Commissioners present: Commissioner Joe Chandler, Commissioner Jesse Hale, Commissioner Melissa Kenfield, and Commissioner Frank Besadesky. Those absent: Commissioner Debbie Loraine, Commissioner Kirstin Dodd and Commissioner John Pugh. Minutes July 23,2020 Historic Review Page 1 CONSENT AGENDA A. Consider and act upon approval of the Minutes from the April 23,2020 Special Called Meeting. Commission Action A motion was made by Commissioner Kenfield, seconded by Chair Chandler, to approve the Minutes from the April 23, 2020 meeting. A vote was taken and the motion carried 4-0. REGULAR AGENDA A. Consider, and act upon, a recommendation to the City Council regarding a request for substantial renovations in accordance with Ordinance No.2013-17 for the remodel of an existing residential structure, located at 308 W Oak Street, Lot 6, Block 9 of the Keller's #2 Addition within the Downtown Historic District. Staff Comments Ms. 011ie stated that the applicant seeks to remodel an existing residential dwelling with updates to exterior to match"English Cabin" art style, and add 816 square feet to the west side of the house. The dwelling is currently 616 square feet, with the new addition the total structure will be 1,432 square feet. The applicant proposes to install new flooring, drywall, shake siding for the skirting and replacing the aluminum windows with vinyl windows. The roof will have a cross-gable roof design. Commissioners Discussion The Commissioners had no questions for the applicant. Commissioners Action A motion was made by Commissioner Kenfield, and seconded by Commissioner Besadesky, to recommend approval to the City Council regarding a request for substantial renovations in accordance with Ordinance No. 2013-17 for the remodel of an existing residential structure, located at 308 W Oak Street, Lot 6, Block 9 of the Keller's #2 Addition within the Downtown Historic District. Consider, and act upon, a recommendation to the City Council regarding a request for substantial renovations in accordance with Ordinance No. 2013-17 for the remodel of an existing residential structure for the purpose of enhancing accessibility, located at 301 N. Ballard Street, ( Brown House) within the Downtown Historic District. Staff Comments Ms. 011ie stated that Mr. Diaz, Parks Director will present. Mr. Diaz stated that with the partnership of Architexas and Kimley-Horn to create a plan to explore the possible uses that Minutes July 23,2020 Historic Review Page 2 would be feasible, preserve the historical integrity and become an asset to the community. The plan would be constructed in three phases. The request before the Commission is the first phase, which is to construct a ramp or a platform lift on the exterior of the building. Both ArchiTexas and Kimley-Horn provided comparison comments on a lift and a ramp. Staff is recommending a ramp due to concerns of maintenance and wear and tear of a lift. The ramp would be appealing and accommodating to those that need assistance, especially for patrons with strollers and walkers. The focus is to the south east corner which faces the downtown. Commissioners Discussion The Commissioners questioned where the handicap parking is located. Ms. Brittany Shake, Engineer for Kimley-Horn, stated there will be two ADA accessible parking spots to the south of the building, but can be shifted to have direct access to the ramp or lift. Ms. Alexis McKinney, with ArchTexas, stated that on the north side of the building,the area is larger and deeper,whereas the south side would encroach into the foundation. The purpose is to have the least amount of impact to the structure as possible, which can be accomplished on the northside. The Commissioners discussed the impact for a ramp versus the lift. Commissioner Hale stated that long term maintenance of a ramp is easier than a lift. The lift would not be visually appealing due to not aging well. Ms. 011ie recommended that if the ramp is recommended,that the motion include a stipulation that the railing match the railings on the porch unless prohibited by ADA. Commissioners Action A motion was made by Chair Chandler, and seconded by Commissioner Besadesky,to recommend approval to the City Council regarding a request for substantial renovations in accordance with Ordinance No. 2013-17 for the remodel of an existing residential structure for the purpose of enhancing accessibility, with stipulation that a ramp be constructed with railings that match the existing railings on the porch and meet ADA requirements. Sproul On April 23, 2020, the HRC recommended approval for substantial renovations to include maintaining the east facing window to keep in character with the Craftsman style home. The Owner/Applicant is now submitting for consideration modifications to the previously approved plans. The new plans indicate removal of the existing roof and rafter system and replacement with a new 8:12 slope roof, the addition of a garage with roof slope to match the main structure. The garage placement does not completely fall behind the rear edge of the main structure as required by Section 6.3.E.4.(b).(3). This is due to the odd shape of the lot and the existing main structure being setback further from the front build line. To maintain the 8:12 roof slope to match the house, the garage is 16' at its highest point, in lieu of the 14' max requirement for accessory structures. The garage does meet the rear& side setback requirements. Renovations include replacement of exterior siding as necessary to repair the exterior, repaint the entire exterior with colors from the Sherwin Williams Historic Pallette and replace window sashes with a 3 over 1 window to replace the existing 1 over 1 windows. Recommendation Direction Discussion The City Council has declared as a matter of ordinance that the preservation, protection, and use of landmarks and historic districts is a public necessity because they have a special character or a special historic, architectural, aesthetic, or cultural interest and value and thus serve as visible reminders of the history and heritage of the City of Wylie. Staff is seeking input from the HRC to draft resolutions, possible ordinances and maps that would designate such areas as "Places of Importance". The HRC shall identify and designate an area(s) in order to make a recommendation on whether it qualifies for a local landmark. The City Council, a property owner, an individual or neighborhood organization, may also request the Commission to make such a study and recommendation. The attached draft ordinance is included for review and comment. The stated purpose of the Landmark Ordinance is in accordance with Local Government Code