zoned Agricultural. The reason for the requested rezoning to a Planned Development is to allow for an age
restricted mixed-use senior residential community.The Planned Development contains three subdistricts that
are proposed to contain different categories of residential development for senior living.

3. Consider, and act upon, the appointment of a board member to the North Texas Municipal
Water District (NTMWD) Board to fill an expired term of June 1, 2020 to May 31, 2022. (S.

Executive Summary
The Board of Directors of the North Texas Municipal Water District is a policy making body similar in nature
to the City Council. The Board is responsible to both the State of Texas and to the member Cities for assuring
that NTMWD operations occur in accordance with state and federal law,in alignment with NTMWD policy,
and in the best interests of the Cities receiving services.
4. Consider, and act upon, Ordinance No. 2020-28 amending Ordinance No. 2019-27, which
established the budget for fiscal year 2019-2020; providing for repealing, savings and
severability clauses; and providing for an effective date of this ordinance. (M. Beard, Finance

Executive Summary
The mid-year budget amendments are generally intended to cover unanticipated and/or unavoidable revenue
and expenditure adjustments to the adopted budget. The detail is attached in Exhibit A for the requested items
which are located within the General Fund, Utility Fund and WEDC. The requests are further defined as
neutral(matching revenues to expenditures),revenue increases or expenditure increases. Salary and benefits
savings from the first half of the fiscal year are included in the amendment in the amount of$534,967.

CALL TO ORDER
Mayor Eric Hogue called the special called meeting to order at 4:00 p.m. The following City Council
members were present: Councilman David R. Duke, Mayor pro tern Jeff Forrester, Councilman Matthew
Porter, Councilwoman Candy Arrington, Councilman Timothy T. Wallis, and Councilman David Dahl (4:05
p.m.).
Staff present included: City Manager Chris Holsted; Assistant City Manager Brent Parker; Assistant Police
Chief Tommy Walters; Public Information Officer Craig Kelly; Fire Chief Brandon Blythe; Assistant Fire
Chief Brian Ritter; Planning Manager Jasen Haskins; and Deputy City Secretary Tina Link.

1. Consider, and act upon, Ordinance No. 2020-24 Continuing or Renewing the Mayor's
Declaration of Local Disaster for a Public Health Emergency. (B. Blythe, Fire Chief)
Staff Comments
City Manager Holsted spoke to Council regarding the amended Order from Dallas County. The City would
like to match the Dallas County Order, which is the most stringent right now. Wylie is comprised of three
counties so there is some confusion about which Order the citizens would follow. The Order with the most
stringent guidelines would be followed, but the desire is to match theirs as closely as possible to eliminate
any confusion.

Council Comments
Councilman Porter asked whether, since Wylie is comprised of three counties, the Dallas statutes apply to
the whole City or only the portion within Dallas County limits, and the Collin County policies apply to the
portion within Collin County. He asked whether, if Collin County's policies do not match those of Dallas
County, the City is required to put Collin's in place or would those restrictions apply only to subdivisions
located in Dallas County, and would that supersede the City Ordinance. Hoisted replied that if a county
adopts an Order that is more stringent than ours, then it would apply to the city limits of that county. Mayor
pro tern Forrester commented that he would like to see the verbiage changed in the City's new Ordinance to
reflect the timeline to read April 3, 2020 rather than 60 days and that it takes Council to terminate the
disaster declaration. The consensus of Council was to make the two changes suggested.
Councilwoman Arrington said that, although Wylie's small businesses were one of the reasons she relocated
here, she is more concerned with the health of the citizens during the pandemic and supports closure of the
designated businesses so that life can return to normal sooner. Councilman Dahl and Forrester recommended
allowing laundromats to stay open. Councilman Wallis expressed his desire for healthcare operations to
remain open.
Porter and Forrester asked some questions on Section 3 regarding employees continuing to be paid while not
at work. Hoisted commented employees who can work from home will log in as usual; if they are choosing
to stay home, they will use their own sick or vacation time; on-site staff will be reduced to those performing
essential functions; and part-time staff will be used as much as possible to perform other duties as needed.
Porter asked about adding language to Section 4 regarding purchases related directly to the disaster. Porter
stated he would like to see Council and the Planning and Zoning Commission to continue to meet in person.
Council recommended keeping the fines in line with the Governor's Order. Porter and Forrester asked if
verbiage could be added to specify that hospital buildings be used only with county, state or federal
guidance. Fire Chief Blythe stated that there is the old hospital facility on Highway 78 that could be utilized
as needed. Assistant Fire Chief Ritter added that there had been discussion regarding using former medical
facilities as needed.
The consensus of Council was to leave verbiage regarding nail and beauty salons in the Order.
Holsted confirmed the following changes: change 60 days to April 3, 2020; Council vote to cancel the
Declaration; add verbiage to Section 4 related to the virus; Section 5 Council and P&Z meet in person unless
changed by Council; Section 7 remove language examining and regulating hospitals and regulating ingress
and egress from City; and in Section 8 reduce fine to $1,000 or 180 days in jail.
Council Action
A motion was made by Mayor pro tern Forrester and seconded by Councilman Porter to approve the
Ordinance No.2020-24 as amended. A vote was taken and motion passed 7-0.
Councilman Porter requested that a special called meeting be set in place before the April 3 deadline.

Staff Comments
Planning Manager Haskins addressed Council stating that the purpose of the Planned Development (PD) is
for townhomes and for mixed-use residential and commercial. There are a few changes from the previous
PD, but most of the information is the same. It would allow for 34 townhomes on Tract 1 and then 230,000
square feet. of commercial and multi-family development on Tract 2-5. Haskins reported construction will be
masonry; shared parking on tracts 2-5; applicant is asking for 15% reduction of per-use parking; and a
pedestrian bridge is proposed over Maxwell Creek.
Haskins reported no responses were received from the notifications mailed out, and the Planning and Zoning
Commission voted 4-2 because of concerns over the project getting finished in time.
Council Comments
Councilman Porter asked if the changes that were made are included in the current motion. Haskins reported
they are located in the PD. Councilman Dahl inquired as to the plat for the townhomes not going through
until the commercial is built. Haskins replied that is located in the first paragraph of Section 1.1
Development Schedule. Porter asked whether,if it should not be completed,the zoning would be in place for
any future developer. Haskins responded that the zoning would remain in effect for any developer. Porter
questioned Mr. Branch regarding information on utility easements.

