Wylie, Collin, Dallas and Rockwall Counties, Texas, amending Resolution No. 2020-06(R), which ordered a General Election to be held on May 2,2020, for the purpose of electing the positions of Mayor and two Council Members (Place 5 and Place 6) of the Wylie City Council, to hold office Minutes April 2,2020 Wylie City Council Page 2 for a period of three years; providing that the election is to be administered by the City of Wylie; making other necessary amendments; providing for a repealing clause. (S. Storm, City Secretary) Council Action A motion was made by Mayor pro tern Forrester, seconded by Councilman Porter, to take no action on Item 3. A vote was taken and motion passed 6-0 with Councilwoman Arrington absent. 4. Consider, and act upon, Resolution No. 2020-21(R) of the City Council of the City of Wylie, Collin, Dallas and Rockwall Counties, Texas, amending Resolution No. 2020-10(R), which ordered a Special Election to be held on May 2, 2020, for the purpose of filling a vacancy in the office of City Council, Place No. 2, resulting from the resignation of council member Matthew Porter; providing that the election is to be administered by the City of Wylie; making other necessary amendments; providing for a repealing clause. (S. Storm, City Secretary) Council Action A motion was made by Mayor pro tern Forrester, seconded by Councilman Porter, to take no action on Item 4. A vote was taken and motion passed 6-0 with Councilwoman Arrington absent. 5. Discussion regarding Fiscal Year 2019-2020 Budget. Staff Comments City Manager Hoisted addressed Council stating regarding the property tax, staff is going to assume a flat existing value with only new value being added to the tax rolls. Staff is projecting a $1 million reduction in sales tax revenue, which is $500,000 to the General Fund and $250,000 to both the 4B Fund and the WEDC Fund. With the current situation, City Management is recommending to furlough most of the part-time staff, which includes positions in the following departments: Recreation, Library, Police, Municipal Court, and Public Art. Council Comments Council direction was to absorb the staff costs and continue to pay the part-time staff for the month of April. Council expressed their support of staff.