Chapter 211, that outlines the authority of a municipality to designate places of importance. Before a structure or land can be designated as a local historic landmark, the property owner must consent, and approval by at least a three-fourths majority vote of the City Council is required. Page 1 of 1 U ' ZONING ORDINANCE SECTION 6.3 DOWNTOWN HISTORIC DISTRICT(DTH) 7. Landmarks Purpose: In accordance with Section 11 of Ordinance 2013-17, and Local Government Code Chapter 211, Section 211.0165 Designation of Historic Landmark, and as amended, the Commission shall have the authority to recommend historic landmarks that have local importance. a. Designation of Historic Landmark (1) A municipality that has established a process for designating places or areas of historical, cultural, or architectural importance and significance through the adoption of zoning regulations or zoning district boundaries may not designate a property as a local historic landmark unless: (a) the owner of the property consents to the designation; and (b) the designation is approved by three-fourths vote of the governing body of the municipality; after a recommendation of approval from the historical commission. (2) If the property is owned by an organization that qualifies as a religious organization under Section 11.20, Tax Code, the municipality may designate the property as a local historic landmark only if the organization consents to the designation. (3) The municipality must provide the property owner a statement that describes the impact that a historic designation of the owner's property may have on the owner and the owner's property. The municipality must provide the statement to the owner not later than the 15th day before the date of the initial hearing on the historic designation of the property. (4) The historic designation impact statement must include lists of the: (a) regulations that may be applied to any structure on the property after the designation; (b) procedures for the designation; (c) tax benefits that may be applied to the property after the designation; and (d) rehabilitation or repair programs that the municipality offers for a property designated as historic. (e) The municipality must allow an owner to withdraw consent at any time during the designation process. b. Historical information should include: (1) List any historical figures associated with the property. (2) Provide names and any known occupants of the property. (3) Legal description of the property with a location map (4) A narrative explanation of the chronological and historical development of the property. (5) Provide a sketch of the current site plan. Include the proposed location of the historic plaque. U ' ZONING ORDINANCE (6) Provide any additional information that supports the application. This may include copies of architectural drawings, letters, oral histories, newspaper/magazine articles, etc. c. References Attach a list of the books, articles, Sanborn MapsTM, newspapers, and other sources used in preparing this form. 8. Certificate of appropriateness review. (a) A certificate of appropriateness for routine maintenance shall be issued by the Historic Review Commission once final approval is given by City Council.. (b) No building permit shall be issued to any applicant by the building inspection department unless the application has first been reviewed by the Historic Review Commission (HRC) and City Council and a certificate of appropriateness has been issued by the commission. (c) When applying for such a permit or site plan approval, the applicant shall comply with all necessary requirements as defined by the building inspection or planning departments, who shall forward such application to the HRC at its next responsible meeting. (d) Upon review of the application, the commission shall determine whether the proposed work is of a nature which will adversely affect any historical, architectural, archaeological, or cultural feature of the Downtown Historic District, and whether such work is appropriate and consistent with the spirit and intent of this article and the designating ordinance. The commission shall recommend denial, or approval of a certificate of appropriateness and forward such action to the City Council for final approval. Upon final approval from the City Council, the applicant shall be issued a COA within ten (10)business days of the last regular meeting of the historic commission. The building inspection department shall immediately notify the applicant of the commission's action. If the commission has denied the certificate of appropriateness, the applicant may file in writing a notice of appeal to the city council with the city secretary within ten (10)business days after receiving notice from the building inspection department. The city secretary shall place the appeal on the city council agenda for a hearing, and the applicant shall be notified by the city secretary of the date of the hearing. The city council utilizing the above criteria, shall deny, with or without prejudice, or approve a certificate of appropriateness. (e) If no action has been taken by the commission within sixty (60)business days of original receipt by the building inspection department or planning department, the building permit shall be issued by the building inspection department or the planning department shall continue the review of the application. U ' ZONING ORDINANCE (f) No change shall be made in the application for any building permit after issuance of a certificate of appropriateness without resubmittal to the commission and approval thereof in the same manner as provided in subsection (c) of this section. (g) After a decision is reached by the commission denying, with prejudice, an application for certificate of appropriateness, where no appeal is made to the city council, a resubmittal of application will not be accepted for additional hearing within a twelve-month period from the date of final decision except upon written request by the applicant, indicating the incorporation of changes in plans and specifications to the original application as recommended by the commission. Denial of a certificate of appropriateness without prejudice permits reapplication immediately. (h) Each certificate of appropriateness issued pursuant to this section shall expire and be void after one (1)year unless construction/alteration has begun and is substantially completed (eighty (80)percent). Requests for extensions should be addressed to the Historic Review Commission prior to the date of expiration and should include the following: a. Reason for requesting the extension; b. A timetable for starting and completing work; and