Applicant Comments
Chuck Branch, representing Daydra Management LLC, addressed Council stating that their engineers have
worked with TxDOT, discussed the ROW, and would next require a Utility Installment Review to be
submitted. Forrester asked Branch if they would be going along or under Highway 78 to tie in with the City.
Branch responded they would go along Highway 78. Branch he had received letters of intent of several
tenants who are expressing interest in the development.
Public Hearing
Mayor Hogue opened the public hearing on Item 1 at 6:21 p.m. asking anyone present wishing to address
Council to come forward.
No one came forward for the public hearing.
Mayor Hogue closed the public hearing at 6:22 p.m.
Council Action
A motion was made by Councilman Porter and seconded by Mayor pro tern Forrester to approve a change
of zoning from Agricultural (AG), Light Industrial (LI) and Multifamily (MF) to Planned Development
(PD), to allow for a mixed-use master planned community on 20.433 acres, located from 2535-2701 S. SH
78. (ZC 2020-03).A vote was taken and the motion passed 6-1 with Mayor Hogue voting against.

amendment to Ordinance No. 2020-24 Declaration of Disaster by striking the jail term of 180 days from
Section 8. A vote was taken and the motion passed 7-0.

Citizen Comments
Justin Dumlao and Melissa Kenfield submitted citizen comment forms that Mayor Hogue read aloud
requesting Council reschedule the general and special elections to November to protect voters' and election
workers' health.
Staff Comments
City Manager Holsted stated the City reached out to the Secretary of State for clarification regarding the
elections, and they responded that if our general election had any opposed at-large races, then the City
cannot cancel any part of the general election, and the unopposed candidates for that general election will
still need to remain on the ballot and will have to receive at least one vote to be elected to the office. If the
City is postponing the election until November (which they strongly recommend that the City do), then the
City must wait until after the November election has been canvassed to swear in those officers, including the
unopposed candidates. If the City postpones the election until November,then the officers that currently hold
those positions will continue to serve in those positions until the new officers are sworn in after the
November election.
City Secretary Storm shared information regarding other cities and how they were handling their May
elections.
Council Comments
Councilwoman Arrington stated she believed the best interest of the City is that the current council stay in
place and would like to see the elections moved to November. Forrester stated that rescheduling the special
election, which has a 120-day requirement, would be a violation of the state Constitution and would
therefore not be permissible or acceptable. Forrester stated Governor Abbott's order cannot override the
Constitution and a change that would violate Article 11 of the Constitution would render the City into the
purview of the Supreme Court of Texas; therefore, he cannot support moving the special election to
November. Forrester stated with the support of the County election official the election can be held safely.
Porter reviewed information from a discussion with the Collin County elections official regarding election
judges, ballots and supplies for ballots by mail, sanitizing supplies, and information on an election machine
technician.
Staff Comments
Holsted stated there is a long list of items that would need to be figured out in order to hold a May election,
and the City does not know what changes may occur between now and May. Storm reviewed important dates
and deadlines regarding holding a May election.
Council Comments
Forrester stated Collin and Dallas Counties and City of Wylie Orders end four weeks prior to Election Day
and asked Holsted if he sees the Orders being extended beyond the election period. Hogue responded it
depends on what the virus is going to do; it is unknown. Holsted replied the positives are increasing and he
was unsure on how far into the future the Orders would be extended. Forrester stated we can offer as much
personal protection that we can offer and it is important to protect the citizens; however, this is a

Constitutional requirement. Porter stated at this point, with the data and limited knowledge, and with the
requirements of the state Constitution, the choice should always be to uphold the Constitution if at all
possible. Porter suggested preparing for the worst-case scenario of holding it and hope that we get to a
position where guidelines and recommendations are changed before the election, and that it is critical to
reach out to the citizens and let them know that anyone who is sick or is 65 years of age can still request a
ballot by mail and vote from their car.

A motion was made by Mayor pro tern Forrester and seconded by Councilman Porter to deny Resolution
No. 2020-19(R) Postponing to the November 3, 2020 Uniform Election Date the General and Special
Elections Scheduled to be held on May 2, 2020, for the purpose of electing persons to the Offices of Mayor
and Councilmembers for Places 5 And 6 and the remaining term for Place 2 in response to the Covid-19
Pandemic and Public Health Emergency; Designating Polling Places; Authorizing Execution of Joint
Election Contract for the November 3, 2020 Election; and take all other appropriate action. A vote was
taken and the motion passed 4-3 with Mayor Hogue, Councilman Dahl, and Councilwoman Arrington
voting against.

extending local Declaration of Disaster, streets and curbs cracking, and postponing May elections to
November.

2. Consider, and act upon, authorizing the Mayor and City Secretary to execute a General Election

5. Discussion regarding Fiscal Year 2019-2020 Budget.
Staff Comments
City Manager Hoisted addressed Council stating regarding the property tax, staff is going to assume a flat
existing value with only new value being added to the tax rolls. Staff is projecting a $1 million reduction in
sales tax revenue, which is $500,000 to the General Fund and$250,000 to both the 4B Fund and the WEDC
Fund. With the current situation, City Management is recommending to furlough most of the part-time staff,
which includes positions in the following departments: Recreation, Library, Police, Municipal Court, and
Public Art.
Council Comments
Council direction was to absorb the staff costs and continue to pay the part-time staff for the month of April.
Council expressed their support of staff.