c. Information regarding work completed, work still to be done, and any amendments requested to the work as originally proposed. If there are no amendments to the originally proposed work, extensions may be granted by the Historic Review Commission for any time period up to one (1)year provided no combination of extensions exceeds a total of one (1)year from the original expiration date. Failure to complete the work within the required time, including any extension, may result in the revocation of the certificate of appropriateness. The holder of an expired certificate of appropriateness or a certificate of appropriateness that the City Planner or his/her designee finds inappropriate to extend may appeal the request for extension to the Historic Review Commission. The requested extension shall be scheduled to be heard at the next public meeting. (i) An applicant may request a preliminary certificate of appropriateness (PCA) at any stage of the design process. The PCA process is generally applied to proposed new construction and/or significant renovation or restoration projects. The application may include, but is not limited to, the following: 1. Site layout—A dimensional scale drawing showing lot lines, street(s), buildings (existing and proposed), setbacks, driveways, parking areas, and other information necessary to define the layout of the property. 2. Plans—Dimensioned scale drawings showing the layout of proposed new construction and the existing building if the new construction is to be an addition. U ' ZONING ORDINANCE 3. Elevations—Dimensioned scale drawings showing each side of the proposed new construction and existing building if the new construction is to be an addition. 4. Sketches—Artistic drawings or renderings illustrating the proposed changes and/or new construction. Sketches may be substituted for elevations for purposes of PCA approval. 5. Illustrations—Conceptual drawings or sketches for elements such as doors, windows, architectural elements, and other elements as they are available in the design process. 6. [Photographs.]—Photographs of existing buildings and/or examples of architectural elements to be incorporated into the design. 7. [Other materials.]—Other materials deemed necessary by the Historic Review Commission for adequate review. A complete, detailed set of drawings is not necessary. The review will be based on the concept only. Review should include form, scale, massing, general architectural design and compatibility with the character of the historic district or landmark. The commission may approve, approve with stipulations, deny or deny without prejudice all or part of the PCA. Upon approval, the applicant may continue design work on the basis of the approval, considering any stipulations. Approval of a PCA by the historic commission shall constitute authorization by the city for the applicant to submit an application for a final CA provided that the final submittal conforms to the PCA and any stipulations attached to its approval. As long as the PCA remains valid, elements of the project specifically approved in the PCA, including the site layout, remain fixed, except as to permit minor adjustments resulting from subsequent architectural or engineering improvements or to prevent a condition affecting public health or safety which was not known at the time of PCA approval. A PCA may not be used to approve an exception to development regulations. Where an approved plan conflicts with an adopted regulation and no variance or exception is expressly approved, the regulation shall apply. A partial building permit may be issued on the basis of the approval and work may begin only on the portion of the project specifically approved by the commission in the PCA (e.g. site layout). A final certificate of appropriateness (CA) must be obtained for work to progress beyond the scope of the PCA approval and before the project is completed. (j) Approval of a preliminary certificate of appropriateness or a certificate of appropriateness, including the site layout, shall not be deemed as conforming to the U ' ZONING ORDINANCE requirements for concept plan, preliminary site plan and site plan approval in the zoning ordinance. Likewise, approval of such plans by the planning and zoning commission does not waive the CA approval requirement by the historic commission. (k) The historic commission may establish a date of expiration for each PCA or CA at the time of its approval. (1) The Historic Review Commission may delegate to the City Planner or his/her designee the authority to issue certificates of appropriateness on minor changes to the exterior of an existing structure where the commission has approved criteria for making determinations on certain matters and where the parameters under which those criteria may be utilized are clearly established by the commission. All denials made by Historic Review Commission shall be deemed as without prejudice and reapply within one (1)year. The applicant may appeal the decision of the City Planner or his/her designee to the Historic Review Commission by filing a written request with the Planning Department within ten (10)working days of the receipt of a written notice of the action taken by the City Planner or his/her designee. The Planning Department shall schedule the appeal for the next available historic commission meeting. Matters upon which the historic commission may delegate the authority to issue certificates of appropriateness may include, but are not necessarily limited to the following: (1) Colors for painting the exterior of a structure including siding, trim, doors, steps, porches, railings, and window frames (does not include painting or otherwise coating previously unpainted masonry); (2) The placement and screening, if necessary, of mechanical units of various types; (3) The placement and design of screening treatments for trash and recycling receptacles on commercial properties; (4) Privacy fences and semi-privacy fences to be installed in the rear and/or side yard; (5) Ground lighting; (6) Accessories attached to a facade of any building, garage or carriage house including mailboxes or incandescent light fixtures; (7) Repairing or replacing non-historic roof materials with that of a different type or color; (8) Installation of handicap ramps; (9) Replacement of historic windows and doors when deteriorated beyond repair and provided the replacement matches the original in dimension, material and style; and U ' ZONING ORDINANCE (10) Exterior storm windows and doors, provided: no alteration to the opening is required; they are not attached to and do not cover any exterior trim and they are prefinished or painted.