Council Comments
Councilmen Porter, Wallis, and Duke stated in light of the changes that have come out in the last few days,
including statements from the Secretary of State and the court case with the City of Anna,their opinions had
changed regarding holding the election in May. They noted that there is now court precedence on the issue as
well as overriding directives that the Governor of Texas issued in an Executive Order since Council last
discussed this matter. The Governor's directives, which now carry forward through April 30 rather than
April 3, as was the case was when Council last met, may preclude individuals' ability to come forward and

The applicant is seeking approval to construct a two-story office/retail building,3,868 square feet.The property was platted
in the 1940s -50s as Keller's First Addition and part of the Original Town of Wylie. A single story wood frame structure
occupies the adjacent lot and is an office use.The applicant desires to combine the two lots into a single lot in order to better
utilize the property and have sufficient setbacks.
If approved,the applicant will submit a replat to combine the lots and share parking between the establishments. There are
currently five parking spaces on the adjacent lot. The proposal will add nine spaces to the rear and three tandem spaces
along the southern property line. Access will be one-way ingress and one-way egress.
The building will be placed 6' from the front property line,and a 6' sidewalk will be installed.The primary exterior materials
shall be face brick,with contrasting color for accent brick. The east elevation(rear)will have hardie-siding accent material
at the cornice. The highest point of the structure will be 28'-9". There will be a rear ramp into the structure as well as an
elevator.
The applicant anticipates a finish date of December 2020.

Discussion
Staff budgeted and planned for a professional pavement assessment for this fiscal year to provide a proactive approach
to reviewing the condition of the City's roadway network. The assessment uses a Pavement Condition Index to evaluate
surface and subsurface distresses by collecting data through visual and mechanical means. Utilizing the index value as
the basis for pavement-related decisions will allow the City to build a quantifiable and repeatable process for planning
annual pavement maintenance preservation project funding.
Staff utilized the North Central Texas Council of Government cooperative purchasing program (SHARE) for this
purchase. After reviewing four contracted companies, staff determined that Data Transfer Solutions LLC provided the
most comprehensive approach to reviewing and reporting on the condition of the City's roads.
The City is authorized to purchase from a cooperative purchasing program with another local government or a local
cooperative organization pursuant to Chapter 791 of the Texas Government Code and Section 271 Subchapter F of the
Local Government Code; and by doing so satisfies any State Law requiring local governments to seek competitive bids
for items.

$50,000,which initiated the bid process. Staff released a bid and received two responses,which were evaluated according

Staff recommends the award of bid#W2020-34-A for Pest Control Services to Daniel Services Inc.d.b.a.All Pest Control
as providing the best overall value.Year one(1)of the service includes initial termite treatment at the Municipal Complex
($14,300), as well as base services for all City facilities ($33,000), and additional money set aside for special treatments
and/or special events for an estimated total of$52,000. Annual expenditures for years 2-4 are estimated at$42,000.
This award will establish an annual contract with three(3)City optional renewals, for a total four(4)year term.

Zoning Case 2020-03 requires an Ordinance to amend the zoning accordingly in the Official Zoning map of the City; and
providing a penalty clause,a repeal clause, a savings clause,a severability clause, and an effective date.
The subject ordinance allows for the rezoning of 20.433 acres of property located from 2535-2701 South SH 78 from
Agricultural (AG), Light Industrial (LI) and Multifamily (MF) to Planned Development (PD). Exhibit A (Legal
Description),Exhibit B (PD Conditions), and Exhibit C (Zoning Exhibits)are included and made a part of this Ordinance.
The above described property shall be used only in the manner and for the purposes provided for in the Comprehensive

AMENDING THE COMPREHENSIVE ZONING
ORDINANCE OF THE CITY OF WYLIE,AS HERETOFORE
AMENDED, SO AS TO CHANGE THE ZONING ON THE
HEREINAFTER DESCRIBED PROPERTY, ZONING CASE
NUMBER 2020-03, FROM AGRICULTURAL (AG), LIGHT
INDUSTRIAL (LI), AND MULTIFAMILY (MF) TO
PLANNED DEVELOPMENT (PD), TO ALLOW FOR A
MIXED USE MASTER PLANNED COMMUNITY;
PROVIDING FOR A PENALTY FOR THE VIOLATION OF
THIS ORDINANCE; PROVIDING FOR THE REPEAL OF
ALL ORDINANCES IN CONFLICT; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS,the Planning and Zoning Commission and the governing body of the City of
Wylie, Texas, in compliance with the laws of the State of Texas with reference to the amendment
of the Comprehensive Zoning Ordinance, have given the requisite notices by publication and
otherwise, and after holding due hearings and affording a full and fair hearing to all property
owners generally and to owners of the affected property, the governing body of the City is of the
opinion and finds that the Comprehensive Zoning Ordinance and Map should be amended;
NOW,THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WYLIE, TEXAS:
SECTION 1: That the Comprehensive Zoning Ordinance of the City of Wylie, Texas, be,
and the same is hereby, amended by amending the Zoning Map of the City of Wylie, to give the
hereinafter described property a new zoning classification of Planned Development (PD), said
property being described in Exhibit A (Legal Description), hereto and made a part hereof for all
purposes.
SECTION 2: That Planned Development Conditions and a Zoning Exhibit are an integral
component of the development of the property and are attached as Exhibits B and C, respectively.
SECTION 3: That all ordinances of the City in conflict with the provisions of this
ordinance be, and the same are hereby,repealed and all other ordinances of the City not in conflict
with the provisions of this ordinance shall remain in full force and effect.
SECTION 4: That the above described property shall be used only in the manner and for
the purposes provided for in the Comprehensive Zoning Ordinance of the City, as amended herein
by the granting of this zoning classification.
SECTION 5: Any person, firm or corporation violating any of the provisions of this
ordinance or the Comprehensive Zoning Ordinance, as amended hereby, commits an unlawful act
and shall be subject to the general penalty provisions of Section 1.5 of the Zoning Ordinance, as
the same now exists or is hereafter amended.

SECTION 6: Should any paragraph, sentence, subdivision, clause, phrase or section of
this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not
affect the validity of this ordinance as a whole or any part or provision thereof, other than the part
so declared to be invalid, illegal or unconstitutional, and shall not affect the validity of the
Comprehensive Zoning Ordinance as a whole.
SECTION 7: This ordinance shall be in full force and effect from and after its adoption by
the City Council and publication of its caption as the law and the City Charter provide in such
cases.
SECTION 8: The repeal of any ordinance, or parts thereof, by the enactment of this
Ordinance, shall not be construed as abandoning any action now pending under or by virtue of
such ordinance; nor shall it have the effect of discontinuing, abating, modifying or altering any
penalty accruing or to accrue, nor as effecting any rights of the municipality under any section or
provisions of any ordinances at the time of passage of this ordinance.

Planned Development District
Development Standards
(Zoning Case 2020-03)
1.0 Purpose:
The purpose of this Planned Development is to provide the appropriate development standards
and controls to allow a residential development on Tract 1 and a mixed-use development on Tracts 2-5, in
line with the approved Development Agreement and shown in the included Zoning Exhibits.
Unless expressly stated otherwise within this Planned Development,Development Agreement,or
Annexation Services agreement, or their exhibits,all development shall be subject to all applicable
Zoning and City Ordinances and/or design standards.
1.1 Development Schedule:
The owner of Tracts 2&3 and the owner of Tracts 4&5 shall complete or cause completion of
construction of at least Forty-Thousand(40,000) square feet of commercial/retail/office/residential space
(of which no less than 20,000 square feet of commercial/retail space and no less than 10,000 square feet
of office space), and all necessary infrastructure, on any of Tracts 2, 3,4, or 5 and obtain from the City of
Wylie all corresponding certificates of occupancy prior to receiving final inspections or certificates of
occupancy for any building on Tract 1.
Necessary infrastructure shall include,but may not be limited to; required utilities, access drives,
fire lanes,parking, landscaping, signage, and a completed perimeter sidewalk, including a pedestrian
bridge per Zoning Exhibits A and D, along State Highway 78.
The development schedule shall generally adhere to the schedule provided as Exhibit B. The
applicable sections of the Texas Local Government Code and other Texas State law shall govern the
expiration of plats,plans, or inactive permits.
2.0 Residential Townhome Standards: Unless included herein (Section 2 and 3) or attached zoning
exhibit,Tract 1 design standards shall follow the requirements of Article 3,Residential District Regulations,
and Figure 3-5 (Townhouse District)of the September 2019 City of Wylie Zoning Ordinance.

3.0 Residential Townhome Standards:
3.1 Allowed Uses:
a. The only allowed uses,as defined in the September 2019 City of Wylie Zoning Ordinance,
on Tract 1 are:
i. Single Family Dwelling,Attached
ii. Community Park(Public)
iii. Neighborhood Park or Playground
iv. By Special Use Permit—any use required by local, state, or federal law.
3.2 Site Plans and Plats
a. Upon approval of zoning, the developer will submit a plat for the property in accordance
with the City of Wylie's Subdivision Regulations.
b. A landscape plan shall be provided in conjunction with the preliminary plat.The landscape
plan shall require City approval including open space approval by the City of Wylie Park
Board.. The plan shall comprehensively address edge treatments,perimeter screening,and
individual townhouse landscape design. The Developer shall coordinate with the City on
the selection of type, style location, and size of all landscape improvements, including but
not limited to plants,trees,mulch,irrigation, and benches.
c. Concurrent with the above submittals for Tract 1,the developer shall submit a preliminary
plat and site plan, in accordance with the City of Wylie's Zoning Ordinance, for such lots
on Tracts 2, 3,4, and/or 5 that meet the requirements of Section 1.1 of this Exhibit.
3.3 Architectural Design Standards Tract 1:
a. All townhome units in Tract 1 shall have 100 percent of each façade comprised of masonry and
shall conform to the exterior design appearance of Exhibit E.
b. Masonry shall include brick, stone or masonry stucco.
c. EIFS may be used as an accent material and comprise no more than 15 percent of any façade.
d. Roofing Materials shall be architectural grade overlap architectural shingles, metal, or
composite Spanish roof tile and other roof appearances shall be painted to match the color of
the roof.
3.4 The maximum number of townhomes in The District Townhome Community(Tract 1) shall be 34
Townhomes or approximately 8.2 Townhomes per gross acre.
3.5 A masonry and wrought iron perimeter screen shall be provided along the property adjacent to State
Highway 78 as generally shown on Exhibit F.
3.6 Entry Features: Architectural features shall be stone, brick, and wrought iron screening wall
monuments.
3.7 Signage at Community Entrance: Illuminated community identification shall be incorporated into
a stone screening wall or monument at the Community entrance. The sign shall be illuminated by
means other than streetlights.Landscaping and upright towers for the Community entrance Signage
shall be constructed to generally conform to those shown in Exhibit F.
3.8 Sidewalk Locations: Five-foot sidewalks shall be provided within the property. Primary walkway
paving shall be enhanced using earth-tone colored concrete (stain mixed, not applied after),
stamped/pattern concrete,aggregate or brick/paver stone at a minimum of 7.5 feet every 75 feet.
3.9 Sidewalk Lighting: Decorative street pole lighting shall be provided throughout the Community.
The Developer shall pay for the installation including electrical connections. Operation and
maintenance shall transfer to the HOA thereafter.
3.10 Mailboxes: Shall be located in a dedicated area as required by the United States Postal
Service. Mailboxes shall be of a uniform style selected by the Developer and shall be stylistically
consistent with the The District Townhomes Community.
3.11 A minimum of 15% of the land within the District Townhome shall be used as Open Space as
shown on Exhibit A.
a. The swimming pool/grill open space area will be owned and maintained by the
homeowners' association(the HOA).
b. All open spaces within the Community with the exception of the swimming pool area shall
be accessible to the public.
3.12 Public open spaces shall be dedicated by plat to the City of Wylie in accordance with City's
Subdivision Regulations.
3.13 Maintenance of the Open Space Area:
Maintenance of the open space area will be the responsibility of the Developer until it is turned
over to the Homeowners Association(HOA).
Developer will be the contact entity with the City for all concerns regarding the maintenance of
open space until 100%of HOA control is turned over to the homeowners.
A. Developer/HOA typical maintenance and responsibilities of amenities include but are not
limited to:
a. Clean up and litter removal.
b. Landscaping installation,care,and maintenance.
c. Trimming, clearing, and removal of unwanted vegetation as determined by the City Parks
Department or Code Enforcement.
d. Maintain irrigation system, pay for the water used in the system and test all backflow
devices annually as per City requirements.
3.14 Water and sanitary sewer will be extended by the Developer to the site, per the Annexation
Services Agreement (City of Wylie Ordinance 2020-17) and to Texas Department of
Transportation and/or City of Wylie standards.
3.15 Minimum drive concrete pavement specifications shall be: six(6") inches of concrete, 3,600 psi,
with#3 rebar at 18-inch center to center, except in required fire lanes which shall be built to fire
code or city engineering standards.
3.16 Exteriors shall have contrasting colors to achieve an architecturally enhanced appearance. Trim
shall be painted one color and a side surface and garage doors shall be painted or stained a second
color.
3.17 Roof pitches shall be a maximum of 6:12 for main gables and hips. Dormer roofs and roofs over
porches may have a lesser pitch.
3.18 Roofing materials shall be architectural grade overlap architectural shingles,metal,or composite
Spanish roof tile and other roof appearances shall match the color of the roof.
3.19 Garage doors shall be carriage style in appearance.This requirement shall be accomplished with
the following:
a. Garage door panels shall be wood clad or have the appearance of wood.
b. Decorative hardware shall be attached to the garage doors. Such hardware shall include handles
and hinges in a complementary color.
3.20 Landscaping: Sodded front yards must be provided with a minimum of one - three-inch caliper
trees. Landscaping shall also be provided along the primary walkway to any home. When
automated, subsurface irrigation systems are provided, rain sensors shall be installed and
operational.
3.21 Energy: All homes shall comply with the then-current ICC Energy Code adopted by the City
(including all local amendments).
3.22 Lighting:
a. Entrances to homes and garage doors shall be illuminated.
b. Lighted house number plaques shall be provided on the front of all homes.
c. The color and shape of lighting hardware must be compatible with other building hardware.
d. Lighting must be uniformly spaced.
e. Lighting must be integrated with other accents and reveals.
f. Specialty lighting shall be coordinated with predominate architectural features.
g. Lighting fixtures along rights-of-way must be spaced to avoid conflicts with tree plantings. The
heights of lighting fixtures must also avoid conflicts with tree plantings.
4.0 Commercial Design Standards-Unless included herein(Section 4 and 5)or attached zoning exhibit,
Tracts 2-5 design standards shall follow the requirements of Article 4 (Non-Residential District
Regulations), Figure 4-2 (Community Retail District), and Article 5 (regarding allowed uses and required
parking) of the September 2019 City of Wylie Zoning Ordinance.

5.0 Commercial Retail Standards:
5.1 Allowed Uses:
a. All uses listed in the Community Retail Zoning District as by-right uses, as defined in the
September 2019 City of Wylie Zoning Ordinance, are allowed on Tracts 2,3,4, and 5
except:
i. Commercial Greenhouse
ii. Hospital
iii. Financial Institution,Alternative
iv. Automobile Rental
b. All the uses listed below are included as allowed by-right uses:
i. School,Business
ii. School,Technical or Trade
iii. Used Merchandise/Resale Shop/Consignment/Thrift Store
iv. Printing and Publishing
v. Office Showroom/Warehouse
c. All other proposed uses are strictly prohibited without the approval of a Special Use Permit,
unless required by local, state, or federal law.
5.2 Site Plans and Plats
a. Upon approval of zoning, the developer will submit plats for the property(ies) in
accordance with the City of Wylie's Subdivision Regulations.
b. Concurrent with preliminary plat submittal, the developer shall submit a site plan, in
accordance with the City of Wylie's Zoning Ordinance, for such lots that meet the
requirements of Section 1.1 of this Exhibit.
5.3 Architectural Design Standards Tracts 2,3,4 & 5
a. Primary front façade materials shall be a minimum of 80 percent masonry product with at
least 20 percent stone on the front façade.
b. Approved primary masonry materials include,brick, stone, masonry stucco, or decorative
concrete.
c. Up to 20 percent of the front facades may be stucco with decorative accents such as
cementitious fiberboard and metal trims.
d. The remaining three facades shall be a minimum of 60 percent brick or stone,and up to 40
percent may be stucco with decorative accents such as cementitious fiberboard and metal
trims.
e. EIFS shall not be considered acceptable primary exterior material but shall be accepted
when applied as accent or architectural features and shall not exceed 15% of any façade
face.
f. To achieve façade articulation,visual variety and/or architectural detailing buildings shall
use two complementary primary façade materials.
g. Composite Spanish roof tile with a 30 to 50-year warranty must be used on visible roofing,
or a similar product.
h. The exterior design appearance of all buildings in Tracts 2,3,4 & 5 shall conform to the
appearance of Exhibit C.
5.4 The Development will be a private development with public access with Property Owners
Association maintained improvements and floodplain.
5.5 Public open spaces shall be dedicated by plat to the City of Wylie in accordance with City's

a. Due to the mixed-use and interconnected nature of the development, parking shall be
shared across Tracts 2 &3 and Tracts 4 &5. per Exhibit D.
b. Parking will be provided per use at a 15%reduction from typical requirements as provided
in the City of Wylie Zoning Ordinance.
c. At no time will temporary parking be allowed in any uncompleted area of the development.
There shall be adequate required permanent concrete parking for each use before a
certificate of occupancy is issued, in the case a single use and tenant occupies an entire
building, or before a building permit for `finish out' is issued in the case of a multi-use /
tenant shell building.
5.8 Lighting:
a. The color and shape of lighting hardware must be compatible with other building hardware.
b. Lighting must be uniformly spaced.
c. Lighting must be integrated with other accents and reveals.
d. Specialty lighting shall be coordinated with predominate architectural features.
e. Decorative lighting and sconces shall be provided at all main entrances.
f. Lighting fixtures along rights-of-way must be spaced to avoid conflicts with tree plantings.The
heights of lighting fixtures must also avoid conflicts with tree plantings.
5.9 Signage at Community Entrance: Illuminated community identification shall be incorporated into
a stone screening wall or monument located at the Community entrance. The sign shall be
illuminated by means other than streetlights. Subject to visibility triangle standards. Shown on
Exhibit G.
5.10 Roofing:
a. A minimum variable roof pitch of inch to 12 inches and/or a flat TPO must be used.
b. Composite Spanish roof tile with a 30 to 50-year warranty must be used on visible roofing.
c. Building roof types, forms, and elements should provide variation and interest in building
profiles and contribute to the architectural identity of the buildings without creating an
imposing scale on adjacent uses.
5.11 Five-foot sidewalks shall be provided within and throughout the property.
5.12 Landscaping: Trees and specimens should be planted to coincide with the overall style and quality
of the development project.
a. Ground-level utility connections and mechanical equipment must be completely screened with
walls and landscape material which are compatible with the overall building and landscape
design.
b. Shall be provided close to the building to emphasize the pedestrian scale.
5.13 Energy Conservation:
a. Energy-efficient architectural lighting must be used.
b. LED lighting must be used for street lighting.
c. An HVAC of 18 to 23 SEER must be used.
d. Insulation, door, and window standard `R values' must exceed the minimum requirement of
the current International Building Code,as adopted by the City of Wylie at time of construction.

EXHIBIT D—AGREED I3LJILI)ING MATERIALS AND MI fmIUI)S STANDARDS
Architectural Design requirements for exterior building materials shall be achieved in
accordance with the following criteria:
1. Tract 1 Townhome Development
a. All townhomc units shall have 100 percent of each facade composed of masonry.
b. Masonry shall include brick, stone,or masonry stucco.
c. EIFS may be used as an accent material and comprise no more than 15 percent of any
facade.
d. Roofing materials shall be architectural grade overlap architectural shingles. metal.or
composite Spanish roof tile and other roof appearances shall be painted to match the
color of the roof.
2. Tracts 2,3,4,& 5 Mixed-Use Development
a. Primary front facade materials shall be a minimum of 80 percent masonry product
with at least 20 percent stone on the front facade.
b. Approved primary masonry materials include, brick, stone, masonry stucco. or
decorative concrete.
c. Up to 20 percent of the front facades may be stucco with decorative accents such as
cementitious fiberboard and metal trims.
d. The remaining three facades shall be a minimum of 60 percent brick or stone,and up
to 40 percent may be stucco with decorative accents such as cementitious fiberboard
and metal trims.
e. EIFS shall not be considered acceptable primary exterior material but shall be
accepted when applied as accent or architectural features and shall not exceed 15%
of any facade face.
f. To achieve facade articulation, visual variety and/or architectural detailing buildings
shall use two complementary primary facade materials.
g. Composite Spanish roof tile with a 30 to 50-year warranty must be used on visible
roofing,or a similar product.
IN WITNESS WHEREOF,the Parties have executed this Agreement and caused this
Agreement to be effective on the Effective Date.

LEGAL DESCRIPTION OF TRACT 1
SITUATED in the State of Texas and the County of Collin, being part of the R. D. NEWMAN
SURVEY, Abstract No. 660, being part of a called 4.95 acre tract of land conveyed to All East Inc.
by deed recorded in Document No. 92-0081176 of the Deed Records of Collin County, Texas and
being more particularly described as follows:
BEGINNING at a 1/2 inch iron rod capped "Roome" set for corner in the existing southeast right-

Discussion
OWNER: Shaw Children GS Trust and Carole C Shaw APPLICANT: Ping Interest
The applicant is requesting to rezone 24.5 acres located at 1751 McMillen Road. The property is currently zoned
Agricultural. The reason for the requested rezoning to a Planned Development is to allow for an age restricted mixed-use
senior residential community. The Planned Development contains three subdistricts that are proposed to contain different
categories of residential development for senior living.
The single-family subdistrict is proposed to contain a maximum 56 single family residential lots that measure a minimum
of 4,000 sq. ft. with dwellings that are a minimum of 1,100 sq. ft. The proposed setbacks are 10' for the front, 5' for the
sides and 20' for the rear. The subdistrict will be providing one garage space and two spaces per driveway. The exterior
material within the subdistrict is comprised of masonry or fiber cement lap siding and panels with at least 20%of the facade
being offset a minimum of 1'.
The multiplex subdistrict is proposed to contain a maximum of 45 residential rental units with a minimum dwelling square
footage of 470 sq. ft. for studio units,675 sq. ft. for one-bedroom units and 875 sq.ft. for two-bedroom units.The proposed
setbacks are 10' for the front, 5' for the sides and 20' for the rear.The subdistrict will be providing 82 parking spaces being
2 spaces per unit. The exterior material within the subdistrict is comprised of masonry or fiber cement lap siding and panels
with at least 20%of the facade being offset a minimum of 1'.

The multiple-care family subdistrict is proposed to contain a maximum of 160 assisted living residential units with a
minimum dwelling square footage of 470 sq. ft. for studio units, 675 sq. ft. for one-bedroom units and 875 sq. ft. for two-
bedroom units.The proposed setbacks are 10' for the front,5' for the side of corner lots,and 15' for the rear on any interior
lot line.This subdistrict will also allow the following accessory uses: civic center,cultural arts facility, fmancial institution
(without drive-thru), medical clinic, commercial amusement (low density), health club, theater, cleaners, general
merchandise store, grocery store, personal service use, restaurant without drive-through service, and a post office. The
subdistrict will be providing 166 parking spaces with 7 of those being handicapped parking spaces. The exterior material
within the subdistrict is comprised of masonry or fiber cement lap siding and panels with at least 25% of the facade being
offset a minimum of 2'.
Access to this development will be provided by private roads that have entrances from both McMillen Road and FM 1378.
All of the private roads will be striped and labeled as fire lanes. On-street parking shall be prohibited and so marked with
signage.
This development will be providing a variety of landscaping open space areas with trails,benches,fitness stations and picnic
tables. A 40' wide landscaped buffer with a 6' wrought iron fence between brick or stone columns will also be provided
adjacent to both of the main street frontages.
Notifications/Responses: Twenty-three notifications were mailed; with one response in favor and one in opposition of the
request.
P&Z Commission Discussion
The Commission voted to recommend approval 6-0.

A. Purpose
The purpose of this planned development district is to allow an age restricted mixed-use development
on an approximate 24.5 acre parcel located on Tract 27 of the Williams Patterson Survey, West of FM
1378 and North of McMillen Road. This community will contain retail, personal service, health club,
outdoor recreation, multifamily, assisted living, and single family uses. The regulations in this Planned
Development (PD) District will encourage high-quality site planning and design
in accordance with the City of Wylie's Comprehensive Plan.
B. District Regulations
1. General.
a. Subdistricts established:This PD shall be developed in three subdistricts as follows:
i. Subdistrict 1: Single Family Subdistrict
ii. Subdistrict 2: Multiplex Subdistrict
iii. Subdistrict 3: Multiple-Care Subdistrict
iv. The zoning exhibit(Exhibit C) shall serve as a subdivision concept plan for purposes of
Zoning and Land Design, Street, and Sidewalk requirements. Separate plat submittals
for all subdistricts shall be required. A separate site plan submittal for Subdistrict 3
shall be required.
2. Development of the Property shall generally conform to the following regulations:
a. Single Family Subdistrict
i. Except as otherwise provided herein, development of the Single Family Subdistrict
shall comply with the Single Family-10 District regulations of the 2019 City of Wylie
Zoning Ordinance.
ii. Permitted Uses: Uses permitted in the Single Family-10 are permitted in the Single

While I realize the property on the 1e;ortth side will not look like ours on
the South sides the issues are OPh,61ttN and impact. t:.mtth of these and other
concerns were raised in pLewluus public forums with Mr. Ping., as it related
to prior proposals. Cne Impact concern was sthoolls. Mr. Ping addressed
that one with the most recent proposal by going to the complete opposite
spectrum, elderly. But, more importantly, he went back to high density.
This is no place for a 4-story building of any kind. If you would not build
it in your front-yard, don't build it in mine. Not to mention my view will
include the dumpsters.
Density is still an issue, even worse now. mile the previous 50-foot wide
lots were not popular, the newly proposed 40-foot lots and multiplex housing
is even less acceptable. Based on Mr. Ping's original statement about how
the land is zoned. . ."we can build anything we want". . .and his initial scare
tactic of a rough plan of multi-story apartments and retail, he is not
interested in our community, only profit. I suspect he will continue to
bring un-popular proposals until we the people are numb and give up. Please
'be our voice.
What I am looking for is a design/plan that will blend the acreage on the
South with the existing housing on the North, keeping as much open
atmosphere as we can. The pond and open space immediately North of McMillen
is a great start. A housing addition with various lots sizes and top
builders as were used in the closest sub-division to the North, eg. Paul
Taylor and Grand, would blend nicely. Keep the smaller 50-foot lots to
less than 15%. Add in 15% of 70-foot lots and tt-hP remaining 60-foot or
larger. There should be a living square' footage minai nm of 2v00 sag ft or
larger. This should reduce the impacts and lower density, as well as
address the asthectics of the area.

Recommendation
A motion to appoint to the North Texas Municipal Water District(NTMWD) Board of Directors for
a term to begin June 1,2020 and end May 31,2022.
Discussion
The Board of Directors of the North Texas Municipal Water District is a policy making body similar in nature to the City
Council. The Board is responsible to both the State of Texas and to the member Cities for assuring that NTMWD
operations occur in accordance with state and federal law, in alignment with NTMWD policy, and in the best interests of
the Cities receiving services.
In accordance with the statute creating the District (Article 8280-141), the qualifications of a director include the
following: "No person shall be appointed a Director unless he resides in the city from which he is appointed. No member
of a governing body of a city and no employee of a city shall be appointed as a Director." Under other state law, no other
government official that receives compensation could be appointed.
NTMWD's existing Board (13-member cities) is comprised of individuals who have worked to represent their
communities in other capacities and who have a solid understanding of municipal concerns to share with other Directors.
Historically, Directors have dedicated from 10 to 30 years of service to the Board, thereby gaining experience and
contributing the necessary leadership. This provides the maximum benefit in order to assure the city's needs are met in
the most effective manner. All NTMWD programs provide service based on cost to serve, with all cities provided equal
treatment. Therefore, NTMWD policy established by the Board of Directors affects cost, performance, and quality of
service.
The City of Wylie has two board members on the NTMWD Board; Mr. Marvin Fuller whose term expires May 31, 2020
and Mr. Keith Stephens whose term expires May 31,2021.

Dear Mr. Hoisted:
The current term of office for some of the Directors of the North Texas Municipal Water District(NTMWD)
Board will end in May. Please accept this as your official notification that Mr. Marvin Fuller's current term
as an NTMWD Board Director will expire on May 31, 2020. The City Council has the option to either
reappoint Mr. Fuller or appoint a new Director to serve the term from June 1, 2020, to May 31, 2022.
The NTMWD appreciates the service Mr. Fuller has provided to the NTMWD. He was appointed by the
City of Wylie in 1996 and has been a leader on the Board serving as President, Vice President, and
Secretary. Mr. Fuller currently serves as Chairman of the Legislative Committee and on the Water,
Finance/Audit, and Policy Committees.

NTMWD BOARD OF DIRECTORS
ROLES AND RESPONSIBILITIES
The North Texas Municipal Water District (NTMWD) Board of Directors serves as the governing
body of NTMWD. The Board of Directors guides the NTMWD towards a sustainable future by
adopting sound governance and financial management policies and ensuring adequate resources
to meet the region's needs. The Board has a responsibility to provide guidance to management
and staff and ensure operations run smoothly and in accordance with the law. Some specific
responsibilities of the Board of Directors include:
• Establish and support the NTMWD mission and purpose
• Select and evaluate the Executive Director/General Manager
• Set policies and ensure effective planning
• Ensure adequate financial resources
• Monitor and strengthen essential programs and services
• Protect assets and provide proper financial oversight
• Ensure legal and ethical integrity
• Enhance the organization's public standing
The Board of Directors meets monthly — generally on the 4th Thursday of each month. This
schedule may be adjusted due to holidays. Some Directors will meet mid-month as well
depending on their Committee assignment.
The Board of Directors also meets in Special Workshops semi-annually for long-term planning as
well as on an as-needed basis for other purposes.
Each Board member serves on at least two standing Committees, such as:
• Water
• Wastewater
• Solid Waste
• Finance/Audit
• Personnel
• Insurance
Directors may also serve on the Legislative Committee, Special Purposes Committees as needed,
and the Chairman of each Committee serves on the Policy Committee.

Discussion
The mid-year budget amendments are generally intended to cover unanticipated and/or unavoidable revenue and expenditure
adjustments to the adopted budget. The detail is attached in Exhibit A for the requested items which are located within the
General Fund, Utility Fund and WEDC. The requests are further defined as neutral (matching revenues to expenditures),
revenue increases or expenditure increases. Salary and benefits savings from the first half of the fiscal year are included in
the amendment in the amount of$534,967.

AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, AMENDING
ORDINANCE NO. 2019-27, WHICH ESTABLISHED THE BUDGET
FOR FISCAL YEAR 2019-2020; REPEALING ALL CONFLICTING
ORDINANCES; PROVIDING FOR A SEVERABILITY CLAUSE; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Council heretofore adopted Ordinance No. 2019-27 setting forth the
Budget for Fiscal Year 2019-2020 beginning October 1, 2019, and ending September 30, 2020;
and,
WHEREAS, the City Departments and Divisions routinely review their budget
appropriations to determine if any changes are necessary; and
WHEREAS, based upon said review the City staff now recommends that certain
amendments to the Budget be considered by the City Council; see Exhibit A; and,
WHEREAS,the City Council has the authority to make amendments to the City Budget under
Article VII, Section 4 of the City Charter, as well as State law; and,
WHEREAS,the City Council has determined that the proposed amendments to the FY 2019-
2020 Budget; see Exhibit A, with the revenues and expenditures therein contained, is in the best
interest of the City; and therefore, desires to adopt the same by formal action.
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE
CITY OF WYLIE, TEXAS:
SECTION I: The proposed amendments to the FY 2019-2020 Budget of the City of
Wylie; Exhibit A, as heretofore adopted by Ordinance No. 2020-28, are, completely adopted and
approved as amendments to the said FY 2019-2020 Budget.
SECTION II: All portions of the existing FY 2019-2020 Budget and Ordinance No.2019-
27, except as specifically herein amended, shall remain in full force and effect, and not be
otherwise affected by the adoption of the amendatory ordinance.
SECTION III: Should any paragraph, sentence, sub-division, clause,phrase or section of
this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not
affect the validity of this ordinance as a whole or any part or provision thereof, other than the part
or parts as declared to be invalid, illegal, or unconstitutional.
SECTION IV: This ordinance shall be in full force and effect from and after its adoption
by the City Council and publication of its caption as the law and the City Charter provide in such
cases.

SECTION V: That all other ordinances and code provisions in conflict herewith are hereby
repealed to the extent of any such conflict or inconsistency and all other provisions of the Wylie
City Code not in conflict herewith shall remain in full force and effect.
SECTION VI: The repeal of any ordinance, or parts thereof, by the enactment of the
Ordinance, shall not be construed as abandoning any action now pending under or by virtue of
such ordinance; nor shall it have the effect of discontinuing, abating, modifying or altering any
penalty accruing or to accrue, nor as affecting any rights of the municipality under any section or
provision of any ordinances at the time of passage of this ordinance.

Reallocation of reimbursed funds to the Travel&Training accounts for both the Wylie Police Department and Wylie Fire and Rescue Telecommunicator for an annual allocation payment from Law Enforcement Officer Standards and Education. The Comptroller
is directed by the Occupations Code,Section 1701.157 to make an annual allocation from the LEOSE account to qualified law enforcement agencies for expenses related to the continuing education of persons licensed under Chapter 1701,Occupations Code,
which includes police officers and telecommunicators. By law these funds must be used for the continuing education of persons licensed under Chapter 1701,Occupations Code.The total amount of funds were averaged out over all the sworn officers and
telecommunicators as of January 1,2019 and funds were then divided between both PD and FD. The total funds allocated are$5,078.36. This reimbursement paid for 492 hours of police officer training and 128 hours for communication training.

In the summer of 2019,a Parks and Recreation vehicle,Unit 106,was involved in an accident. TML determined that the vehicle was not salvageable and paid the City for the estimated replacment cost of the vehicle,which was$22,665. Parks and Recreation
Department staff is requesting a new vehicle to replace Unit 106 due to the final settlement being reached with TML in August 2019 after FY 2020 budget was finanlized. Unit 106 was a 1.5 ton truck that had a water tank and was used for watering non-irrigated
park areas. Parks and Recreation staff has reorganized its use of vehicles withi the department and will be using an existing 1 ton vehicle in its current fleet for use as the new water truck. Re-allocating this 1 ton vehicle still leaves the department short a
vehicle. A 1/2 ton crew cab truck is being requested as a replacement for Unit 106. A 1/2 ton truck will provide the needed vehiclecapacity and will be more cost effective than purchasing a 1.5 or 1 ton truck.
